Thank you for your recent submittal of the information requested in our letter dated April 15,
2003. We greatly appreciate the effort that you made in compiling this information and sending
it to our Fayetteville Regional Office by the date required. We also appreciate the fact that you
reported the problem with high freeboard to our staff as required by your permit and worked with
our staff to manage the problem once it occurred.

Upon review and consideration of the information submitted , the Fayetteville Regional Office
has determined that no further compliance/enforcement actions will be taken by the Division for
these high freeboards .
Also, based on yout actions to properly operate your facility, the Division of Water Quality·
hereby rescinds the Notice of Violation that was issued to you on April 15, 2003, and replaces it
with this Notice of Deficiency.
In the future, please continue to evaluate ways to maintain freeboard levels in the required range.
These methods include, but are not limited to, water conservation practices, adding additional
application sites, updating your cropping systems, adding additional and/or more flexible
application equipment, and maintaining the lagoon levels at the lowest allowable and appropriate
levels throughout the year. Our staff looks forward ~o continuing to work with you and your
Technical Specialist to evaluate and implement any needed changes to your system.

On March 10, 2003, a representative of your animal operation informed the Division of
Water Quality (DWQ) that there was inadequate freeboard in the lagoon(s) serving this facility .
This lack of adequate freeboard is in non-compliance with the Certificate of Coverage
issued to this facility on May 19, 1997. In addition to this Notice of Violation (NOV), this non-
compliance is subject to an appropriate enforcement action by DWQ. This action can consist of
one or more of the following : a civil or criminal enforcement action; an injunction; and/or a
requirement to apply for coverage under an individual permit. The action chosen will be based
on complete evaluation of all factors that re sulted in the inadequate freeboard; the actions taken
to restore the needed freeboard ; and · the actions being proposed to prevent the problem from
reoccurring.
To assist us in our review, please provide the Fayetteville Regional Office with an
evaluation of the reasons for the freeboard violation(s) and a strategy to prevent future freeboard
violation(s). This evaluation and strategy must include but is not limited to the following:

Freeboard level records in the lagoon(s) for the past 12 months up to the date of submittal
Spraying records for the past 12 months up to the date o f submittal

Cropping system and PAN specified in the CA WMP. If the cropping system was not in
compliance with the facility 's CAWMP, provide details of the cropping system in place
for the past 12 months.
A ·summary of actions taken to restore the needed freeboard in the lagoon(s) including but
not limited to removal of animals from the site, delay of restocking of animals, pumping
and hauling waste to another site (specify site), securing additional irrigation equipment,
and securing additional spray sites.
A description of water conservation measures m use at the facility and the date(s)
installed.
If the lagoon level(s) are still in violation of the facility's CA WMP and Permit, provide
an updated Plan of Action as to how the facility will return to compliance.
Provide a detailed description of the actions taken or proposed to be taken to insure that
there are no further freeboard violations at this facility.
This information must be received by the Fayetteville Regional Office at the following
address no later than 10 days following receipt of this letter.

Once this information is received and evaluated by the DWQ staff, a determination will
be made as to the appropriate compliance/enforcement actions to be taken. Each case will be
evaluated on its own merit. The efforts by the owner/producer to notify DWQ of the problem,
efforts made to resolve the problem once identified, and efforts proposed to prevent future
problems will be positive factors in this determination .
Nothing in this letter should be taken as removing from you either the responsibility or
liability for this non-compliance or future cases of non-compliance. If you have any questions
regarding this letter, please do not hesitate to contact our Fayetteville Regional Office Staff at

In response to your September 11 , 2000 Jetter concerning the Stafford Farm:
1. The low-nutrient two-stage lagoon and the large acreage on this farm make it
impossible to optimally fertilize the bermuda and matua grass crops( see
attached IRR-2s). Through grazing and hay harvesting, we have removed as
much or more as we applied. The matua fields are just now in the process of
the seed breaking dormancy, so you would not have been able to evaluate
the stand(One matua field we applied an average of 40LBS this Spring and
the other zero) . We do expect good germination and will supplement seed if
necessary late this month. We plan to convert any grass fields we deem poor
to row crops this next crop cycle .
2. The discharge pipe between the primary and secondary lagoons has been re-
set once in the past two years due to sagging and our Engineering
Department will correct it again this mon t h.

On September 6, 2000, staff from the Fayetteville Regional Office of
the Division ofWater Quality conducted an annual inspection of the
Stafford swine farm located off SR 1259 in Sampson County . The
inspection revealed that the bermuda crop was poor and the matua grass was
nonexistent. In addition, one of the two discharge pipes between the
primary and secondary lagoons was not set properly resulting in the primary
lagoon level rising higher than the design level of 19 inches.
The Division of Water Quality requests that the following items be
addressed:
1. Continue efforts to improve the coastal bermuda grass stand.
2. Adjust the improperly set discharge pipe between the primary and
secondary lagoon to the proper level to assist in maintaining the
required design level.

RE: NOTICE OF VIOLATION for Facility No. 82-682
Dear Mr. Hasty:
In response to your August 13, l999letter regarding the Stafford Farm, please consider the
following:
1. The bermuda sprayfield to which irrigation was being applied on August 11 was not saturated;
however a sinkhole in the area of the far ends of the pulls where stumps from land clearing were buried
held ponded water mixed with irrigation water. This shallow (3"-4" deep) sink hole worsened by the
cowherd lying in it to keep cool. As irrigation records {attached) show, irrigation in the area in
question was ahemated day to day between two pulls and no irrigation amount was greater than 0.33
inches/acre. As you noted, all water was permanently contained in this shallow sinkhole. Prior to
irrigating in this bermuda field, the operator irrigated 26 acres of matua, then 18 acres of millet, then
11.4 acres of bermuda and 8.8 acres of soybean in other fields.
2. The coastal bermuda in the field in question was sprigged last spring and has been grazed since.
Mixed in this pasture with bermuda, is crabgrass and some johnsongrass. According to our staff
Technical Specialist, during committee meetings on SBI217, Dr. Green ofNCSU affirmed that grass
monocultures were neither achievable nor necessary in grazing and any warm season grass was
acceptable in a mixed pasture ofbermuda, and that crabgrass utilizes the same PAN ~d grows during
the same months as bermuda. Upon your directive though we can 5p13y MSMA in the spring to kiD
the crabgrass and johnsongrass; please let us know by February 2000.
3. The irrigation equipment in question was repaired by a contractor on August 2JJd , but lll1SllCCeSSfuly
unbeknownst to us. It was successfully repaired August 131h. Less than thirty gallons ponded around
the machine at the field edge.
4. The operator did not neglect to tum off the irri~on pump when the irrigation event completed. The
gun cart came in to the reel and tk pump was cut off within five minutes. The less than twenty
gallons of effiuent that seeped into the newly cleared lane was normal drainage from the reel hose as
pump pressure is relieved.
Since your visit, we have constructed small benns around "at risk" risel"S to contain this hose drainage.
We have also graded the sink hole area to drain rain water slowly out of the sprayed area and seeded
with rye. By October 1st, we will seed file newly cleared lane with fescue.
Please review these facts and reconsider the issuance. Please also respond to myself or Kraig
Westerbeck if any further actions by us are necessary. Thank you.

You are hereby notified that Stafford Swine Fa.rm, which has been
pennitted to have a nondischarge permit for an animal waste disposal system
pursuant to ISA NCAC 2H.02177 has been found to be in violation of its

On August 11, 1999, staff from the Fayetteville Regional Office of the
Division of Water Quality conducted and inspection of the waste application
fields at Stafford Swine Facility located off SR1259 in Sampson County after
observing waste ponded in the field during aerial surveillance. The inspection
revealed that waste was being applied to a saturated field with a poor to
nonexistent bermuda crop where waste was previously ponded from a prior
irrigation event. In additio~ the operator neglected to turn off the irrigation
pump when the irrigation event was completed, resulting in animal waste
running off the field into a newly cleared lane adjacent to the field . Also, waste
was being applied simultaneously to a soybean field at agronomic rates with
equipment in need of repair resulting in waste ponding and running off the
waste application field which are violations of General Permit condition (section

The Division ofWater Quality requested that the following items be addressed :
1. Evaluate the irrigation records to detennine if the operator is utilizing
all the available waste application fields to prevent future over-
application problems.
2 . Evaluate the crops to determine the suitablity of the stand for waste
application and what measures are available to improve the crops .
3 . Immediately inspect the irrigation equipment components and repair and
replace as necessary.
4. Plant a suitable cover grass in the field buffers to curtail run-off and to
assist in the assimilation of the nutrients.
Please be advised that this notice does not prevent the Division ofWater
Quality from taking enforcement aciton for this violation or any past or future
violation. Fwthennore, the Division of Water Quality has the authority to levy
a civil penalty of not more than $25 ,000 per day per violation.
Please provide a written response to this office on or before September
15, 1999, regarding corrective actions taken or planned . If you have any

Dear Dr. Boyd:
On March 27, 1998, staff from the Fayetteville Regional Office ofthe
Division of Water Quality responded a discharge at the Stafford farm, called in
by Scott Faircloth and Trent Allen of the Division of Soil and Water. By the
time DWQ arrived, approximately one hour after receiving the call, a
bulldozer had been brought in and had filled in a ditch to keep the waste from
entering a small stream on the property. After further investigation, the
following narrative outlines the events, as verbally expressed to the inspectors
on March 27, 1998, concerning the specifics of this incident.
Mr. Paul Faircloth was performing a routine irrigation on a field at the
Stafford Fann and was on site. Per Mr. Fairclot~ as the irrigation gun
approached the reel he noticed that waste was running toward the edge of the
field via tractor tracks in the field . He immediately left to tum off the pump.
The waste entered an old ditch perpendicular to the small stream. It was at
about this time that DS&W was riding by the farm and noticed the waste in
the field and called DWQ. At the same time Mr. Paul Faircloth was on his
way back to the field with a tractor to disc the tractor tracks in the field to
stop the waste from leaving the field . He had already called in a grading
service to fill in the ditch to keep the waste from entering the stream.

It did not appear to the inspectors that waste had reached the stream and that the blockage
was sufficient to keep it from entering the stream. Samples were taken but were inconclusive as
to the impact ofthis discharge. Due to the quick response by Mr. Faircloth the waste was
contained and was to be pumped back onto the field from the ditch. It must also be noted that the
bulldozer was on site within approximately twenty minutes after the discharge was noticed.
Please provide this office with a written response, by May 18. 1998, outling the
circumstances of this incident and the actions taken, or planned, to avoid this situation in the
future.

SUBJECT: NOTICE OF DEFICIENCY
Stafford Farm
Registration No. 82-682
Sampson County
On September 4, 1997, staff from the Fayetteville Regional Office of the Division of Water
Quality inspected the Stafford Farm swine facility . It was observed that the facility did not have a
copy of the Certified Waste Management Plan (CAWMP) on-site and none of the waste
application fields have been planted . The primary lagoon was in the emergency storage level (18
inches) according to the lagoon marker and requires adjusting of the piping system between the
first and second stage lagoons. The irrigation system was in the process of being installed at the
time of the inspection.
In regard to the deficiencies noted during the inspection, the following actions are requested :
1. Consult with a technical specialist for assistance in regard to detennining the problem or
problems resulting in the lagoon level in the emergency storage zone .
2 . Obtain a copy of the CA WMP for the facility to be maintained on-site and submit a copy to
the Division of Water Quality with all certification forms for review to the Regional Office
address at the bottom of the letterhead page.
Please notil)' this office on or before September 22, 1997 at the address below as to the
actions taken or proposed to be taken to resolve this deficiency . Nothing in this letter sh~:mld be
taken as absolving this facility of the responsibility and liability of any violations that have or may
result from these deficiencies .
