We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification is required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, in most cases, 60 days after receipt of a request for certification is a reasonable time for State action. Therefore, if you have not acted on the request, or asked for an extension of time, by October 6, 1995, the District Engineer will deem that waiver has occurred. PROJECT DESCRIPTION The project site is a 569 acre tract, located just south of the Town of Shallotte, adjacent to the Shallotte River, in Brunswick County, North Carolina. The east side of the property is bordered by the Shallotte River. The property includes, and is oriented around. the existing Copas Shores Subdivision, which includes Copas Road (SR 1191) and several other existing private residential streets. The property is outside of the corporate limits of the Town of Shallotte, but within the Town's extraterritorial planning jurisdiction. The existing roads and out parcels of the already developed Copas Shores Subdivision, are shown on a map attached to the application. The remaining undeveloped acreage is predominately wooded uplands. There are areas of mature Longleaf and Loblolly Pine forests, as well as, areas of mature OakiHickory hardwood forest. There are four existing ponds on the tract. The largest is located in the south central portion of the tract, and is known as the Mill Pond. State Road 1191 runs across the dam of Mill Pond Lake, which separates the lake from the inter-tidal marshes of the adjacent river. There is a connected, tidal canal which runs east-west, along the south side of the lake. The canal is 30 - 40 feet wide, with narrow borders of Smooth Cord-grass (Spartina alterniflora) on either side. The canal receives overflow from the lake spillway. There is extensive evidence of beaver activity around this lake. The wetlands within the tract have been delineated and approved by the U. S. Army Corps of Engineers. Some of the inland wetlands are isolated. but most are associated with drainage corridors, or existing and remnant ditches. The wetland types vary from Sweet Gum/Red Maple hardwood bottom, to Pine/Red Bay pocosin, to coastal tidal wetlands along the shoreline of the Shallotte River. Much of the uplands adjacent to the river consists of high bluff shoreline. In the lower portion of the river (southern), there are extensive Smooth Cordgrass marshes (Spartina altemiflora) adjacent to the water. In the upper portions of the river (northern), the adjacent marsh is primarily Black Needle-rush (Juncus roemarianus), with narrow borders of S. altemiflora adjacent to the open water corridors. The waters of the Shallotte River are classified SC, from U.S. Hwy 17 to the mouth of the Mill Pond, and SA, from the mouth of the Mill Pond to the ICWW, by the N. C. Division of Environmental Management. The lower portions of the Shallotte River are 0 PE1V to the harvest of shellfish. All of the Shallotte River, in the project area is designated as Primary Nursery Area by the N. C. Division of :Marine Fisheries. The applicant is proposing to construct an eighteen hole golf course and clubhouse. with amenities, as well as, new subdivision streets and utilities which would create the subdivision infrastructure for 571 single-family residential lots. There are five areas within the tract that have been designated for future multi-family development. Wastewater for the development would be provided by individual septic tank and/or LPP subsurface sewage systems. Potable water would be provided by the Brunswick County system. The proposed streets and culvert installations are shown on the project drawings. The construction of the golf course would involve significant land clearing and soil disturbance during the landscaping of the fairways, tees, greens, etc.. It would include the excavation of four (4) ponds from federally regulated wetlands (2.46 acres). Excavated material would be used to landscape upland golf course features. There are eight (8) golf cart bridges proposed, that would be elevated over wetlands (totaling 840 ft. Y 8 ft.), and eleven (11) proposed bulkhead/rip rap shoreline stabilization sites. All of the bulkheads and/or riprap would be located above vIHW and landward of the Corps and/or CAM A wetland line. New road construction would consist of a 20 feet wide paved travel way, within a 60 ft. right-of-way. Presumably, utilities would be installed below ground within the right-of-way. Road construction would include 51 culvert installations and the construction of a vellicular bridge near the proposed Clubhouse site (Pg. 2 of 9). Page 3 • 10. AiMCIPATED EMPACTS The construction of the proposed golf course would disturb approximately 191 acres of land during the clearing, grading, and landscaping of fairways, greens, and tees, and the construction of roads. The proposed excavation of four (4) ponds, within federally regulated wetlands would convert 2.46 acres of pocosin type wetlands to shallow water habitat. Other wetland impacts include the loss of .24 acres resulting from nine (9) road crossings, and a 1.17 acre wetland loss from golf cart path and fairway fill sites. The applicant proposes to mitigate for the wetland conversion and loss, by converting 3.9 acres of uplands, to a planted wetland shelf, adjacent to the pond sites. At build-out, approximately 14 % of the tract would be converted to impervious surfaces. Although this percentage is' 1/2 of regulatory allowances for low-density development, as with any development, there would certainly be a contribution to the accumulative long-term impacts to the water quality of the adjacent watershed. As discussed in the application package Mr. R.D. White, et.al. owns the 569 acre property and they desire to construct the 18 hole golf course with clubhouse and amenities plus plat and develop 571 single family residential lots. Mr. White also has 3 multi-family sections which will remain undeveloped until public sewer becomes available. With this CAMA Major submission the sedimentation control plan and stormwater plans are also being included as vital parts of the application package.- A summary of 404 wetland impacts is attached as a reduced 11'x 17" color coded map which helps to illustrate various locations of specific land use impacts. The $250.00 application fee and a sheet containing riparian land owner names and address is also attached. On some adjacent riparian neighbors Mr. White has explained the project personally and on others he has mailed the attached "Notification Letter" by Certified Mail, Return Receipt Requested. As the return receipts come in Mr. White will forward them to you. As to CAMA concerns there will be no saltmarsh or estuarine waters directly filled or excavated. There will be, however, 7 elevated wooden cart paths over saltmarsh vegetation but in order to reduce shading impacts they will be at least 6 ft. above the MHW contour. Also, there are potentially 11 separate locations for bulkhead/riprap retaining walls all at or above all 404 wetlands and/or MHW or NWL contours. The purpose of the 2250 L.F. of bulkheading is to stabilize either existing eroding bluffs or help prevent sediment from newly constructed fairways from reaching saltmarsh areas. 10 s Ed Brooks Page 2 The 404/CAMA wetlands were identified during the Fall of 1993 and the Corps approved the line in January of 1994. The wetland lines are illustrated on the attached bluelines. In order to save money, the 404/CAMA wetland line is used as the MHW contour which Mr. White recognizes increases his impervious cover ratios. Finally, the 3.87 acres of "woody" 404 wetlands which will be impacted with fill or excavation are to be mitigated by a 1:1 replacement by the creation of shallow ponds out of uplands and the planting of a 40' wide wetland shelf around their perimeters which will be planted with emergent grass like plant species. We've had some very productive on-site meetings with Rudy Scheiner and Michael Hosey of your staff and Ed Brooks of DCM, as well as dialogue with DEM's Stormwater and Water Quality staff and the final design is a reflection and compromise of many of the agency concerns. Mr. White wanted me to thank you for your staff's valuable input. What follows is a discussion of the 3 MOA criterion and "The Rocks" design/ construction scheme to achieve full compliance. (A) The Least Damaging Practical Alternatives: As is illustrated on the "Summary of 404 Wetland Impacts" color coded map (attached) the major wetland impacts will occur within pine flat wetlands by 9 proposed road crossings, 4 new shallow irrigation ponds, and fairway land clearing activities. The golf course development was carefully sited on the 569 acre property in such a way to cause the loss of 3.87 acres of interior woody wetlands. With a .site this large only .24 acre will be disturbed for the fill road crossings, 1.17 acres for the mechanized land clearing is fairways, and 2.46 acres is new wetland ponds. Since much of the site had existing streets, existing home sites, and was previously platted, the golf course architect and engineer laid out this land plan as the least damaging alternative. SEP J 5 1995 ENVIRONMENTAL SCIENCES 'np?0 r'N •P { 2 (B) Practical Steps to Minimize Wetland Losses: The goal of the project design was to minimize 404 wetland loss to less than 4 acres and to prevent any disturbance to CAMA salt marsh areas. In order to achieve these goals a series of 8 elevated wooden cart paths will be utilized within the golf course and one vehicular bridge will minimize damage to "adjacent" wetlands. Only the pilings will disturb the wetland surface and they will be raised high enough 41-6' along grade in order to assure native vegetative cover. You probably noted that the applicant proposed 11 bulkheaded locations totalling 2250 L.F. of estuarine shoreline. While this may seem excessive it should be emphasized that the bulkhead/stone revetments will only be used to stabilize eroding shorelines and retain potential siltation and sediment runoff from land disturbing activities. Each retaining wall structure will be situated at or above the wetland lines previously surveyed and contain erosion/siltation activities on the downslope side of sand fence barriers. You should also note that the 571 single family residential lots are platted in such a way to avoid most wetland impacts and maintain adequate space for a typical home. The applicant fully realizes that some of the lots may need minor lot line revisions in order to maximize useable space and he will establish deed restrictions to educate future lot buyers of wetland restrictions. (C) Practical Mitigation/Compensation of Unavoidable Impacts: As was discussed with your staff the applicant wants to achieve a "No Net Loss" goal. Therefore, for the 3.87 acres of interior woody wetlands which will be disturbed, another 3.9 acres of fresh water pond/emergent wetland will be created. It is anticipated the ponds will be dug to a 6-7 ft. depth and around their edges a shallow 40 ft. wide emergent wetland shelf will be established. In addition to volunteer sedges and rushes a mixture of Pickerel-weed (Pontederia cordata); Bull Tongue (Sagittaria falcata); and Lizard Tail (Saururus cernuus) will be planted to help mitigate other wetland impacts noted above. Dear Ed: Enclosed please find 24 copies of the blueline drawings of "The Rock" which details all of the proposed interior wetland 404 impacts and dimensions of the various site improvements. As discussed in the application package Mr. R.D. White, et.al. owns the 569 acre property and they desire to construct the 18 hole golf course with clubhouse and amenities plus plat and develop 571 single family residential lots. Mr. White also has 3 multi-family sections which will remain undeveloped until public sewer becomes available. With this CAMA Major submission the sedimentation control plan and stormwater plans are also being included as vital parts of the application package.' A summary of 404 wetland impacts is attached as a reduced 11'x17" color coded map which helps to illustrate various locations of specific land use impacts. The $250.00 application fee and a sheet containing riparian land owner names and address is also attached. On some adjacent riparian neighbors Mr. White has explained the project personally and on others he has mailed the attached "Notification Letter" by.-Certified Mail, Return Receipt Requested. As the return receipts come in Mr. White will forward them to you. As to CAMA concerns there..,will be no saltmarsh or estuarine waters directly filled or excavated.` There will be, however, 7 elevated wooden cart paths over saltmarsh vegetation but in order to reduce shading impacts they will be at least 6 ft. above the MHW contour. Also, there are potentially`-11 separate locations for bulkhead/riprap retaining walls all'at or-above all 404 wetlands and/or MHW or NWL contours. The purpose,of the 2250 L.F. of bulkheading is to stabilize either existing ero'ding,.bluffs or help prevent sediment from newly constructed fairways tr-om' reaching saltmarsh areas. f Ed Brooks Page 2 The 404/CAMA wetlands ''were identified during the Fall of 1993 and the Cotps approved the line in January of 1994. The wetland lines are illustrated on the attached bluelines. In order to save money, the 404/CAMA wetland line is used as the MHW contour which Mr. White recognizes increases his impervious cover ratios. Finally, the 3.87 acres of "woody" 404 wetlands which will be impacted with fill or excavation are to be mitigated by a 1:1 replacement by the creation of shallow ponds out of uplands and the planting of a 40' wide wetland shelf around their perimeters which will be planted with emergent grass like plant species. (NJ&A) conducted an endangered and threatened species survey on the White Investment Properties tract. This tract is comprised of approximately 250 acres located in Brunswick County south of Shallotte, North Carolina along S.R. 1191. Secondary road 1191 forms the dam for The Millpond lake. The majority of the acreage surrounds the lake on the northern, western, and southern sides. Most of the property is dominated by longleaf pine with some patches of loblolly pine. The wetland drainages on the tract are dominated by mixed oaks with an understory of ericaceous shrubs. The U.S. Fish and Wildlife Service provided a list of endangered/threatened species for Brunswick County. The Natural Heritage Program database was checked to determine known locations in the vicinity for any of the listed species. Preserved specimens of the plants were reviewed prior to the field survey at the UNC- Wilmington herbarium. The survey consisted of searching the appropriate habitats on-site as well as off-site areas within a half-mile radius (a special requirement for the red-cockaded woodpecker). The survey consisted of 6 man-days of effort. The Natural Heritage Program has no known locations for any of the listed species in the vicinity of the property. No appropriate habitat exists on-site for the following listed species: Shortnose sturgeon, Florida manatee, Piping plover, Loggerhead sea turtle, Green turtle, Leatherback turtle, Kemp's ridley sea turtle, and Seabeach amaranth. No Bald Eagles or nests were observed on the property or in the general area. No Wood storks were observed during the field survey. Since the survey was done during June, it was not surprising that the Arctic peregrine falcon was not sighted since it is more likely to be seen during the fall migration. No tracks or other evidence of the Eastern cougar were observed. No evidence of the American alligator was observed on the property but suitable habitat exists in the form of the millpond and possibly along the edge of the Shallotte River. The bulk of the field survey effort was spent looking for the three most likely species: Red-cockaded woodpecker, Rough-leaved loosestrife, and Cooley's meadowrue. The proposed work includes the excavation of 2.46 acre of wetla for the purpose of creating ponds within a golf course and the ruction of roads and golf cart paths. Eight golf cart bridges elevated over wetlands are also proposed. The purpose of the work is to create a golf course and associated residential development, which will result in impacts to approximately 3.9 acres of wetlands, located adjacent to the Shallotte River, off of Copas Road (SR 1191), near Shallotte, in Brunswick County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be done in strict compliance with the permit plans. 2. All excavated materials will be confined landward of the mean high water (MHW) elevation contour within adequate dikes or other retaining structures to prevent the spillover of solids into any vegetated wetlands or surrounding waters. 3. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 4. The fill material will be clean and free of any-pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 5. The activity will be conducted in a way that prevents a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required State/Federal coordination. 7. If possible, under applicable law, the permittee will incorporate this permit as part of the documents reflecting title to or interest in the real property affected. 8. Mitigation to offset the impacts 3.87 acres of woody wetlands resulting from the proposed project will be the excavation of shallow ponds in high ground. A 40 foot wide fringe around the perimeter of each pond will be planted with species of emergent grass. 9. Prior to beginning any work, a detailed mitigation plan will be submitted to and approved by the U. S. Army Corps of Engineers (USACE), the North Carolina Division of Coastal Management (NCDCM), and the North Carolina Division of Environmental Management (NCDEM). 10. Within the wetland mitigation areas, the physical and chemical properties of the soils will be suitable to support target plant species. Hydrology will be maintained such that the soils are either saturated within 12 inches of the surface, or ponded or flooded for at least 12.5 percent of the growing season under reasonably average climatic conditions. The geomorphology of the area will be suitable to meet hydrology requirements with regards to contours, elevation, and drainage/connections with surface waters. 11. The plan will list wetland vegetative species to be planted. The plan will also describe the numbers of each species to be planted and the planting plan. Changes in planted species and locations of planted vegetation may be altered in accordance with onsite field.conditions. Finalization of the planted species and the locations of each species will be located on a map and forwarded to the USACE, NCDCM, and NCDEM. 12. Survival rates of each species will be at least 80 percent of the number planted. Survival rate monitoring will be c#nducted for three years from the initial planting, and will occur at the beginning and the end of each growing season. If a.survival rate of less than 80 percent occurs, the species will be replanted in accordance with the original planting plan, and a new three year monitoring period will begin. 13. Failure of any of the proposed parameters will result in your arrangement of a meeting with the USACE, NCDCM, and NCDEM to allow approval of a revised plan. 14. By 1989 V. americans was present in 138 sample plots. The only floating-leaved species present in 1987 were Nelumbo lutea and Nympha°ea odorata, however, only N. lutea became established by 1989. In 1987 it was present in 68 plots, but by 1989 it was present in 310 plots. N. odorata was present in 44 plots in 1987 and in no plots in 1989. In Par Pond, N. odorata and B. schreberi occur in protected areas such as coves. Water flow from reactor discharge may prevent these two species from occurring near discharge points (Grace 1984, unpublished).
