Thank you for discussing this project with me today. As I stated, I met with representatives of the Town of Chapel Hill for
this project in July. We discussed the different components, and at the time, based on the discussions and information I
had, I suggested that the project would be permitted using multiple NWPs. However, after receiving the PCN and
reviewing the plans, it seems that the project should be permitted using only a NWP 3 and a NWP 18. The NWP 3 would
cover all of the work at the existing culverts and the NWP 18 would cover the work below the OHWM of the pond. Would
you please re-issue the 401 certification for only a NWP 3 and NWP 18? Please let me know if you need any additional
information. Thanks.
