Box 27 Shallotte, NC 28459 Dear Sirs: You have our approval to place fill material in 1.81 acres of wetlands or waters for the purpose of constructing a WWTP facultative pond at US 17 Bypass and 17 Business near Shallotte, as you described in your revised application dated 14 March 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you to not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733- 1786. The lagoon was relocated to this, sites from a previously proposed site due to groundwater concerns and concerns over wetland drainage. -,The current site was recommended by this office because a large portion of it is existing spray irrigation, fields which have recently been determined to be unsuitable for continued irrigation of wastewater due to a high groundwater table. It was also felt that the previously proposed lagoon site may be more valuable as a spray site than as a lagoon site. A meeting was held on March 7, 1996 with Dwight Wasser of McKimm & Creed to discuss further minimization of wetland impacts. We suggested that the lagoon location be moved as close to the access road as possible. This alignment would result in the loss of additional existing irrigation area but would also keep the majority of the irrigation areas away from surface waters. A revised PDN was submitted to this Office on March 14, 1996. With the lagoon moved as close to the road as possible, wetland impacts are reduced by 35 %. Total wetland impacts are now 1.81 acres. Part of this system will include a wastewater holding lagoon prior to a pump station which will apply the wastewater onto the ground surface by spray application. The lagoon is approximately 12 acres in surface area and wilhirnpact 2.88 acres of wetlands with the construction of its berm and excEfVoon of the, holding cells. The attached Plan Sheet C-1 shows the location of the lago.9n in relation to the wetlands. Michael Hosey with. the Corps of Engineers and Jim Gregson with North Carolina Department of Environmental Management have been to the site and done a site evaluation for the wetlands. Attached are seven (7) copies of the joint forms for the permits. It shows that.43 acres of the wetlands will be filled for the construction of the berms while 2.45 acres will be excavated for holding area, totaling approximately 2.88 acres.
