Ms. Linda Fluegel, for Departme~t,of the;Army (DA) authorization and a State
Water Quality Certification to ~a~'tain a Ghannel and basin on Jinks Creek,
off the Atlantic IntracoastalWateay (AIWW) , Sunset Beach, Brunswick County,
North Carolina. Your receipt of, th,s letter verifies your acceptance of a
valid request for certification ih.a~cordance with Section 325.2(b) (ii) of our
administrative Fegulations. ~~~
We are considering author:i.:iing the proposed activity pursuant to Section,
404 of the Clean Water Act, a~d we have det~rmined that a water quality
certification is required un9~r the provisi6~s of Section 401 of the same law.
A Department of the Army :permit will not be granted until the certification
has been obtained or waived>,', . ' ,

In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request'~c>:rcertification is a reasonable time for State

,In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the O\\'I1er of said property. then forward a copy of the
deed Or other instrument under which the owner claims
title. plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 71.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers. landmarks, and
the like.
A stormwater management plan,if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management and should be advised by the applicant of
that opportUnity.

Proiect Narrative
'riparian landowners to Jinks Greek have petitioned the Town of Sunset Beach to
t>btainthe permits necessarytore-predge the channel along Jinks Creek in order to
provide boating access to theirprdpertY during low tide. This channel was originally
dredged in 1972 and the east and west entrances were maintained in 1987.
Appro?<imately 30,000 cubic yards of material will need to be dredged in order to
provide sufficient depth for boating access during low tide. This material is proposed
to be disposed of in a spoil area located directly across the Intracoastal Waterway from
the project. Permission has been obtained from the landowner, Mr. Edward Gore, to
use the spoil site.

'. 'darea,but none of them are n ,ore.than several hundred yards long and all of them dead end

"';jite\rlouslybeen dredged (State permitU2411l:pto access Bill's Seafood Market and Restaurant located
, at the corner of the above referenced s~~;!Y Turtle Creek, on the east side of the project, was
tiginaUy excavated to create'a canal, from Shoreline Dr. E. tO,the AIWW. Maintenance dredging, on
i~ southern half of that channel, was completed in 1987 (State Pennit #73-87). Jink's Creek, located
1ntb.~c~Ilter of the project area islittle more than a marsh cove, with a narrow channel, 3-6 feet wide,
IU1lni1ig through the, Smooth Cordgrass (Spartina alterniflora) marsh. There is a border of Smooth
'Cordgrass along the entire length of the proposed project's shoreline, ranging in width from 20 to 70
feet. At, it's transition to high ground, this regularly flooded' wetland border is fringed with high marsh
species, including; Saltwart (Salicorniaspp.), Sea Lavender CLimonium, spp.), Sea Oxeye CBorrichia
.' friitescens), and Salt Meadow Grass (Spartinapatens).W aterward of the shoreline's marsh fringe there
is an unvegetated shallow water flat that is',basically dry at low water. The applicants report that a
channel was dredged through this area ip. 1972, however, no documentation was included in this
application. An island-like expanse of Smooth Cordgrass marsh, 50 to 280 feet wide, separates this area
from the open water of the AIWW.
The waters in the project area are classified SA., by the NC Division of Environmental Management,
and are CLOSED to the harvest of shellfish. The area is designated as a Primary Nursery Area (PNA)
by the NC Division6fMarine Fisheries. The 'Atlantic Intracoastal Waterway is approximately 500 feet
wide at this location.
The applicants propose to excavate aU-shaped channelfroril theAIWW at Mary's Creek, then parallel
to the shoreline through the shallow water flat, and return to the waterway at Turtle Creek. The channel
would be 2875 feet long and 30 ft. wide, ex;c~t it would expand to a 40 ft. width through the corners
where the channel turns parallel to the shoreline:'The ,proposed d~th is -8 feet at Jv!LW. The applicants
predict that the side slope stabilization of the' 30-40 feet qox cut would produce a 55-65 feet top width
of the channel. The excavation would be, done by hydntulicdredge, and the excavated material pumped
to an existing spoils disposal area located directly across the waterway. The diked disposal area is
approximately 1700 feet long and 400 feet wide.
10. ANTICIPATED IlVIPACTS
t: The proposed project would disturb approxirnately,127, 125 square feet (2. 9 acres) of shallow water
bottom in Primary Nursery Area. There would be s9me short-tenn turbidity associated with the
dredging activity. Approximately 30,000 cubic yald~ of spoil material would generated from the channel
, exsavation, and deposited over a 680,000 square feet(15.6 acres) hi~hground disposal site. Although
