Dear Mr. Doughty:
You have our approval to place fill material in 4625 square feet of waters for the purpose of
installing riprap and constructing a boatramp at Summerfield Fann subdivision, as you described in
your application dated 3 May 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2733. This certification allows you to use
Nationwide Permit Number 13 or its equivalent when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

PERMIT AND WATER QUALITY CERTIFICATION /
The Department of Environment, Health, and Natural Resources hereby gives public notice as
required by N.C.G.S. 113A-119(b) and 143-215 3(a)(1)(c) that Mr. John Doughty, agent for
Summerfield Farm Subdivision, filed an application on 2 May 1995 for a permit from the
Division of Coastal Management to develop in an Area of Environmental Concern and for
certification from the Division of Environmental Management that a discharge of fill material
in project wetlands will not violate applicable water quality standards. According to said
application, Mr. John Doughty proposes to subdivide an approximately 22 acre tract of land into
8 waterfront residential lots averaging 0.6 acre each and leave the remaining acreage in
agriculture. Development proposed on the 8 residential lots includes: riprap, wooden groins
and a boat ramp. An access road will also be constructed. The site is located on US 64 at the
SR 1136 intersection on Albemarle Sound near Roper, Washington County, North Carolina.
A copy of the entire application and additional information maybe examined (or copies furnished
upon request and payment of reproduction costs) during normal business hours of the Division
of Coastal Management, 1424 Carolina Avenue, Washington, North Carolina, and/or the
Division of Environmental Management, 1424 Carolina Avenue, Washington, North Carolina.
The Division of Environmental Management proposes to take final action on this water quality
certification on or before 24 June 1995. The issuance of the CAMA Major Development permit
and the Section 401 Certification may deviate from this projected date depending upon the nature
of the comments submitted and subsequent hearings that may result.
All persons desiring to make comments should do so in writing to Mr. Roger Schecter, Director,
Division of Coastal Management, P.O. Box 27687, Raleigh, N.C. 27611, prior to 13 June 1995
for consideration in the CAMA permit decision, and to Mr. John Dorney, Division of
Environmental Management, P.O. Box 27687, Raleigh, North Carolina 27611 prior to 8 June
1995 for consideration in the water quality certification decision. Later comments on the CAMA
application will be accepted and considered up to the time of permit decision. Project
modifications may occur based on review and comment by the public and state and federal
agencies. Notice of the permit decision in this matter will be provided upon written request.

Project Setting
The project site is located adjacent US 64 at the intersection of SR 1136 on Albemarle
Sound near Roper in Washington County, North Carolina. The property is bordered on the
downstream (east) side by a developed lot which has a bulkhead and riprap and is part of
Summerfield subdivision. The property is bordered on the upstream (west) side by an
undeveloped wooded tract. Approximately 20 acres of the 22 acre site is in active agriculture
production. An existing home, barn and shed take up another ±1 acre of the site. The
remaining ± 1 acre is a wooded area which is at the west side of the property and is part of the
adjoining forested area. The wooded portion of the site is predominantly hardwoods with
undergrowth of vines and shrubs. The unplowed portions of the site are vegetated with various
upland grasses. The ± 14' elevation above mean sea level creates an erosion bluff at the sound
interface with aggressive undercutting of the bank.
Albemarle Sound is classified as SB by the Environmental Management Commission.
Albemarle Sound at the project site is coastal water but is not open to shellfishing.
Project description
The applicant proposes to place ±925' of riprap along the shoreline. The riprap will
average 5' waterward of the normal water level (NWL) with a maximum distance offshore of
5'. The riprap will extend approximately 11' landward of the NWL to a height of 5' above the
NWL. The applicant proposes to grade the existing 14' bluff down to this established 5' height
and run a concrete sidewalk along the top of the riprap. Nine 25' long wooden groins are
proposed with 7 placed at the new lot lines and 2 at the proposed boatramp. The boatramp will
be constructed on an 30' wide access lot at the west end of the project site and will be 10' wide
and 40' long (20' to be below the NWL).
A gravel road 30' wide (ditch to ditch) and ±700 long is proposed to provide access to
the proposed waterfront lots. A 10' wide dirt path will be created from the end of the gravel
road down to the proposed boatramp.
Anticipated impacts
The project as proposed will result in the filling of ±4,625 ftz of sound bottom associated
with the placement of riprap and the construction of the boatramp. Grading of the existing bluff
and the construction of the access road will result in the disturbance of ±87,120 ft2 of
highground. The project as proposed will result in localized turbidity as a result of the
construction activities.

Dear Mr. Hoye:
Enclosed is a completed CMU Major permit Application
to place riprap, construct wooden groins and a concrete boat
ramp, and to build an access.road on the Willie C. White
Estate property on US 64E at SR 1136 on the Albemarle Sound
near Roper in Washington County, North Carolina.
The property consists of approximately 22 total acres
(20 acres in cultivation, 1 acre in upland forest, and 1
acre in homesite). The proposed project will produce eight
single family wat_erfront.homesites. The balance of the
property will raziein in its current use.
Access to the lots will be by way of Summer.field Road
(existing) and appro,,Unetely 700 linear feet of new road.
The new road will have crushed stone (granite) surface and
grassed swales.
Services available to the site include power, telephone
and county water. Septic tanks will be used for waste water
disposal..
Surface runoff from the project area will be minimized
by stabili2ing all ouposed soil areas with grass and straw.
Grassed swales will carry runoff away from the waters edge.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 71.020 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

Dear Mr. Dorney:
Enclosed is the application of the Willie C. White Estate for Department
of the Army authorization and a State Water Quality Certification to place
riprap material along an eroding shoreline, and construct an access road,
wooden groins, and a boatramp, on property identified as "Summerfield Farm",
located off US Highway 64 and S.R. 1136, adjacent the Albemarle Sound, near
the community of Roper, Washington County, North Carolina. Your receipt of
this letter verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until
the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases,
60 days after receipt of a request for certification is a reasonable time
for State action. Therefore, if you have not acted on the request, or asked
for an extension of time, by July 23, 1995, the District Engineer will deem
that waiver has occurred.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under

• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an S 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 71.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the
