During this conservation you spoke of several lots (e.g. lot #'s 187, 188, 189, 263, 265, 267, and 269) adjacent to and or near Highway 25 in the Southchase subdivision which have yet to be sold. Further, you stated that the Windsor/Aughtry Company would deed out the wetlands on these lots and place conservation easements on them. Ultimately these wetland areas would be turned over to a public trust organization for conservation in perpetuity. The Division of Water Quality strongly encourages you to pursue these options. We would request that you advise both the Central Office and The Asheville Regional Office as to your efforts in deeding out these wetland areas. Considering the hydrology and light regime indicative of the site we feel that this is likely the most appropriate mix. RE: Southchase Subdivision Water Quality Certification Henderson County Dear Mr. Coldwell: Reference is made to your letter dated July 5, 1997, which responded to our proposed corrective measures for the subject project. Our response is as follows: 1. We will submit the request for 401 Water Quality Certification and an application for a Corps of Engineers wetland crossing permit to cover Woodhill Drive within the next few days. 2. It is our intent to also submit a 401 Water Quality Certification and an application for a Corps of Engineers wetland crossing permit to cover the stream crossing of Woodhill Drive in Section 6 (adjacent to lots 187, 188, & 189). 3. Mr. Norwood has contacted all of the property owners along the drainage channel. They are all very supportive of the tree planting project, however, they will not grant a wetland preservation easement. We feel that the risk of these trees being cut down by the property owners in the future is very low. 4. The wetland preservation area on lots 187,188, 189, 263, 265, 267, and 269 has already been deeded to individual property owners. They are all supportive of the covenant and restriction on their property. The corrective measures outlined in the proposals are generally acceptable to the Division for the resolution of the 401 violation. Listed below are the Division's comments and concerns related to the proposals. Southchase Subdivision 1. The application for the stream crossings on Woodhill Drive and any other impacts should also be made to this office for the appropriate 401 Water Quality Certification. 2. You also have lots 187, 188, and 189 of Section 6 listed as needing authorization, yet these are also lots that are included in the proposal for preservation of the wetlands. Please explain. 3. For the proposal to reseed and plant trees along the "excavated drainage channel', is there a way to get an agreement from the individual property owners to prevent them from cutting the trees in the future. 4. If an agreement is reached with the adjacent property owner that will allow you to construct a wetland biofilter at the end of the drainage channel, the plans for this work should be submitted to the Division for review prior to construction. 5. The Division also recommends that the wetlands on lots 187, 188, 189, 263, 265, 267, and 269 (2.06 acres) which are to be preserved, be taken out of the individual deeds and consolidated into one property to be donated to a public trust organization for future protection. This is to advise you of the following actions: 1. The attached site plan shows the as-built conditions of the Windsor Forest Subdivision showing all stream crossings, wetland impacts, and structures. 2. An on-site meeting was held on Thursday, May 1, 1997, with Mr. Pete Colwell, Mr. Mike Parker, Mr. Paul White and Mr. F.A. Norwood to discuss the wetland violations identified in the Notice of violation. It was agreed that a second meeting the U.S. Army Corps of Engineers would be required to develop a plan for corrective measures. 3. On Friday, May 9, 1997 a meeting was held on the project site with Mr. David Baker (COE), Mr. Paul White (DEM), Mr. F.A. Norwood (Windsor-Aughtry) and the writer (W.G. Lapsley). The meeting included a walk-through of the wetland impacted areas. It was agreed that the following corrective measures will be taken by the developer: a) Regrade disturbed area along the sanitary sewer line right-of-way to restore the ground as close as William G. C) The creek on the north side of the Tulip Tree Court culvert crossing will be restored as close as possible to its original condition. The rip-rap stone will be removed and the banks reseeded with the special wetland mix. d) The area shown on the as-built plan will be (3.68 acres), will be preserved as dedicated wetland by deed restriction. A copy of the language included in the deeds for lots 95, 96, 97, 99, 100, 103, 104, 105, 106 is attached. The location of these measures are shown on the attached plan. Is there any way to get an agreement or deed restriction from each property owner to prevent the cutting of these trees? If an agreement is reached with the adjacent property owner that will allow Mr. Norwood to construct a wetland south of the property to treat stormwater, construction plans of this wetland and associated species should be submitted to DWQ for approval. The purpose of the meeting was to examine the stream and wetland impacts and discuss resolution of the Notice of Violation issued to you for the Southchase and Windsor Forest Subdivisions off Fanning Bridge Road near Fletcher, NC. At Windsor Forest we found that approximately 350 feet of stream had been channelized and rip rapped around the road crossing and along the sewer line. We also determined that it was very likely that wetlands adjacent to the stream on the north side of Tulip Tree Court had also been filled with the installation of the sewer line and the road and that wetlands on lot 103 also had been impacted. As we discussed in the field, you will need to have the US Army Corps of Engineers determine the extent of the wetlands and wetland impacts on the project before we can sort out the corrective actions that need to be taken. You had indicated that you would put conservation easements on the remaining wetlands along the creek as a means to mitigate for the impacts to the wetlands, but this was required by the original 401 Certification and will not fully offset the impacts on your project. It is likely that some stream and wetland restoration will be required. At Southchase Subdivision, we found a number of impacts not authorized by 401 Water Quality Certifications, including three additional stream crossings, a large ditch carrying the flow from two small streams, and a large road crossing with wetland fill along near US 25. I am not convinced that there was not some stream channelization and other impacts associated with the large ditch through the lower part of the subdivision. However, I also realize that it would be very difficult to do any restoration along the ditch because of the large numbers of individual property owners involved. At the construction entrance road crossing off US 25, we estimated that as much as 0.5 acres of wetlands may have been impacted by fill. You offered to remove the lot fill near the US 25 road crossing and dedicate the wetlands on lots 188, 189, and 263 to 270 as a conservation area prohibiting future development. We understand that without this protection these wetlands could be threatened by future development along US 25. We also discussed the planting of trees and/or shrubs along the main ditch to provide shade and some habitat value. And finally we discussed the construction of a stormwater pond or wetland biofilter that would treat the subdivision runoff before it enters Cane Creek. I have enclosed some examples of these. The Division feels that the above measures would reasonably offset the water quality impacts created by Southchase project. In order to keep our files up to date and to adequately monitor the above projects, the I Division requests as built and proposed plans for the entire subdivisions showing all stream crossings, wetland impacts, and proposed structures. We look forward to receiving the information on Windsor Forest and your plans to mitigate for the impacts at Southchase. The existing stream channel is currently running through four of the proposed lots and the applicant wants to move this portion of the channel off of the proposed lots and into an adjacent new channel. Downstream from the relocation project, the remainder of the creek on the property (approximately 1,100 linear feet) will be left intact. In addition, at least 10 feet of vegetated buffer from the top of the bank landward will be left along the 1,100 linear feet of existing channel and the 500 linear feet of new channel. The new channel will be constructed and completely stabilized before flow is turned into it. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Department of Environment, Health and Natural Resources (NCDEHNR) has determined the applicability of a Water Quality Certificate as required by PL 92-500.
