This letter is in response to your letter dated August 15, 1997 regarding the
compliance evaluation inspection conducted on August 12, 1997 at the subject project.
Please note that even though the proposed construction and mitigation plan have
not been implemented, Mr. Tom Chapin, owner of the property will be proceeding with
the approved plans in the near future. Mr. Chapin realizes that he has until December 31,
1998 and will make every effort to complete the improvements in accordance with the
permit requirements.

The Department of the Army permit program is authorized by Section 10 of the Rivers and Harbors Act of 1899, Section 404 of the Clean Water Act and Section 103 of the Marine,
Protection, Research and Sanctuarles Act. These laws require permits authorizing activities in or affecting navigable waters of the United States, the discharge of dredged or fill
material Into waters of the United States, and the transportation of dredged material for the purpose of dumping it Into ocean waters. Information provided on this form will be used
in evaluating the application for a permit. Information in this application is made a matter of public record through issuance of a public notice. Disclosure of the information
requested is voluntary; however, the data requested are necessary in order to communicate with the applicant and to evaluate the permit application. If necessary Information is
rot provided, the permit application cannot be processed nor can a permit be Issued.
One set of original drawings or good reproducible copies which show the location and character of the proposed activity must be attached to this application (see sample drawings

4. DETAILED DESCRIPTION OF PROPOSED ACTIVITY
4a. ACTIVITY
The project requests the filling of .43 acre of adjacent 404 wetlands and the creation of
.91 acres of wetlands from adjacent upland knobs in a 2:1 ratio. This will allow
for some reasonable utilization of this disturbed highway frontage property.
4b. PURPOSE
The fill is needed to level out the grade of the property in order that the corner
of Deck St. and Evans Street can be utilized for a store. The rest of the property
will be converted into 404 wetlands and be held as such for their inherent values.

- ± 3600 c.y. of clean sand and stone at building site.
- Excavation of ± 2800 c.y. of sand from uplands to create wetlands.
- There will be net gain of ± .5 acre of wetlands that will be contiguous.

Arlington Self Storage
Dear Mr. Chapin
On June 1, 1995 you were issued water Quality Certification No.
3004 authorizing 0.43 acres of wetland impact for the Arlington Self
Storage project. This Certification required you to submit a
mitigation plan to DWQ for review. This plan was received, reviewed
and approved by this office.
As part of an ongoing compliance and enforcement effort on August
12, 1997 Mr. John Dorney and Mr. Eric Fleek from the Division of Water
Quality's Central Office conducted a compliance evaluation inspection
at the above referenced facility. As a result of the inspection, it
was noted that you apparently have not started construction. In
addition, there was no work started on the proposed mitigation plan.
This office requests that you advise us as to your intentions at
this site. If you are still intending to develop this site you must
follow your original plans as submitted to this office' If your plan
changes you must notify us and you may be required to submit a new
application as required by the 401 Water Quality.Certification.
Your efforts to comply with the conditions of your 401 Water
Quality Certification is needed and much appreciated. If you have any
questions regarding this matter please feel free to contact Mr. John
Dorney or Mr. Eric Fleek at (919) 733-1786.

THIS CERTIFICATION is issued in conformity with the requirements of Section 401
Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500 to Arlington Self Storage
resulting in 0.43 acres of wetland impact in Pitt County pursuant to an application filed on the 30th
day of March of 1995 to construct a store at comer of Deck and evans Streets.
The Application provides adequate assurance that the discharge of fill material into the waters
of Green Mill Run in conjunction with the proposed development in Pitt County will not result in a
violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of
North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-
500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set
forth.
Condition(s) of Certification:
That the activity be conducted in such a manner as to prevent significant
increase in turbidity outside the area of construction or construction related
discharge (50 NTUs in streams and rivers not designated as trout waters by
DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs
in trout waters).
Additional written approval must be received from DEM for a final mitigation
plan.
Violations of any condition herein set forth shall result in revocation of this Certification. This
Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon
expiration of the 404 or LAMA permit.
If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon
written request within sixty (60) days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and
filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless
such demands are made, this Certification shall be final and binding.

Department of the Army (DA) permit and a State Water Quality Certification to
fill 0.43 acres of adjacent contiguous 404 wetlands to Green Mill Run in order
to level the property to facilitate the construction of a store at the corner
of Deck Street and Evans Street, Greenville, Pitt County, North Carolina.
Your receipt of this letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60
days after receipt of a request for certification is a reasonable time for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by May 30, 1995, the District Engineer will deem that
waiver has occurred

Mr. Tom Chapin the owner of the property has asked me to address
the T40A concerns noted during our on-site meetings. Much of the
final site planning reflects both your concerns and Debra Sawyer's
co:nnents noted duz-ing the environmental scoping process. What
follows is a discussion of the 3 MOA criterion and Mr. Chapin's
design/construction s.heme to achieve full- compliance.
A) Least Da!qgg_jng__Practi_ca1 Alternatives:
The Project site was evaluated to maximize the useable upland
acreage which had the least amount of 404 wetland impact. The
northeast corner of the tract was chosen since the wetlands
there are more isolated and have been impacted more heavily
with highway runoff and trash buildup. This section of the
property also has the highest natural elevations which allows
for better control of directed runoff and moves the future
store building out of the flood plain.
B) Practical._Steps to Minimize Wetland Losses:
Only the rninimum area needed for the store building and
required parking will be disturbed. All of the other acreage
on the tract will be dedicated as open space which will
contain both natural and constructed wetlands. The traffic
flow through taste of the curb cuts will also minimize excess
fill since ingress and egress locations are located in cleared
uplands. Stormwater from the site will be directed. to both.
natural and mats-made 404 areas and stone riprap velocity
dissipaters will be utilized to sloth dowzi the sheet flow
runoff.

ARLINGTON SELF STORAGE, ATTN: MR. TOM CHAPIN, 408 West Arlington
Boulevard, Greenville, North Carolina 27834 has applied for a Department of
the Army (DA) permit TO FILL 0.43 ACRES OF ADJACENT CONTIGUOUS 404 WETLANDS TO
GREEN MILL RUN IN ORDER TO LEVEL THE PROPERTY TO FACILITATE THE CONSTRUCTION
OF A STORE AT THE CORNER OF DECK STREET AND EVANS STREET, Greenville, Pitt
County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show that the applicant proposes to place approximately 3600 cubic
yards of clean sand and stone fill material into adjacent contiguous 404
wetlands of Green Mill Run. The applicant also proposes to mitigate for
wetland impacts by excavating approximately 2800 cubic yards of sand from
uplands in order to create 0.91 acres of contiguous wetlands at the project
site. The site was previously disturbed by ditching and grading in 1984 and
1986. The existing wetlands that will be impacted are primarily vegetated with
Salix niara (Black Willow), Fraxinus pennsvlvanica (Green Ash), Acer rubrum
(Red Maple), Platanus occidentalis (Sycamore), Carpinus caroliniana (Iron
wood), Licrustrum sinense (Privet), Impatiens capensis (Jewel weed), Polycronum
arifolium (Tearthumb), Tvnha latifolia (Cattail), Scirpus spp. (Bullrush), and
Smilax glauca (Cat Brier).
The purpose of the work is to level out the grade of the property in order to
construct a store at the corner of Deck Street and Evans Street. The rest of the
property will be converted into 404 wetlands contiguous to Green Mill Run. Plans
showing the work are included with this public notice.
The State of North Carolina will review this public notice to determine the need
for the applicant to obtain any required State authorization. No DA permit will be
issued until the coordinated State viewpoint on the proposal has been received and
reviewed by this agency, nor will a DA permit be issued until the North Carolina
Division of Environmental Management (NCDEM) has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
This application is being considered pursuant to Section 404 of the Clean Water

proposed activity will affect species, or their critical habitat, designated as
endangered or threatened pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of the
probable impacts, including cumulative impacts, of the proposed activity and its
intended use on the public interest. Evaluation of the probable impacts which the
proposed activity may have on the public interest requires a careful weighing of all
those factors which become relevant in each particular case. The benefits which
reasonably may be expected to accrue from the proposal must be balanced against its
reasonably foreseeable detriments. The decision whether to authorize a proposal,
and if so the conditions under which it will be allowed to occur, are therefore
determined by the outcome of the general balancing process. That decision should
reflect the national concern for both protection and utilization of important
resources. All factors which may be relevant to the proposal must be considered
including the cumulative effects thereof. Among those are conservation, economics,
aesthetics, general environmental concerns, wetlands, cultural values, fish and
wildlife values, flood hazards and flood plain values (in accordance with Executive
Order 11988), land use, navigation, shore erosion and accretion, recreation, water
supply and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, considerations of property ownership, and, in general,
the needs and welfare of the people. For activities involving the placement of
dredged or fill materials in waters of the United States, a permit will be denied if
the discharge that would be authorized by such permit would not comply with the
Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding
sentence and any other applicable guidelines or criteria, a permit will be granted
unless the District Engineer determines that it would be contrary to the public
interest.
The Corps of Engineers is soliciting comments from the public; Federal, State
and local agencies and officials; Indian Tribes and other interested parties in
order to consider and evaluate the impacts of this proposed activity. Any comments
received will be considered by the Corps of Engineers to determine whether to issue,
modify, condition or deny a permit for this proposal. To make this decision,
comments are used to assess impacts on endangered species, historic properties,
water quality, general environmental effects and the other public interest factors
listed above. Comments are used in the preparation of an Environmental Assessment
(EA) and/or an Environmental Impact Statement (EIS) pursuant to the National
Environmental Policy Act (NEPA). Comments are also used to determine the need for a
public hearing and to determine the overall public interest of the proposed
activity.
Generally, the decision whether to issue this DA permit will not be made until
the North Carolina Division of Environmental Management (NCDEM) issues, denies, or
waives State certification required by Section 401 of the Clean Water Act. The
NCDEM considers whether or not the proposed activity will comply with Sections 301,
302, 306, and 307 of the Clean Water Act. The application and this public notice
for the DA permit serves as application to the NCDEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, NCDEM, Salisbury

Dear Henry:
Mr. Tom Chapin the owner of the property has asked me to address
the 140A concerns noted during our on-site meetings. Much of the
final site planning reflects both your concerns and Debra Sawyer's
co:nnents noted during the environmental scoping process. What
follows is a discussion of the 3 MOA criterion and Mr. Chapin's
design/construction scheme to achieve full compliance.
A) Least Dam aing Practical A1UrnatiytS_:
The Project site was evaluated to maximize the useable upland
acreage which had the least amount of 404 wetland impact. The
northeast corner of the tract was chosen since the wetlands
there are more isolated and have been impacted more heavily
with highway runoff and trash buildup. This section of the
property also has the highest natural elevations which allows
for better control of directed runoff and moves the future
store building out of the flood plain.

only the minimum area needed for the store building and
required parking will be disturbed. All of the other acreage
on the tract will be dedicated as open space which will
contain both natural and constructed wetlands. The traffic
flow through use of the curb cuts will also minimize excess
fill since ingress and egress locations are located in cleared
uplands. Stormwater from the site will be directed to both
natural and man-made 404 areas and stone riprap velocity
dissipaters will be utilized to slow down the sheet flow
runoff.

Approximately .91 acre consisting of three cleared upland
knobs will be excavated down to adjacent wetland grades in
order to achieve a 2:1 wetland replacement figure. Since
there is more than enough variety of seed sources for fac.-W
and obligate grasses and shrubs, it is felt that the native
404 vegetation will soon colonize the property. If the
application is approved a 12 month project summary report will
be written to detail mitigation success. This short summary
will take pictures of the mitigation areas and list those
species which volunteer based on their percent of cover.

ARLINGTON SELF STORAGE, ATTN: MR. TOM CHAPIN, 408 West Arlington
Boulevard, Greenville, North Carolina 27834 has applied for a Department of
the Army (DA) permit TO FILL 0.43 ACRES OF ADJACENT CONTIGUOUS 404 WETLANDS TO
GREEN MILL RUN IN ORDER TO LEVEL THE PROPERTY TO FACILITATE THE CONSTRUCTION
OF A STORE AT THE CORNER OF DECK STREET AND EVANS STREET, Greenville, Pitt
County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show that the applicant proposes to place approximately 3600 cubic
yards of clean sand and stone fill material into adjacent contiguous 404
wetlands of Green Mill Run. The applicant also proposes to mitigate for
wetland impacts by excavating approximately 2800 cubic yards of sand from
uplands in order to create 0.91 acres of contiguous wetlands at the project
site. The site was previously disturbed by ditching and grading in 1984 and
1986. The existing wetlands that will be impacted are primarily vegetated with
Salix ni ra (Black Willow), Fraxinus pennsvlvanica (Green Ash), Acer rubrum
(Red Maple), Platanus occidentalis (Sycamore), Carpinus caroliniana (Iron
wood), Ligustrum sinense (Privet), Impatiens cavensis (Jewel weed), Polvaonum
arifolium (Tearthumb), Tmha latifolia (Cattail), Scirpus spp. (Bullrush), and
Smilax alauca (Cat Brier).
The purpose of the work is to level out the grade of the property in order to
construct a store at the corner of Deck Street and Evans Street. The rest of the
property will be converted into 404 wetlands contiguous to Green Mill Run. Plans
showing the work are included with this public notice.
The State of North Carolina will review this public notice to determine the need
for the applicant to obtain any required State authorization. No DA permit will be
issued until the coordinated State viewpoint on the proposal has been received and
reviewed by this agency, nor will a DA permit be issued until the North Carolina
Division of Environmental Management (NCDEM) has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
This application is being considered pursuant to Section 404 of the Clean Water

In keeping with your request, this office has circulated to interested state review agencies
U. S. Army Corps of Engineers Public Notice Action ID. No. 199502104 dated March 30, 1995
which describes a project proposal by Arlington Self Storage of Greenville. The project,
involving wetland fill to facilitate construction of a store, is located in wetlands of Green Mill
Run at the corner of Deck Street and Evans Street in Greenville, in Pitt County.
Based on a coordinated agency review, the state interposes no objection to the project.
Two cooperating agencies provided written comments to the record as follows:
Division of Environmental Health - requests that the applicant contact Mr. Terry
Anderson at the Greenville Department of Public Works to discuss mosquito control;
Division of Environmental Management - issued the required Section 401 Water
Quality Certification. Certification No. 3004 was issued on 6/1/95.
Should you require additional input from the state on this matter, do not hesitate to
contact this office or the commenting agencies.
