Preston Howard, Jr., P.E., Director November 3, 1995 Sampson County DEM Project # 95927 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONM Mr. James Colman McLamb FRT cop 693 Pine Forest Church Road Roseboro, N.C. 28382 Dear Mr. McLamb: You have our approval to place fill material in 1.25 acres total (0.34 acres of new fill in wetland) of wetlands or waters for the purpose of extending your existing turkey house off Feed Mill Road (SR 1459) in Sampson County, as you described in your application dated 29 August 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. The toe of the slope of the fill shall not exceed 160 feet from the end of the existing building or the width of the existing fill for the turkey house. An appropriate silt fence shall be planed at the limits of the fill to contain sediment runoff from the fill. The fill slopes shall be seeded for stabilization within 30 days of project completion. No other impairments to water flow shall be placed in the wetland without modification of this certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are fmal and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. McLamb 401 Water Quality Certification for filling wetlands associated with turkey brooder house expansion, on SR 1459 near Salemburg, Sampson County, North Carolina. DEM ID: 95927. The Wildlife Resources Commission has reviewed the subject permit application. A site visit was made on September 28, 1995. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.). The applicant has applied for Water Quality Certification to fill approximately 1.25 acres of wooded wetlands. The project's purpose is to expand an existing turkey brooder house into a growout house by adding 128 ft. to the rear of the structure. The rear of the structure is presently about 50 ft. from the wetlands. A series of additional turkey houses occur on an adjacent highground field. Wetland soils were dry and mostly barren of herbaceous understory at the time of our site visit. It looked as though livestock had been kept in the area at one time. Wetland vegetation included red maple, sweetgum, water oak, and greenbriar. Raccoon, oppossum, and songbirds may use the area. It is unclear as to whether these wetlands are r isolated. A hydraulic connection to area streams may indeed occur during periods of wet weather. If this is so, project wetlands may be performing an important filtration function for runoff leaving the turkey farm and entering Little Coharrie Creek. In our view, wetland loss can be averted or at least minimized by adopting a highground alternative. One alternative would be to expand one of the existing turkey houses on the adjacent highground field rather than the one next to wetlands. A second alternative would be to split the proposed expanded floorspace between the front and back of the building, or in other words, add 64 ft. to the front and 64 ft. to the back. This would reduce encroachment on wetlands. We recommend that the project be so modified to either avoid or minimize impacts to wetlands. Thank you for the opportunity to comment on this project.
