County, North Carolina. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. The discharge does not cause the loss of more than 10 acres of waters of the United States; b. The permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. The discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was also provided for fills for roads r `( -2- crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed area of no more than 1/ linear feet of the fill including wetlands; C. The crossing is the restriction of, and aquatic organisms; in waters of the United States is limited to a filled 3 acre. Furthermore, no more than a total of 200 for the roadway can occur in special aquatic sites, culverted, bridged or otherwise designed to prevent to withstand, expected highflows and the movement of d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer in accordance with the "Notification" general condition. Your work, impacting a total of 2.45 acres of jurisdictional waters, is authorized by these nationwide permits provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management. These nationwide permits do not relieve you of the responsibility to obtain other required State or local approvals. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. Based on this review, we have identified significant uses which would be removed by this project. These uses are pollutant removal, water storage and wildlife habitat. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in wetlands. Therefore, we are moving toward denial of your 401 Certification. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your project on administrative hold. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to fill of these wetlands. Specifically can you construct your residential development and pond on nearby uplands? Any documentation such as maps and narrative which you can supply to address upland alternatives may be helpful in our review of your 401 Certification. Predominately, this tract consisted of gentle rolling topography with mixed pine/hardwoods of variably mixed stand ages.. The wetlands at this site were well delineated. A significant portion of the wetlands were channels that conveyed rain event water and were of relatively low value. However, there are locations along these channels that were likely more seasonally inundated. Also, frequent evidence of scouring was often observed in these habitats.. The wetlands located adjacent to Bachelor Branch, which transverses the Southern portion of the proposed development, are of significant greater value. Due to soil composition, the wetlands located in the Triassic Basin are routinely small and infrequent. This proposed development contains both isolated wetlands and hydrologicaly connected wetlands that are located in the Bachelor Branch flood plain. The plans provides storm water control through the use of a retention pond. It is my opinion that several water retention ponds located along the respective unnamed tributaries to Bachelor Creek would provide a more effective storm water control system. This could reduce the stormwater impositions on Bachelor Branch proper, limit the impact to the flood plain, and reduce alteration of the ephemeral wetlands which are interspersed through the flood plain. The project is located near Cary, NC (Wake County) and is bordered to the east by NC 55, and to the south by Bachelor Branch as shown on the enclosed plans and vicinity maps. We previously submitted applications for Fieldstone Phase I and Phase II which currently are and have always been under completely separate ownership but are adjacent to this project. All three border Hwy. 55 and Bachelor Branch is their common property line. The Corps approved detailed wetland delineation is shown on the attached map. These delineations have been approved by Mr. Eric Alsmeyer of the U.S. Army Corps of Engineers. Fill in the wetlands will be required to utilize the property for a residential subdivision including lots, roads, etc. (see attached map). Most of the wetlands on the tract do not appear to be high quality; they consist primarily of channels which seem to be remnants of old agricultural practices on-site, while a few other wetlands are small, isolated pockets. The plans have been configured to minimize wetland impacts to higher value areas except for the stormwater quality pond which does impact some of the better wetlands on-site. It will be necessary to fill 2.12 acres (see jurisdictional wetlands above headwaters for proposed facilities utilizing Nationwide 26. filled under NW 14. Fill in the wetlands will be required to utilize the property for a residential subdivision including lots, roads, etc. (see attached map). Most of the wetlands on the tract do not appear to be high quality; they consist primarily of channels which seem to be remnants of old agricultural practices on-site, while a few other wetlands are small, isolated pockets. The plans have been configured to minimize wetland impacts to higher value areas except for the stormwater quality pond which does impact some of the better wetlands on-site. It will be necessary to fill 2.12 acres (see map) of jurisdictional wetlands above headwaters for placement of the proposed facilities utilizing Nationwide 26. 0.33 acres will be filled under NW 14. An additional .44 acres of channels will be flooded for the creation of a stormwater retention pond. Based on current Corps and DEM "policy" non-vegetated waters of the U.S. to be inundated by the creation of a lake or other impoundment are not considered to be adversely impacted, except for the dam area. Therefore, the .44 acres of channels to be flooded are not included as acreage impacted under NW 14 or NW 26.
