Dear Mr. Wellons:
You have our approval to place fill material in 0.46 acres of wetlands or waters for the purpose
of construction of road crossings and apartment complex at NC 42 and NC 55, as you described in
your application dated 25 January 1995. After reviewing your application, we have decided that this
fill is covered by General Water Quality Certification Number 2732. This certification allows you to
use Nationwide Permit Number 14 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification.
Additional written DEM approval for a stormwater management plan including wet pond and/or
sheetflow into remaining wetlands from the entire site must received before construction begins. A
deed restriction shall be placed on remaining wetlands on the site to prevent future fill. Replanting of
the disturbed wetland area shall be done as described in the 6 February 1995 letter from Steve
Morrison, Land Management Group. In addition, you should get any other federal, state or local
permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Dear Mr. Wellons:
You have our approval to place fill material in 1.31 acres of wetlands or waters for the purpose
of construction of road crossings, commercial development, and apartment complex at NC 42 and NC
55, as you described in your application dated 25 January 1995. After reviewing your application, we
have decided that this fill is covered by General Water Quality Certification Number 2671. This
certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of
Engineers.

I enjoyed meeting you on the Don Wellons tract in Fuquay-
Varina this week and appreciate your quick response to our request
for a site review. As you will recall, the submitted nationwide
permit/401 request for minor fill in wetlands reflects a scaled-
back project design with much of the fill being necessary for
simple high ground access. We would like to have this request
reviewed as drawn. Mr. Wellons has consulted with his engineer and
they believe that stormwater features can be handled within the
upland and requested fill areas.
The logged area of wetland nearest the highway will be cleaned
up by removing the piles of logs, limbs and debris. The disturbed
areas within this wetland will have the soil stabilized with a
seeding mixture as specified by the engineer. Existing root mat,
standing tree seed source and stump sprouts will generate the
regrowth of the sapling, shrub and herbaceous layers in this logged
area of wetland. The cleanup of this area will basically serve to
help restore the wetland and its values following the logging
damage incurred by the former owner. The approximate area of
"restoration" is 3.6 acres.
Please process this request in light of the avoidance,
minimization and restoration involved with this project. I believe
this is a reasonable request reflecting the owner's responsible
attitude toward the importance of our State's wetlands.

I have enclosed seven copies of the joint application for use
of nationwide permits 14 and 26 on behalf of Don Wellons. Mr.
Wellons will be constructing apartments and mini-storage buildings
on his tract along with preparation of a highway commercial site on
Hwy. 55 near Fuquay-Varina. His engineer will be submitting the
required Sedimentation/Erosion Control Plan and Stormwater Plan for
approval as a condition of the 401 certification.
The project site was logged this past year, reducing the
existing wetland values with respect to habitat, pollutant removal
and wildlife corridors.
Mr. Wellons has reduced the wetland disturbance of the
proposed project by eliminating over one-quarter of the mini-
storage units at the rear of the property. He has also taken care
to plan development activities on the wetland fringes-avoiding the
heart of the large wetland areas. The two entrance roads cross the
wetland at narrow points. All crossings will be culverted properly
to maintain the hydrologic conditions within the wetland.
