You have our approval to place fill material in 0.417 acres of wetlands or waters for the purpose
of constructing the Lewey Farms Subdivision at SR1610, as you described in your application dated 6
October 1995. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Numbers 3022, 2732 and 2671. These certifications allow you to use
Nationwide Permit Numbers 12, 14 and 26 when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. Deed
restrictions or similar measures shall be placed on all lots with jurisdictional wetlands to prevent future
fill. Fill shall not be placed in wetlands on lots 263, 272, 273, 236 and 237. Stormwater from the
cul-de-sac and nearby lots shall be directed to flow into the wetland on lot 263 to maintain its
hydrology. In addition, you should get any other federal, state or local permits before you go ahead
with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

The subsequent natural conversion of the pond margin and areas upstream of
the pool to wetland (an estimated 1.08 acres including the pool) will help offset
losses caused by construction. Although a sedimentation and erosion plan will
be installed to preserve water quality, the pond will provide additional benefits.
Water storage, pollutant removal and aquatic habitat values will significantly
increase. The DEM rating value for the wetland on the property was 54 (See
attached form).

Construction of a residential subdivision (see map).
13. Purpose of proposed work:
To provide access to upland portions of the property.

carried out in wetlands. Also, note measures taken to minimize wetland

The streams must be crossed to utilize uplands. Road crossings are all nearly at right angles to
drains. Rear lot lines have been adjusted parallel to the wetland. Therefore the wetlands
contained within lots will maintain some of their values and functions (eg. They may be cleared
but not filled for the construction of the home).

Reference is made to the survey plat dated July 21, 1995, titled "Wetland
Delineation Map for Mildred A. Lewey Tract". Specifically, the "Lewey Tract"
is located north of S.R. 1610, east of Highway 55, adjacent to two unnamed
tributaries to White Oak Creek, near Apex, in Wake County, North Carolina.
The survey plat accurately reflects the limits of wetlands on the property as
delineated by your consultant, Mr. Jamie Shearn with soil and Environmental
Consultants, and field verified by Mr. Brandon DeRosa of my Raleigh Field
office staff. Unless there is a change in the law or our published
regulations, this determination of the limits of wetlands may be relied upon
for a period not to exceed August 15, 2000. Enclosed is a copy of the plat
and a copy of the survey data.
Pursuant to Section 404 of the Clean Water Act, prior Department of the
Army approval is required for the discharge of dredged or fill material in
waters of the United States, including wetlands.

The purpose of this letter is to inform you of the intent to utilize Nationwide
Permits 12,14 and 26 to cover proposed wetland impacts from the establishment
of the Lewey Farms Subdivision Project. The project is located in Apex, NC
(Wake County) and is east of NC Highway 55, north of SR 1610, and south of
White Oak Creek; as shown on the enclosed vicinity map.
The wetland delineation has been reviewed in the field and approved by Mr.

To provide access to upland portions of the property.

The streams must be crossed to utilize uplands. Road crossings are all nearly at right angles to
drains. Rear lot lines have been adjusted parallel to the wetland. Therefore the wetlands
contained within lots will maintain some of their values and functions (eg. They may be cleared
but not filled for the construction of the home).

Reference is made to the survey plat dated July 21, 1995, titled "Wetland
Delineation Map for Mildred A. Lewey Tract". Specifically, the "Lewey Tract"
is located north of S.R. 1610, east of Highway 55, adjacent to two unnamed
tributaries to white Oak Creek, near Apex, in Wake County, Noi th Carolina.
The survey plat accurately reflects the limits of wetlands on the property as
delineated by your consultant, Mr. Jamie Shearn with Soil and Environmental
Consultants, and field verified by Mr. Brandon DeRosa of my Raleigh Field
office staff. Unless there is a change in the law or our published
regulations, this determination of the limits of wetlands may be relied upon
for a period not to exceed August 15, 2000. Enclosed is a copy of the plat
and a copy of the survey data.
Pursuant to Section 404 of the Clean Water Act, prior Department of the
Army approval is required for the discharge of dredged or fill material in
waters of the United States, including wetlands.

SUBJECT: 401 Water Quality Certification for Mildred A. )Dewey Farm Subdivsion, Wake
County, Apex NC, White Oak Creek, Cape Fear Basin, No. 95788
Staff biologist: with the North Carolina Wildlife Resources Commission have reviewed the
subject document. Our comments are provided in accordance with provisions of the Clean Water
Act of 1977 (33 U.S,C, 466 ct seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as
amended; 16 U.S.C. 661-667d) and North Carolina General Statues (G.S. 113-131 et seq.).
The applicant proposes to impact 0.063 acres under NW 14, 0.024 acres under NW 12
and 0.437 acres under NW 26 for construction of a subdivision. A total of 0.172 wetlands will
not be disturbed.
We request that the certification be modified and conditioned as follows:
1 Reduce the overall wetland impacts by prohibiting fill on lots 263, 272, 237, and 236. It
does not appear that this fill is necessary for building on these lots. Protection of these
areas will increase the wetlands on the property and keep the wetland areas in this drain
from becoming fYagmented.
2. Deed retrictions should be placed on individual lots to prevent any further wetland
destruction by current or future owners,
3. There should be no future authorization for wetland destruction for the portion of this
tract that was not examined.
