Facility No. 82-664 , Permit No. A W$82-0664 Sampson County Dear Mr. Grimes: On January 7, 2011 staff of the NC Di vis ion of Water Quality (DWQ), Aquifer Protection Section, did a follow-up inspection of Grimes Road Farms to check for repair of a leaking hog house. A s a result of thi s inspection, you are. hereby notified that, having bee n permitted to have a non-discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T .1304, you h ave been found to be in violation of your permit as follows: Violation 1: Discharge of animal waste. (Permit No . A WS0901 76 Section I. 1.) On January 7, 2010 DWQ sta ff noti ced a leaking valve near the lagoon pump. The waste exited through a storm water pipe into wetlands leading to Goshen Swamp. The waste was mo stl y infiltrating and unrecoverable. DWQ acknowledges that this section of th e waste system was completed on December 2, 2 0 I 0 and operator unfamiliarity was likely a contributing factor. DWQ thank s you for your fast response when called. Required Corrective Action for Violation 1: Please take all necessary steps to ins ure this violation does not recur. DWQ has calculated that the pipe can hold over 1700 gallons of hog waste. Since the pump and one or more valve s are lower in elevation than the spray field , back siphoning can occur in case of mechanical failure or improper closure. Currently, there is no provis ion for containment of hog waste that gets out of the system. Also, ability to drain the system following irrigation events would be beneficial, especially durin g the s ummer. The lower lagoon is surrounded on three sides by wetland s in close proximity to Goshen Swamp, a major perennial stream. An explanarion from rhe OIC for this farm regarding how this violation occurred 2. A list from the manager concerning the steps that will be taken to prevent this violation from occurring in the future. You are required to provide a written response to this Notice by March 4, 2011. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to the Director of the Division of Water Quality who may issue a civil penalty assessment of not more that twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms, conditions, or requirements of a permit under authority of G.S. 143-215 .6A.
