Division of Parks and Recreation Stone Mountain State Park Star Route 1, Box 17 Roaring Gap, NC 28668 Dear S irs: You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose of stabilizing a stream bank at Stone Mountain State Park, as you described in your application dated 5 February 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationxzde Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application.. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead %A-ith your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Region Coordinator Ilabitat Conservation Program DATE: January 23, 1996 SUBJECT: Review of an application by Stone Mountain State Park to improve wild trout habitat by stabilizing eroding stream banks at two sites on Big Sandy Creek; Alleghany County. Stone Mountain State Park is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U. S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and our field biologists have developed the plan submitted by State Parks. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 446 et. seq.) and the fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-6674). The applicant proposes to improve wild rainbow trout habitat by stabilizing approximately 100 linear feet of eroding stream banks at two sites along Big Sandy Creek ;n Stone Mountairr State Park. Big Sandy Creek is NCWRC Designated Public Moul?t.ain Trout Water trrrdcr the wild trout management program. The proposed project has the potential to reduce scd;rnentation and improve wild trout habitat with the use of root wads. Based on the inr:)rrnation provided by the applicant and the fact that our biologists are proponents of this project, we have no objection to the project as proposed. However, construction will be prohibited during the rainbow trout spawning period of December 1 to April 30 in order to protect the egg and fiy stages fionr sedimentation.
