On September 1, 2006 you or staff from your farm notified the Fayetteville
Regional Office of the Division of Water Quality, as required by General Permit condition
III.S.e, that the freeboard level of the lagoon was less than the minimum required by the
General Permit. The liquid level of the lagoon 1 was reported as 16 inches .. General
Permit condition V.3 states "The maximum waste level in lagoons/storage ponds shall not
exceed that specified in the CAWMP. At a minimum, maximum waste level for
lagoons/storage ponds must not exceed the level that provides adequate storage to
contain the 25-year, 24-hour storm eve~t plus as additional 1 foot of structural freeboard.·
The Division of Water Quality will take no further action for this reported incident
at this time. However, if you have not done so you are asked to please notify this office
in writing within 15 days of receipt of this letter as to what date the lagoon was lowered
within the specified time frame in which the Plan of Action (POA) allotted. It will also
close this event out within your file. If you have any questions concerning this matter,

On April 7, 2008, you . or staff from your farm, notified the Fayetteville Regional Office of the Division of
Water Quality, as required by General Permit condition Ill 13 C. that the freeboa rd level of the lagoon was less than
the amount required by the General Permit. The liquid level of lagoon #1 was reported as 18.5 inches . General
Permit condition V 2. states "The maximum waste level in lagoons/storage ponds shall not exceed that specified in
the CAWMP . At a minimum, maximum waste level -for lagoons/storage ponds must not exceed the level that
provides adequate storage to contain the 25-year. 24-hour storm event plus an additional 1 foot of structural
freeboard ." On your farm. that is a maximum waste level of 19 or 19.5 inches freeboard.
The Division of Water Quality will take no further action for this reported incident at th is time . The
Division recommends that you review your facilities and procedures with the goal of eliminating future high
freeboards , which could lead to mandatory review of your Waste Utilization Plan by a Technical Specialist,
Notices of Violation or monetary penalties .
The Division appreciates your cooperation in self-reporting high freeboards, pumping down lagoon levels ,

On December 14, 2 009, staff of the NC Division o f Water Quality (DWQ), Aquifer Protection Section
(APS) were notifie d by Greer Moore of a hi gh freeboard leve l in th e lagoon 1. We wish to thank Mrs.
Moore for notifying DWQ of thi s incident.
As a result of this incident, you are he re by notified that, having been permitted to have a non-discharge
permit for the s ubject animal waste di sposal system pursuant to I5A NCAC 2T Section .1300, you have
been found to be in violation of your Certifie d Animal Waste Management Plan and the Swine Waste
System General Permit No. A WG I 00000 that you are covered to operate und er, as follows:
Deficiency 1:
Failure to maintain waste level s in yo ur lagoon/stora ge ponds in accordance \vith the facility's Certified
Animal Waste Management Plan in accordan ce with Condition V. 2. of Swine Waste System General
Permit No . A WG 100000.
On December 14, 2009 a lagoon/storage pond level was documented at 18 .00 inches in lagoon l. A
level of 19 in ches is the maximum level allowed by your permit and Certified Animal Waste
Management Plan.

Required Correctin Action for Deficiency 1:
DWQ has received a copy of your 30 Day Plan of Action (POA) for the high freeboard occurrence.
Take all necessary additional steps to insure lagoon levels remain in compliance with Section 2 of your
permit.
This is the second NOD in a three year period you are now required to obtain a review of your Waste
Management Plane by a Technical Specialist. This review must be submitted to the Fayetteville
Regional Office in writing within 60 days of receipt of this NOD. The review must contain any
corrective action taken or proposed to be taken to improve the facility's compliance.
A com pi iance inspection was done 12114/20 l 0 and all records were reviewed and the date and time
lagoon 1 returned to compliance on 03/15/2010.

Dear Mr. Guyton,
I have performed a technical review of Mr. Ronnie Carter's Waste Management
Plan for facility 82-688. I reviewed his daily precipitation levels ove,r the past 3 years,
and have also taken time to inspect the grade around all hog houses, to ensure that all
storm water is diverting away from the hog houses and the lagoon.
I spoke with Mr. Carter about the importance of doing daily water line checks in
all of his hog houses. I also mentioned to him that he may want to consider installing cup
waters in the hog houses which would help conserve excess fresh water from entering the
lagoon.
Lastly, I emphasized the importance of getting his lagoon level 8 inches below
stop pump between June 15th-Oc tober 31 5\ and trying to maintain that level going into
hurricane season. I also went over his available PAN rates on Bermuda, and again
emphasized the importance of utilizing those rates during the summer months to get his
lagoon level down in preparation for hurricane season and/or a wet winter. Mr. Carter
has recently added a new field, approximately a 5.0 acre pull, to his waste management
plan . Mr. Carter has more than enough land available for land application.
