This certification was issued only for the impacts associated with Archer Road and contained additional conditions requiring deed restrictions to be placed on lots with jurisdictional wetlands to prevent future fill. In addition, stor.mwater shall be directed to sheet flow across the remaining wetlands. On January 16, 1997 Mr. Ken Averitte from the Division'S Fayettville Regional Office and Mr. Pete Colwell from the Division's Central Office conducted a compliance evaluation inspection of the Brightmoor Subdivision. As the February 11, 1997 inspection report indicated, you were apparently compliant with the 401 Water Quality Certification. This inspection letter also requested that in order to verify that the deed restrictions were placed on the lots specified in the certification you were requested to send this office a copy of the deed restriction. As of this writing this office has not received a copy of the deed restrictions. We are again requesting that you provide this office with a copy of the relevant deed restrictions. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. Additional conditions are: 1. that deed restrictions shall be placed in lots 51 and 52 and the area of old lot numbers 53 to 60 to prevent additional fill, the restrictions shall run with the property and the state shall be a beneficiary; 2. this certification is only for impacts associated with Archer Road and its adjacent lots. Any other wetland or water impacts in Bright Subdivision must receive DEM approval before construction. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters.
