Enclosed are the redesigned plans for the Cracker Barrel Old Country Store on 1-
95, Fayetteville, Cumberland County, North Carolina. Specifically, these plans
incorporate a permanent wet stormwater detention pond, a reduction in parking area, and
a reduction in wetlands fill (0.3 acre) from that requested in our State 401 Water Quality
Certification application.
Hopefully, this information will be adequate to allow prompt processing of our

The storm water detention pond proposed by Cracker Barrel Old Country Store,
Inc. to treat stormwater draining from the Fayetteville Cracker Barrel ha.. been fully
reviewed. After having the engineering firm of Design and Engineering, Inc. modify the
initial pond design to include a forebay, the pond should now perform as an acceptable
water quality control measure,
Cracker Barrel Old Country Store, Inc, ha.. also committed to the continuing
maintenance of the pond with a maintenance agreement signed by Mr. Don Kravitz, Vice
President of Development, who can be reached at (615) 444-5533. If there are any further

Monthly, or after every runoff-producing event. whichever comes first:
A.
Remove debris from pond.

Check and clear the orifice of any obstructions.

Check pond sideslopes. Repair any eroded areas before the next
rainfall event.
II. Quarterly:
A. Inspoct the stormwater collection system (pipes & flumes) for proper
functioning. Clear any accumulat.ed trash from catch basin grates
and bottoms and remove any obstructions from piping.
B. Check pond inlets for undercutting. Replace riprap as required and
repair any broken pipes.
C. Reseed grassed areas twice a year as necessary. Immediately
repair any eroded areas.
III. Every 6 Months:
A. Remove any accumulated sediment fl'Om the outlet structure and
dispose of off-site in an approved manner.
B. Check the pond depth at various points in the pond. If the depth is
reduced to 3' (75% of the design depth of 4') rerYlove sediment to at
least tile original des.ign depth. Dispose of sediment o'ff~site in an
approved manner.

IV. General:
A. Maintain pond sideslopes, not including normally SUbmerged
vegetated shelf according to the season. Grassed areas shall be
mowed to maintain a maximum grass height of a" .
B. Cattails and other indigonous wetland plants are encouraged along
the perimeter of tl1e pond. Should plants cover the entire surface
area of the pond, they are to be removed to the perimeter of the
pond.
C.
The orifice is designed to draw down the pond in 2 to 5 days. If
drawdown does not occur within that time, the system may be
clogged. The source of clogging must be determined and
eliminated.
D. All components of the pond system (inlat and outlet structure and
pond itself) must be maintained in a good working order.

Dear Sirs:
Reference your application of February 6, 1996, for Department of the
Army (DA) authorization to discharge fill material into 1.53 acres of
jurisdictional wetlands for the purpose of developing a restaurant and
appurtenances on your property located above the headwaters of Locks Creek, at
the intersection of Interstate Highway 95 and Cedar Creek Road, in
Fayetteville, cumberland County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 404 of the Clean Water Act, was provided by Nationwide
Permit No. 26 for discharges of dredged or fill material into headwaters and
isolated waters.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and any
required State authorization. A Section 401 water. quality certification is
required from the North Carolina Division of Environmental Management.
Contact Mr. John Dorney, telephone (919) 733-1786 for this certification, This
nationwide permit does not relieve you of the responsibility to obtain other
required State or local approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked, which will occur prior to January 21, 1997. It is
incumbent upon you to remain informed of changes to the nationwide permits,
which will be announced by public notice when they occur, If you commence, or
are under contract to commence, this activity before the date the nationwide
permit is modified or revoked, you will have twelve months from the date of
the modification or revocation, to complete the activity under the present
terms and conditions of this nationwide permit.
This verification is issued to you as a prospective property owner and as
proponent of the construction proposal. This verification may be assigned to
a subsequent property owner following notification to this office regarding
the change in property ownership and an acceptance of the terms and conditions
of this verification,

SR 2007 in Cumberland cOllnty for constmction of a Cracker Bane! restaurar:[. Based on this
review, we have identified significant uses which would be removed by this rroject. These uses arc
pollutant removal and stream bank stabilization. Furthermore, insufficient e\'jjence is present in uur
tiles to conclude that your project must be built as planned in waters and/or \- ~tlancls. Therefore. we
are moving toward denial of your 401 CertiticaUon as required by 15A NCAC 2B.0109. Until we
receive additional information, we are requesting (by copy of this letter) that [he U.S. Army Corps of
Engineers ancl/or the N.C. Division of Coastal Management place your projc<..t on administraUve
hold.
Please provide us with information supporting your position that your pr"ject must be
constructed as planned and that you have no practicable alternative to placing ,ill in these waters
ancl/or wetlands. Specifically can you construct your Cracker Banel by miniraizing wetland Jill (e.g..
not separating out the northern parcel) and utilizing the remaining wetland fuc storm water

Dear Mr. Schaffer:
Reference your application of March 1, 1996, for Department of the Army
(DA) authorization to discharge dredge or fill material into 0.11 acre of
wetlands located above the headwaters of Locks Creek, on your property at
Cedar Creek Road and Interstate 95, in Fayetteville, Cumberland County, North
Carolina. This authorization request has been made subsequent to a previous
request for discharge into 1.53 acres of wetlands located on an adjacent tract
which you owned. A cumulative total of 1.64 acres of wetlands have been
impacted on this property.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits, Authorization,
pursuant to Section 404 of the Clean Water Act, was provided by Nationwide
Permit No, 26 for discharges of dredged or fill material into headwaters and
isolated waters.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and any
required State authorization. This nationwide permit does not relieve you of
the responsibility to obtain other required State or local approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked, which will occur prior to January 21, 1997. It is
incumbent upon you to remain informed of changes to the nationwide permits,
which will be announced by public notice when they occur. If you commence, or
are under contract to commence, this activity before the date the nationwide
permit is modified or revoked, you will have twelve months from the date of
the modification or revocation, to complete the activity under the present
terms and conditions of this nationwide permit.

Enclosed are the permit materials for the Ralph Williams and Associates (Cracker
Barrel) tract in Cumberland County. As you know the entire site is cleared and has repeatedly
been disturbed (farmed) in the past. No habitats for protected species are present on the site or in
the immediate project area. I assume OEM will run this by SHPO.
The state had already approved a stormwater management plan submitted by Cracker
Barrel. Fortunately it is similar to our discussions. The tract is currently owned by Ralph
Williams and Associates, but will be sold to, and developed by, Cracker Barrel.
