Dear Mr. Weeks:
On March 20, 2001, Danny Smith for the Central Office conducted a site visit of
the subject Marina in response to a compliant. A subsequent file review confirmed that
on May 31, 1996 a state issued 401 Water Quality Certification was issued. This
Certificaiton is issued under the authority of the Section 401 of the Clean Water Act in
addition to the Section 404 permit issued by the Corps of Engineers. Specifically, the
state 401 Water Quality Certification stated the following:
" The plan for the marina shall be altered to remove all 90 degree angles. The
plan for the entrance channel shall be altered to require that 80 foot wide V-
notched weirs as depicted in your 29 April 1996 letter to Rob Moul shall be
installed at 4 locations along the breakwater to increase circulation in the access
channel. The outermost weirs shall be centered approximately at 250 feet form
the marina."
The site visit did not reveal any weirs. Please clearly indicate why these structures
are not in place. You should also explain how you plan to comply with the 401 Water
Quality Certification. If alternatives designs have been used, please provide this office
information confirming that surface water standards will not violated includeing plans
that detail the alternative. Also, you should offer any additional information as to why
this office should not proceeded with a Notice of Violation and develop a civil penalty
recommendation regarding this matter.
These violations and any future violations may be subject to a Civil Penalty
Assessment of up to $25,000 a day for each violation. Please respond to the above
mention information request within 15 days of receipt. Thank you for your attention to

Deep point Marina - Southport, TtiC
Dear Mr, Brooks:
Bald Head Island Management, inc. is currently constructing the first phase of the Deep Point
Marina under a Major CAMA Permit. During the course of final engineering and planning,
several minor program and layout changes have been recommended. We are forwarding the
phase one modifications for your review.
We are requesting issuance of a, letter of pemit refinement acknowledging and approving the
following refinements:
I. Final layout of the marine maintenance, contractor parking and barge landing service areas.
These areas have been refined from the Master. Land Use Plan approved under the permit.
2. A final perforated bulkhead design. for the wetland. and marsh. zones bordering. the marina
channel to promote flushing, The proposed bulkhead detail. and. location are attached (see
bullhead type 1-2).
3. Construction of a temporary contractor's ferry landing and temporary bulkhead immediately
north of the barge landing. Both structures will be removed after Phase Two marina basin
improvements are completed.
Also attached for your files is a copy of the Phase One stormwater and erosion control plans
which have been submitted to NCDWQ and NCDLQ, respectively, Please cunta4t me if you

Bald Head Island Management, inc. is currently constructing the first phase of the Deep Point
Marina under a Major CANiA Permit. During the course of final' moneering and planning,
soverai minor program and layout changes have been recommended. We are forwarding the
phase one modifications for your review.
We are requesting issuance of a. tatter of permit refinement acknowledging and approving the
following refinements:
1. Final layout of the marine maintenance, contractor parking and barge landing service areas.
These areas have been refined from the Master. Land Use Plant approved under the permit.
2. A final perforated bulkhead design. for the wetland aatd marsh. zones bordering. the marina
channel to promote flushing. The proposed bulkhead detail, and. location are attaclied (see
bulkhead type 1-2).
3. Construction of a temporary contractor's ferry landing and temporary bulkhead immediately
north of the barge landing. Moth structures will be removed after Phase Two marina basin
improvements are completed.
Also attached for your files is a copy of the Phase One stormwater and erosion control plaits
which have been subruitted to NCDWQ and NCDLQ, respectively. Please contaut me if you
require any additional information or clarification concerning this request. If desired, we are

Dear Mr. Weeks:
You have our approval to place fill material and dredge 2.74 acres of wetlands or waters (0.21 acres of
wetlands) for the purpose of constructing a marina and operations complex at Pfizer Tract (NC 211 and
Southport/Ft. Fisher Ferry terminal), as you described in your revised application dated 15 February 1996. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Numbers 3025 and 2668.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, -you must nodfX us and Xou Wag be wired to send a new a lication. For this
approval to be valid, you must follow the conditions listed in the attached certification. a plan for the marina ;-
shall be altered to remove all 900 angles. The plan for the entrance channel shall be altered to require that 80
foot wide "V-notched wiers" as depicted in your 29 April 1996 letter to Rob Moul shall be installed at 4
locations along the breakwater to increase circulation in the access channel. The outermost wiers shall be
centered approximately at 250 feet from the marina. Deed restrictions shall be placed on all remaining
jurisdictional wetlands to prevent future fill except for unavoidable road crossings and utility corridors. In
addition, you should get any other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. "
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding
unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401 of the

Bald Head Isla nd Management, Inc. is currently preparing final engineering plans for the marina
channel bulkhead and jetty at the Deep Point Marina. Our project engineer, Mr. Rod Andrew of
Andrew & I'us e c mmended that the breaks in the bulkhead system designed to improve
marina channel flushing be limited to one section of bulkhead along the southwest alignment. We
are bringing this matter to your attention for your review and approval.
The original marina channel location was realigned at the request of the NCDCM to reduce fringe
marsh impacts. The bulkhead and jetty were designed to provide sheltered passage and dockage
for the barge and ferry boats. We are recommending that a 160 foot section of the southwest
bulkhead alignment be left open for tidal flushing. The remainder of the bulkhead and jetty system
will be continuous to provide the needed sheltered passage, and- stable dockage required for the.
barge landing.
We feel that this refined design meets the intent-of the original request to provide additional: tidal
flushing to the channel and basin while providing safe passage for the barge. Drawings
summarizing this refinement are attached for your review.
The construction of the marina is currently underway. We would appreciate your timely review
and approval of this refinement. After your review, please- call or issue a letter notifying us that
this refinement is approved or what changes maybe needed so that we may finish final design and
implementation. We are available at your convenience to meet with you in Wilmington or if

Re: Ports in jetty walls at Deep Harbor basin, Southport - Brunswick County.
State Permit #91-96
I visited this site on the morning of July 31, 2001 for the purpose of observing the
existing ports installed along the entrance channel jetties for the subject project. I
observed that the elevation of these ports was responsible for the transport of sand
from the river bottom through the jetties with a resulting shoaling within the entrance
channel. My understanding is that the DCM permitted the ports as a modification to
the subject permit as a result of a requirement by DWQ on the permittee. My
observations indicate to me that this effort is detrimental to the operation of the
facility.
My recommendation is that DWQ remove the requirement for these features or advise
the permittee what goal should be considered in any redesign of similar structures if
they are necessary for the maintenance of water quality in the permit area.

. Through coordination with the North Carolina Division of Coastal
Management, we have learned of your request to use an alternate design for
entrance channel breakwaters, allowing water flow to the adjacent marsh areas.
The Department of the Army permit issued on July 2, 1996, authorized dredging
of 9,000 square feet of vegetated wetlands and an additional 110,400 square
feet of non-vegetated wetlands and shallow bottom, in the Cape Fear River,
adjacent to the Prices Creek Southport/Fort Fisher ferry, on NC 210, east of
Southport, in Brunswick County, North Carolina.
Your work continues to be consistent with the provisions and objectives
of general permit No. 198000291. The permit is hereby modified to include the
work as shown on the enclosed plan. It is understood that all conditions of
the original permit remain applicable and the expiration date is December 31,
1999.

channel bulkhead and jetty at the Deep Point Marina. Our project engineer, Mr. kod Andrew of
Andrew & Kuske has recommended that the breaks in the bulkhead system designed to improve
marina channel flushing be limited to one section of bulkhead along the southwest alignment. We
are bringing this matter to your attention for your review and approval.
The original marina channel location was realigned at the request of the NCDCM to reduce fringe
marsh impacts. The bulkhead and jetty were designed to provide sheltered passage and dockage
for the barge and ferry boats. We are recommending that a 160 foot section of the southwest
bulkhead alignment be left open for tidal flushing. The remainder of the bulkhead and jetty system
will be continuous to provide the needed sheltered passage' and stable dockage required for the
barge landing.
We feel that this refined design meets the intent of the original request to provide additional: tidal
flushing to the channel and basin while providing safe passage for the barge. Drawings
summarizing this refinement are attached for your review.
The construction of the marina is currently underway. We would appreciate your timely review
and approval of this refinement. After your review, please- call or issue a letter notifying us that
this refinement'is approved or what changes maybe needed so that we may finish final design and
implementation. We are available at your convenience to meet with you in Wilmington or if

We are requesting issuance of a letter of permit refinement acknowledging and approving the

On March 20; 2001, Danny Smith for the Central Office conducted a site, visit of
the subject Marina in response to a compliant. A subsequent file review confirmed that
on May 31, 1996 a state issued 401 Water Quality Certification was issued. This
Certificaiton is issued under the authority of the Section 401 of the Clean Water Act in
addition to the Section 404 permit issued by the Corps of Engineers. Specifically, the
state 401 Water Quality Certification stated the following:
The plan for the marina shall be altered to remove all 90 degree angles. The
plan for the entrance channel shall be altered to require that 80 foot wide V-
notched weirs as depicted in your 29 April 1996 letter to Rob Moul shall be
installed at 4 locations along the breakwater to increase circulation in the access
channel. The outermost weirs shall be centered approximately at 250 feet form
the marina."
The.site visit did not reveal any weirs. Please clearly indicate why these structures
are riot in place. You should also explain how you plan to comply with the 401 Water
Quality Certification. If alternatives designs have been used, please provide this office
information confirming that surface water standards will not violated includeing plans
that detail the alternative. Also, you should offer any additional information as to why
this office should not proceeded with a Notice of Violation and develop a civil penalty
recommendation regarding this matter.
These violations anndany future violations may be subject to a Civil Penalty
Assessment of up to $25,000 a day for each violation. Please respond to the above

Per your request I have reviewed the draft dissolved oxygen monitoring plan for the Bald Head Island
Deep Point Marina near Southport. Based on the draft provided and previous work done by the Division
related to marinas and water quality (DWQ - Report No. 90-01), 1 suggest the following:
• Sampling should be increased to include high and low tides due to the tidal amplitude of this
portion of the Cape Fear River.
• Since this is a short time frame (August-September), twice weekly sampling is advised to provide
a more robust data set.
• Tidal stage should be recorded during each sampling event.
• The stations appear to be located appropriately for the intent of the study.
• Since we are using average summer basin DO to determine compliance with the DO standard
and taking into consideration the wide tidal fluctuations, I doubt that measuring diurnal variations
would significantly impact the final average DO concentrations.

Bald Head Wand Marina will be implementing a short-term water quality monitoft
program intended to document ambiam dissolved oxygen (DO) conoontirations from July
2003 to September 2003. The program is being initiated in response to requests by NC
Division of Water Quality to demonstrate that basin Da concentrations are similar to
ambient conditions found in the Cape Fear River.
proposed sampling will span the mid to late summer months (July through September) tQ
capture seasonally-reduced DO (correlating with iaaw sed water temperatures and
increased biological oxygen demand). A total of seven (7) stations (soc attached map)
will be emablished and sampled twice per month, Five (5) of the stations will be located
within the matins basin and entrance channel. Two (2) reference stations will be located
within the Cape Fear River west of the entranee obaun 1. At each station, DO (mom )
will be. measured with a hand-held YSI inamment at three depths (surpm, mid, and
buttom)_ Temperature (°C ), salinity 00), and conductivity (wS) will also be recorded at
each of the three depths. In addition, qualitative weather information (a. g. approximate
air temperature, rwiad direction, and relative cloud cover) will be dooumented at the time

Dear Mr. Dorney:
Thank you for your time by phone today to address some of the issues that l have brought to
your attention, in writing and verbally, during the month of May. Your validation that Bald
Head Island Barge Marina is in violation of their 401 Certification, as stated above, is a step
in the direction toward some form of resolution.
You indicated today in our conversation that CAMA and Charles Jones have been notified
that BHIBM is in violation. You also have 2 phone-mail messages from me today requesting
that your office fax to me a copy of the written notification you have provided to CAMA and
Mr. Jones regarding this violation.
Lastly, this will confirm our meeting at your office in Raleigh on Monday, June 2, 2003 at 11
AM. At that time I will lay out clearly the connection between BHIBM and the injustices
brought to our community. In addition I will clarify for you any questions you have about the
factual errors and misinformation that were made an official part of our application for
channel-protecting structures. These errors occurred with our first request on March 20,
2000; and many were carried forward with our second request on December 13, 2000.
These factual errors and misinformation were disseminated by DCM, over our objections, to
the reviewers at the 14 or so state and federal agencies reviewing our project. This
misinformation was the primary source upon which the reviewers based their OBJECTIONS.
Again thank you for your time and for your honest and forthright input.
