The Department of the Army permit program is authorized by Section 10 of the Rivers and Harbors Act of 1899, Section 404 of the Clean Water Act and Section 103 of the Marine, Protection, Research and Sanctuarles Act. These laws require permits authorizing activities in or affecting navigable waters of the United States, the discharge of dredged or fill material Into waters of the United States, and the transportation of dredged material for the purpose of dumping it Into ocean waters. Information provided on this form will be used in evaluating the application for a permit. Information in this application is made a matter of public record through issuance of a public notice. Disclosure of the information requested is voluntary; however, the data requested are necessary in order to communicate with the applicant and to evaluate the permit application. ACTIVITY The project requests the filling of .43 acre of adjacent 404 wetlands and the creation of .91 acres of wetlands from adjacent upland knobs in a 2:1 ratio. This will allow for some reasonable utilization of this disturbed highway frontage property. 4b. PURPOSE The fill is needed to level out the grade of the property in order that the corner of Deck St. and Evans Street can be utilized for a store. This Certification required you to submit a mitigation plan to DWQ for review. This plan was received, reviewed and approved by this office. As part of an ongoing compliance and enforcement effort on August 12, 1997 Mr. John Dorney and Mr. Eric Fleek from the Division of Water Quality's Central Office conducted a compliance evaluation inspection at the above referenced facility. As a result of the inspection, it was noted that you apparently have not started construction. In addition, there was no work started on the proposed mitigation plan. This office requests that you advise us as to your intentions at this site. If you are still intending to develop this site you must follow your original plans as submitted to this office' If your plan changes you must notify us and you may be required to submit a new application as required by the 401 Water Quality.Certification. TOM CHAPIN, 408 West Arlington Boulevard, Greenville, North Carolina 27834 has applied for a Department of the Army (DA) permit TO FILL 0.43 ACRES OF ADJACENT CONTIGUOUS 404 WETLANDS TO GREEN MILL RUN IN ORDER TO LEVEL THE PROPERTY TO FACILITATE THE CONSTRUCTION OF A STORE AT THE CORNER OF DECK STREET AND EVANS STREET, Greenville, Pitt County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show that the applicant proposes to place approximately 3600 cubic yards of clean sand and stone fill material into adjacent contiguous 404 wetlands of Green Mill Run. The applicant also proposes to mitigate for wetland impacts by excavating approximately 2800 cubic yards of sand from uplands in order to create 0.91 acres of contiguous wetlands at the project site. The site was previously disturbed by ditching and grading in 1984 and 1986. The existing wetlands that will be impacted are primarily vegetated with Salix niara (Black Willow), Fraxinus pennsvlvanica (Green Ash), Acer rubrum (Red Maple), Platanus occidentalis (Sycamore), Carpinus caroliniana (Iron wood), Licrustrum sinense (Privet), Impatiens capensis (Jewel weed), Polycronum arifolium (Tearthumb), Tvnha latifolia (Cattail), Scirpus spp. (Bullrush), and Smilax glauca (Cat Brier). The purpose of the work is to level out the grade of the property in order to construct a store at the corner of Deck Street and Evans Street. The rest of the property will be converted into 404 wetlands contiguous to Green Mill Run. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not a registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show that the applicant proposes to place approximately 3600 cubic yards of clean sand and stone fill material into adjacent contiguous 404 wetlands of Green Mill Run. The applicant also proposes to mitigate for wetland impacts by excavating approximately 2800 cubic yards of sand from uplands in order to create 0.91 acres of contiguous wetlands at the project site. The site was previously disturbed by ditching and grading in 1984 and 1986. The existing wetlands that will be impacted are primarily vegetated with Salix ni ra (Black Willow), Fraxinus pennsvlvanica (Green Ash), Acer rubrum (Red Maple), Platanus occidentalis (Sycamore), Carpinus caroliniana (Iron wood), Ligustrum sinense (Privet), Impatiens cavensis (Jewel weed), Polvaonum arifolium (Tearthumb), Tmha latifolia (Cattail), Scirpus spp. (Bullrush), and Smilax alauca (Cat Brier). The purpose of the work is to level out the grade of the property in order to construct a store at the corner of Deck Street and Evans Street. The rest of the property will be converted into 404 wetlands contiguous to Green Mill Run. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. Army Corps of Engineers Public Notice Action ID. No. 199502104 dated March 30, 1995 which describes a project proposal by Arlington Self Storage of Greenville. The project, involving wetland fill to facilitate construction of a store, is located in wetlands of Green Mill Run at the corner of Deck Street and Evans Street in Greenville, in Pitt County. Based on a coordinated agency review, the state interposes no objection to the project. Two cooperating agencies provided written comments to the record as follows: Division of Environmental Health - requests that the applicant contact Mr. Terry Anderson at the Greenville Department of Public Works to discuss mosquito control; Division of Environmental Management - issued the required Section 401 Water Quality Certification.
