On November 8, 2001, stafffrom the Fayetteville Regional Office of the Division of Water Quality
conducted an annual inspection of the Taylor's Bridge Sow Farm in Sampson County. The inspection revealed that
the certified operator had applied 113 pounds of PAN on one field (pull) in one eight day period·.
This letter is to request from Murphy-Brown your policy for maximizing nutrient uptake throughout the
growing season and preventing runoff during land application of waste. This information is sought in an effort to
better understand how the application of such large quantities ofliquid and PAN over such a short duration can
meet the needs of the crop for the entire growing season. Also, this information is sought in an effort to understand
how such land application practices do not lead to the potential for runoff or other impacts to the environment.
Please ensure the most recent waste sample is used to calculate irrigation records.
We ask tor your policies and response to this matter by December 28. 2001. If you have any questions or

You are hereby notified that, having been permitted to have a non-discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC 2H
.021 7, you have been found to be in violation of your 2H .021 7 Permit.
On October 3, 2000, staff from the Fayettev ille Regional Office of the
Division ofWater Quality performed an inspection ofthe Taylors Bridge Farm after
a routine fly over identified wastewater ponding in the waste application field and
running into a pocosin located on the farm adjacent to the field in Sampson
County. During the inspection, it was confirmed that the facility was irrigating in
the field and wastewater was ponding in the spray field and in the pocosin. The
investigation confirmed that the wastewater did not enter waters of the state. It was
then recommended to an employee, a farm worker, to begin emergency measures
to include the construction of an earthen berm at the edge of the field to prevent
additional wastewater from entering the pocosin.
The Division of Water Quality requests that the following items be addressed:
1. Provide a detailed explanation as to why the runoff from the application
field occurred.

2. A more detailed and thorough inspection of the irrigation system along with spray field
conditions needs to be carried out on a routine basis before and during an irrigation event to
prevent the future release of wastewater.
3. Immediately evaluate and determine what corrective actions can be implemented to prevent
wastewater from entering the ditch in the future.
Failure to comply with the above conditions may result in the facility's General Permit
being revoked and being required to obtain an individual non-discharge permit for the facility .
Please be advised that this notice does not prevent the Division of Water Quality from
taking enforcement actions for this violation or any past or future violation. Furthermore, the
Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00
per day per violation.

Dear Mr. Rawls:
In response to your October 20, 2000 letter issuing a NOV, please refer back to my October 6,
2000 letter( attached) to Mr. Heath of your staff.
Surface waters were neither impacted nor threatened and the pending was localized, contained,
and not excessive. Therefore, we believe this more appropriately fits the definition of a Notice of
Deficiency at most or a comment on an inspection form at least, as defined in the September 6,
2000 guidance memorandum from Tommy Stevens.

In accordance with permit requirements and in response to your October 3rd visit to the
farm, our plan of action to address your concems is as follows:
Although OIC Anthony Carter was on-site moving hay bales in preparation for over-
seeding, he was unaware his irrigation activity had resulted in pending at the far end of
the spray field. The conditions of the fields were suitable for irrigation prior to beginning.
However, several factors led to the localized pending:
1) Two reels were pulled out evenly side-by-side. This created a higher
instantaneous irrigation rate in the overlap portion .
2) The reels were not travelling as fast as necessary to avoid pending at the overlap .
3) The far end of the field is the lowest elevation.
We have reprimanded and redirected the irrigator to offset or separate reels, increase
traveler speed, and check field conditions more often.
No irrigated water reached waters of the State. This was confirmed by our lab sample.
No ponded water reached further than eight feet beyond the cattle fence into a dry
wooded area.

On June 5, 2002, staff from the Fayetteville Regio na l Office of the Division of Water Q uality conducted a
routine compliance inspection of the above refere nced facility in Sampson County. The inspection revealed that
none of the mi llet fields had been established as req uired by the facility's Waste Utilization Plan (WUP). It was
also noted that irrigation records indicated an application even t o n May 7 , 2002 for hydrant #3 5 in a millet field.
This event is within one (I) day of the expiration of the 30 day pre-plant window allowed for waste application. ·
During a follow up complia nce inspection on June 6 , 2002, facility re presentatives had initiated planting of the
required millet crop. We were also informed, by a facility representative, that there was not an application event
for hydrant #35 due to a record keeping error.
The Division of Water Quality requests that the following it em(s) be addressed:
I . Complete crop establishment in all fields as required by the facility's WUP .
2. Submit corrected lRR-1 and IRR-2 forms and note all corrections made.
Failure to comply with the above conditions may result in th e facility losing its General Permit and being
required to obtain an individual non-discharge permit for the facility .

Dear Mr. Sherman :
In response to your June 11, 2002 letter issuing a NOD, please refer to the following action plan :
As you noted, we completed seeding all the millet fields in accordance with the Nutrient
Utilization Plan (NUP) the day after your first visit (June 6, 2002). While this date is slightly
later than our usual planting time, the delay is certainly warranted given the drought conditions
we had faced thus far and our mutual goal of establishing and growing a healthy crop capable
of waste nutrients uptake.
As also noted by you, the OIC did record an application on hydrant #35(millet) in error. The
actual event occurred on hydrant #30(bermuda). While the planting of the millet made the
original application on #35 valid one, the OIC corrected his records (attached) to reflect the
actual location . The confusion was due to the uncertain and changing plan on the timing of the
millet planting. In early May, the OIC began to move irrigation equipment to the millet field in
preparation for planting within 30 days; however, when he was informed by the planters that
they would wait until we had some rain to plant the millet, he diverted the equipment to the
bermuda fields .
