After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3022. This certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get anv other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. , This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. The project, previously known as the Sunset West Development and currently called Sunset Ridge the golf course is now called Devils Ridge, is owned by SSL Limited Partnership. The project is located near Holly Springs, NC (Wake County), and is bordered by SR 1152 and Middle Creek (as shown on the enclosed plans, and Apex, NC, USGS Topo Quad vicinity map). The original permits were for a golf course and two different developments (each owned by a different entity), but for regulatory purposes they were considered one project. Our firm has performed the detailed wetland delineation shown on the attached map. The delineation has been approved by Mr. Alsmeyer of the U.S. Army Corps of Engineers. Impacts to wetlandswill be required to construct a sanitary sewer interceptor for the residential development. Construction of the sewer interceptor will require impacts to 1.1 acres of forested wetlands. Impacts will be covered under the provisions of Nationwide Permit 12. Previously a total of 3.34 acres was authorized for the entire development (for both residential and golf course areas). Nationwide Permit 14 acreage was 0.51, and Nationwide 26 was 2.83 acres. Current revisions will require an additional 1.1 acres of wetland impacts under Nationwide Permit 12. If approved, total impacts for the project will amount to 4.44 acres. Sincerely, ,16c, (/?
