After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. A 100 foot undisturbed buffer shall be maintained between the canal and the pasture except; in one location where direct access to water is required. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. A site visit was conducted on January 13, 1995. Our comments are provided in accordance with certain provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U. S. C. 661-667d) and North Carolina General Statues (G. S. 113-131 et seq. ) . The subject project involves clearing approximately 2.0 acres of wetlands for a horse pasture. The subject wetlands have already been fragmented and impacted due to rural residential development in the area and as such provide little or no assimilative capacity. We therefore have no comment on this project as it relates to water quality certification. Thank you for the opportunity to comment on this project in the early stages. Anderson ??dmont Regional Coordinator Habitat Conservation Program DATE: January 10, 1994 SUBJECT: North Carolina Department of Agriculture (NCDA) Proposal to Spray Bacillus thruingiensis var. kurstaki (Bt) for Suppression of Gypsy Moth Along the North Carolina-Virginia border in Northampton County, Project # 95-0388. Biologists on the North Carolina Wildlife Resources Commission staff have reviewed the subject document. Our comments are provided in accordance with certain provisions of the National Environmental Policy Act (42 U.S.C. 4332(2)(c)) the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), and North Carolina General Statutes (G. S. 113-131 et. seq.). The NCDA proposes to treat 975 acres of forest several miles north of the town of Severn with one aerial application of Bt. The purpose of this treatment is to suppress gypsy moth populations along the NC-VA border. We do not believe there will be significant adverse impacts to fish and wildlife or their respective habitats from the proposed action. The benefits from the application of this agent to suppress the gypsy moth should exceed any minor adverse impacts associated with the application.
