Dear Mr. Sugg:
On June 13, you reviewed my property located on SR 1915, 3
miles south of Goldsboro. Patty Gabriel, from NRCS was with
you on this review. I would like to apply for an
agricultural exemption for the access road that I want to
install. This access road will be 30 feet wide with two 15
foot drains on either side of the road. I will only need one
culvert crossing the road. (see drawing). I have 50 acres
of cropland that I farm on this property.
In addition to the access road, I have inclosed a permit
application for installing a ditch. I have modified my
request on the ditch installation so I will impact less than
1 acre of wetland. I want to install the ditch right beside
the nonwetland so I will only be impacting wetland on the
west side on the ditch. I will be clearing the nonwetland
to the ditch.
You determined on the 13th, that both the ditch and the
access road are above headwaters.

You have our approval to place fill material in 0.9 acres of wetlands or waters for the purpose of
constructing a ditch at SR 1915, as you described in your revised application dated 22 June 1995.
After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 2733 or 2671. This certification allows you to use Nationwide Permit Number 14
or 26 when either is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

This letter confirms the receipt of information J`a17ed June 20, 1995,
requesting verification of the exemption from Section 404 of the Clean
Water Act for the construction of a farm access road on your property
located on Farm Number 6211, Tract Number 1646, on the east side of State
Road 1915, approximately 1.0 mile north of State Road 1120 intersection,
adjacent to the Neuse River, north of Indian Springs, Wayne County, North
Carolina.
The construction or maintenance of farm roads intended to be used
solely for farming functions are considered to be exempt from regulation
under Section 404 of the Clean Water Act. However, to meet this
exemption, any roads must be constructed and maintained in accordance with
certain best management practices (BMPs) to assure that: (1) flow and
circulation patterns arid chemical and biological characteristics of waters
of the United States are not impaired; (2) that the reach of the waters of
the United States is not reduced; and (3) that any adverse effect on the
aquatic environment is minimized.
Accordingly, we have determined that your proposed farm road is exempt
from regulation by the Department of the Army provided that the road is
utilized strictly for farming activities, and the enclosed BMPs are
followed. Please be aware that this determination does not relieve you of
the responsibility to obtain any other required State or local approval.
