Dear Mr. Regan:
This letter is to serve as a clarification to the stormwater management plan requirements for your
project on U.S. 17 North at Ogden, North Carolina. As you are aware your 401 Water Quality certification
(dated March 4, 1994) required that a "written stormwater management plan must be approved by DEM
before construction begins'". In a recent phone conversation you noted that construction on this site has not
occurred and that only land clearing has taken place. As a result you contended that the need for a
stonnwater management plan was not necessary since no actual "construction" has taken place.
According to our records, an 11/12/93 site plan prepared by the Land Management Group and
submitted to DWQ as part of the 401 application package (site plan copy enclosed) clearly shows (flat
portions of this property have been constructed. Specifically, it appears that the property on which "Super
Sod" and the expanded portion of "Furniture Choices" now reside was part of the original site plan.
Therefore, DWQ concludes that construction has occurred on this site and that the approved stormwater
management plan is required as per the 401 Water Quality Certification. Please forward a plan showing
how the stormwater on this site will be handled. As John Dorney discussed with Rob Moul the simplest
process may be to direct the stonnwater into the remaining wetlands on site at non-erosive velocities.

We have reviewed your request for 401 Water Quality Certification
to place fill material in 0.82 acres of wetlands or waters which are
tributary to Pages Creek for commercial development located at "Ogden
Shopping Center", Hwy. 17 in New Hanover County as described in your
submittal dated 17 January 1994. Based on this review, we have
determined that the proposed fill is covered by General Water Quality
Certification No. 2671. A copy of the General Certification is
attached. This Certification is necessary for coverage under Corps of
Engineers' Nationwide Permit No. 26. This action completes DEM's
review under Section 401 of the Clean Water Act. An additional
condition is that a written stormwater management plan must be
approved by DEM before construction begins.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final- and binding.

Dear Mr. Regan:
On March 4, 1994 you were issued General Water Quality
Certification No. 2671 authorizing 0.82 acres of wetland impacts
needed to expand the Ogden Business Park off US 17 North, New Hanover
County. This certification contained the specific conditions that a
written stormwater management plan must be approved by the Division of
Water Quality before construction begins.
On April 24, 1997 Mr. Jim Gregson from the Division's Wilmington
Regional Office and Mr. Pete Colwell from the Division of Water
Quality's Central Office made a compliance evaluation inspection of
the subject project. As a result of the inspection, you were issued a
letter on may 8, 1997 noting that there were no identifiable
stormwater measures in place. In addition, in order to avoid a Notice
of Violation being issued to you it was requested that you provide
this office with the stormwater plans and a schedule for implementing
those plans. As of this writing these plans and schedules have yet to
be received by this office. Failure to respond to this second request
will likely result in a Notice of Violation being issued against you.
Your efforts to comply with the conditions of your 401 Water
Quality Certification are needed and much appreciated. If you have any

Per your request I met with Linda Lewis yesterday, who heads the
Stormwater Management Section of DWQ in the Wilmington Regional
Office. I went over the plans with her and she noted that since
you did not disturb more than 1 acre of land in the rear parcel
behind your old furniture building, she will not require a written
Stormwater Plan. In addition, it is not within a CAMA "Area of
Environmental Concern" (AEC) and does not require a plan.
At this time it appears that about .76 of an acre was land cleared
in preparation of another business purchasing the site. The future
owner's plans will most likely cause land disturbances which
cumulatively total greater than 1 acre and their building plans and
impervious cover will need to be sent to Linda Lewis (910-395-
3900). The New Hanover County Zoning officer and Sediment Control
officer will notify Linda when formal building and site works are
drawn up.
It should be noted that as of February 3rd of this year the
remaining wetland acreage based on the 1987 Army Corps Manual was
.43 acres. None of this acreage was filled and only .38 of an acre
of wetlands was disturbed by land disturbing activities and not .82
acres as originally proposed.
At this point in time you should be in compliance with both the
Army Corps and DWQ. I am sending a copy of this letter to Pete
Caldwell of DWQ in order to help him close his monitoring file
concerning the "Stormwater Plan Condition" of the state 401
certification issued March 4, 1994.

determined that the proposed fill is covered by General Water Quality

attached. This Certification is necessary for coverage under Corps of
Engineers' Nationwide Permit No. 26. This action completes DEM's
review under Section 401 of the Clean Water Act. An additional
