Development", Greenville, N.C.
Dear John:
Enclosed are seven copies of the Joint Application to fill and/or
impact 7.38 acres of headwater woody wetlands located in the new
Ironwood Development located west of Greenville. The golf course
and residential housing project is situated in its first phase
north of N.C. 43 at Rock Springs on old family farmland tracts
totalling 305.1 acres. William Daniels and Associates did a
wonderful landplan along with Lee Travino to avoid the adjacent
wetlands and minimize those wetland impacts which totally removed
wetland functions.
As you can see nearly 70% of the wetland impact will be the
proposed creation of an impounded irrigation lake totalling 4.88
acres. The trees in the stream ravine will be removed but other
hillside species will remain intact. The impacts of the conversion
to aquatic resources will be off-set by a combination of mitigation
techniques which are explained as follows:
(1) A significant amount of household trash and farm refuse was
historically placed into the small headwater tributaries and
todate about 78 tons have been collected and removed off the
site;
(2) Three small ponds will be created out of isolated low
elevation "upland" soils and a 40 ft. wide shallow shelf will
be constructed along the pond perimeters;

(3) The 40' pond bank will be stabilized with common freshwater
wetland grasses such as Bulrush, Smartweed, Lizard's Tail,
Wildrice, Duck-potato and Pickerel plant. Other prolific
native plants such as Woolgrass and Cattail would be added
later if others fail to stabilize within 18 months.
(4) As agreed upon with the Army Corps all disturbed stream
corridors (due to junk removal or golf course construction
activities) will be restored up to a 25 ft. buffer from the
stream bank along each side back up the slopes. These areas
will not be filled or piped inorder to allow free wildlife
travel. Also, a mixture of wetland/upland plants of grass and
shrub variety will be transplanted here totalling about 1.1
acres.
(5) The total 1 et nds created and/or enhanced will total a
minimum of 0. 8 acres which equates to a 1:1.5 ratio and
maintains the pirit of the "No Net Loss Concept".

02-1885 (see attached) was received on 12/09/02 and sent to the WaRO on 12/12/02. WaRO provided comments
sometime after 12/12/02 (comments were not dated) to "Issue n/c". It was then put in my box, presumably to write the
Issue letter, sometime after WaRO comments. I most likely saw WaRO comments to "Issue n/c" and put it in my pile of
projects to write approval letters on. I kept pushing it back to the end of the pile because other higher priority projects
came up. I failed to check the "drop dead" date and as such the project is now past the 60-day review period and would
normally be waived. I found the file today and began to write the "waiver " letter once I realized that it had past 60 days.
In writing the letter I came across the following issues.
Basic facts provided within the PCN: The PCN was submitted by the property owner (possible homebuilder). The PCN
states that no buffers will be impacted and it doesn't appear that any will. The PCN states that they plan to build a "house
with in "MBU lines". Todd sent it to the WaRO stating "proposed impact to wetlands but none are shown on plans". The
"triage check list" also stated (not sure who wrote it), "discuss w/ applicant specifics of impact areas -just how much
needs to be impacted for what specific purpose -no need for impacts just to produce the "green carpet lawn" area". The
PCN stated under "prior project history", "Action ID 199503797 - Requested certification on a larger amount of wetlands
area." It did not provide the "DWQ Project Number".
My review on 2/18/03: 1 found the project location on the USGS and soil survey with the ald of the Pitt Co. web-based
GIS database. I checked Filemaker for any prior projects under the name Osborne. Nothing came up. I then checked for.
any projects under the subdivision name (Ironwood) and found DWQ Project No. 95499 (see attached). Iwent to the lab
and pulled the file. It contained the DWQ Certification issued on August 14, 1995 and the USACE Permit 199503797.
The Certification required, "A deed restriction shall be added to all lots with jurisdictional wetlands to prevent future
wetland fill". It also required that "DEM shall be copied on all mitigation reports including an as built'report after
construction". The file did not contain any such reports. The 1995 "Joint Form" requested 1.67 acres of fill, 4.88 acres of
flooding and 0.83 acres of excavation. The authorization letter gave "approval to placed fill in 7.38 acres of wetlands or
waters". One of the "mitigation techniques" proposed in the 1995 cover letter was "(5) The total wetlands created and/or
enhanced will total a minimum of 10.78 acres". It looks like you circled 10.78" and wrote a note "inc. pond". The
Certification also required no direct discharge of stormwater into the streams.
Does the fact that they failed to provide the "DWQ Project Number" in the "Prior Project History" section of the new PCN
constitute an incomplete application? If so, can we deny the project (or at least request additional information) based on
"no practical alternatives" and the 1995 deed restrictions? If not, please return and I'll write the waiver letter. I apologize
for letting this project slip through.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Sirs:
You have our approval to place fill material in 7.38 acres of wetlands or waters for the purpose
of constructing a golf course and residential subdivision at Ironwood Development, as you described in
your application dated 9 May 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2671. This certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. A
deed restriction shall be added to all lots with jurisdictional wetlands to prevent future wetland fill.
DEM shall be copied on all mitigation reports including an as built report after construction.
Stormwater shall be directed so as not to directly flow into streams on the property. In addition, you
should get any other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

Reference is made to our letter to you dated July 11, 1995, concerning
Department of the Army Nationwide Permit 26 authorization for your proposed
discharge of fill material in 1.67 acres, flooding 4.88 acres, and excavating
0.83 acres of above headwaters 404 wetlands (total wetland impacts 7.38 acres).
The site is located at Ironwood Subdivision Phase I, 0.5 miles west of the
intersection of U.S.264 Bypass and N.C. 43, between Rock Springs and the Tar
River, Pitt County, North Carolina. The proposed 7.38 acres wetlands impacts
are necessary in order to facilitate the construction of an 18 hole golf course
and irrigation ponds.
Reference is also made to a June 7, 1995, letter (copy enclosed) from the
North Carolina Department of Cultural Resources (NCDCR) to your agent, Rob Moul,
with Quible & Associates, P.C., which requests additional information necessary
to provide for a determination of effect on the adjacent Camden County Courthouse
which is listed in the National Register of Historic Places.
In accordance with our regulations (33 CFR Part 330) no activity which may
affect properties listed or determined eligible for listing on the Register is
authorized by the Department of the Army nationwide permit until the requirements
of Section 106 of the National Historic Preservation Act have been satisfied.
Accordingly, to ensure compliance with this regulation, you should coordinate
with the State Historic Preservation Office to satisfactorily resolve their
concerns in this matter prior to any work on the property. Copies of all
correspondence regarding this issue should be forwarded to our office.

Roger Thorpe, Debra Sawyer (WARO), Bill Daniels (project engineer), and I visited
Ironwood Development on July 24, 1995. Bill directed the tour and showed us the
location of the proposed creation of an impounded irrigation lake. The stream to be
impounded is a small, slow moving, unnamed tributary to the Tar River. The stream
appeared not to be teeming with aquatic life.
Roger, Debra, and I saw no problems with the project design and therefore approve of
issuing the 401 Certification. However, a deed restriction clause should be added stating
that homeowners should not develop within a distance of at least 50 feet from the irrigation
impoundment, in order to maintain a substantial buffer around the lake.
