After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2664, 2732 and 2671. These certifications allow you to use Nationwide Permit Numbers 12, 14 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification- Anti- seep collars shall be located at no more than 150 foot intervals as the sewer line passes through wetlands. Deed restrictions shall be added to the deed which includes the wetlands and streams in the dedicated open space to prevent future fill. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. The project, owned by Pulte Homes Corp. Inc., is located near Raleigh, NC (Wake County). The site is east of Kyle Road (NCSR 2231) and south of US HWY 401 as shown on the enclosed plans, and Raleigh East, N.C., USGS Topo Quad vicinity map. The wetland delineation has been approved by Mr. Alsmeyer of the U.S. Army Corps of Engineers, a copy of the signed delineation map is available upon request. Fill in wetlands will be required to construct private residences, roads and utility lines as part of the infrastructure of a residential development. It will be necessary to impact 1.193 acres (see map) of jurisdictional wetlands above headwaters for placement of some of the proposed roadways and utility lines. A total of 0.073 acres will be impacted for the placement of lots under Nationwide 26. A total of 0.04 acres (see map) will be filled for road crossings under Nationwide Permit 14. The road crossing is perpendicular to wetland alignments, in order to minimize impacts. Utility line construction will impact 1.08 acres of wetlands. Utility construction easements are 40 foot wide, with a permanent maintained easement 20 foot wide. To expedite the permitting process the following individuals/ agencies have been provided with a complete copy of this entire application package: U.S. Fish and Wildlife Service, National Marine Fisheries, N.C. Cultural Resources, Danny Smith (DEM) and Wilmington Corps (Chief of Regulatory Branch).
