After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786. I visited the site on 17 October 1994 to discuss concerns that we have regarding the design of the project and placing it on hold until those concerns are addressed. As of today, we have not received a response to our earlier letter. Unless we receive a response from you by 22 May 1995, we will consider that you have withdrawn this application and are not interested in pursuing the project at this time. Date: 941007 f'9 A site visit and discussion with Mr. Mitchell and Mr. Colbert on October 6, 1994 indicated that plans for the golf course have drastically changed from the plans we initially received. Also, the Corps of Engineers has not been to this site to delineate wetlands. It is thought that more wetland acreage (1/3 acre?) will be altered/destroyed, in one particular area, than anticipated from the latest plans. It should be noted that one of the main reasons for revising the plans was to avoid other areas of wetlands. They have done a good job of avoiding most wetlands on the property and the only areas to be affected now are the lake area and this one particular area on the first hole. They are also going to leave a pond right in the middle of the fairway on hole 1, which the designer wanted to take out, but they wanted the area surrounding it drained or piped for the fairway (This is where I think the wetland area is larger than appears and I want the Corp to delineate before I tell them what I think they should do). Mitchell and Colbert are extremely cooperative and have gone along with every suggestion to ensure water quality standards are kept intact including trying to create wetlands around the lake they plan to construct and 20' buffer zones around all streams located on the property. This memo is to request that I wait until the new plans have been finalized and received, which should be in about a week or two, and wait until the Corps. has had a chance to visit the site before I do a review. cc: WSRO (MEMO.
