In response to your September 4, 1997 visit to the Sampson/McKay Boar Stud Farm,
the following actions are planned or completed:
1. Staff technical specialists and engineers concurred that no problem exists with the
lagoon or liner. The liner material is a darker, more brown color than the more typically
seen red clay, being an elastic silt material which is as or more an adequate sealant.
Although this lagoon was constructed before we began conducting porosity tests on all
new lagoon construction, we have conducted porosity tests on identical material since
then with results showing a PI of 55 and 95% passing through a 200 sieve, indicating
excellent liner material. These test results are available from our engineering
department if needed.
2. Winter rye will be planted in the designated sprayfields during the month of
October. This will be followed in spring by the sprigging of coastal bermuda.
The boar studs, by nature and design, use less water than typical hog units and
therefore fill the lagoon slower. The first day of irrigation for this farm will probably take
place late this winter.

Dear Mr. Heath: September 25, 2000
In response to your September 12, 2000 letter concerning the Sampson Boar Stud Farm:
The low water use and therefore low waste flow at this and all of our boar studs make it
impossible to optimally fertilize the bermuda grass. We re-sprigged this farm again
earlier this summer for at least the third time. We then flushed with fresh water for
months just to have enough water and nutrients to establish a crop. We currently have
the best stand of grass (bermuda/crabgrass) ever at this 16-acre site. Harvest will occur
as soon as weather permits.
Our technical specialist will re-write the plan for bermuda/crabgrass. We plan to
supplement fertilization next spring and summer to improve the stand.

1. This fann was sprigged in Spring '97 and again in June '98 acting in response to an ear1ier DWQ
request. The constraint to establishing and maintaining a healthy stand of any crop is the fact that
boar studs by design produce very little effluent for irrigation. In the last twelve months, we
irrigated across the entire field one time in June, applying nine pounds of nitrogen (see records
attached). The fact is, lagoons and sprayfields for boar studs were so over-designed that we are
precluded from establishing and then maintaining a good crop. Please advise us of any ideas you
may have on how to deal with this dilemma. We have considered hauling sludge from another
lagoon but so far it has been economically impossible due to hauling distance and anyway issues
of bio-security are unresolved since the boar studs are near the top of the bio-security pyramid.
Please direct us as to what we can do to avoid any future preble s at this farm. Thank you.

Sampson County
On September 6, 2000, staff from the Fayetteville Regional Office of the Divi sion
of Water Quality conducted an annual inspection of the Sampson Boar Stud swine farm
located off H wy 41 in Sampson County. The inspection revealed that the bermuda crop
was poor to nonexistent as has been the case for all past inspections with one notable
difference, the waste application field had a good stand ofs summer annual (crabgrass).
The Division of Water Quality requests that the following items be addressed:
1. Continue efforts to improve the coastal bermuda grass stand and apply waste
sparingly to improve the stand.
Please be advis ed that this notice does not prevent the Division of Water Quality
from taking enforcement actions for this violation or any past or future violation.
Furthermore, the Division of Water Quality has the authority to levy a civil penalty of
not more than $10,000 .00 per day per violation.

On September 4, 1997, staff from the Fayetteville Regional Office of the Division of Water
Quality inspected theSarnpson I McKoy Boar Stud swine facility . It was observed that the facility
did not have the required crops planted or the irrigation plan as specified in the CA WMP
conditional certification on or before December 3, 1996. The entire lagoon bank was devoid of
any vegetation and the soil appeared to be inconsistent with that normally observed for a lagoon
liner.
In regard to the deficiencies noted during the inspectio~ the following actions are requested :
I. This facility has a lagoon that is approximately 4 feet below the anticipated pump on level of
December 3, 1996, according to design criteria suggesting that a problem exist with the lagoon.
Contact a technical specialist or an engineer for assistance in regard to recertifying that the lagoon
has been properly designed and that the appropriate liner material was properly installed and
submit a copy of the report to this office.
2. Immediately plant a crop to comply with the CA WMP and specify an operation and
maintenance irrigation plan to attach with the CA WMP should future waste application be
required .
Please notify this office on or before October 8, I 997 at the _address below as to the actions
taken or proposed to be taken to resolve this deficiency . Nothing in this letter should be taken as
absolving this facility of the responsibility and liability of any violations that have or may result
from these deficiencies.

On August 16, 1999, staff from the Fayetteville Regional Office of the
Division ofWater Quality perfonned an inspection of the Sampson Boar Stud
Farm in Sampson County. The inspection revealed that the application field
had a poor to nonexistent bermuda stand. Along with crabgrass and other
weeds, there were gwn tree saplings growing in the field.
In regard to the deficiencies noted during the inspection, the following
actions are requested:
1. Establish an acceptable bennuda crop on the application field. as
required by theCA WMP, to effectively take up the nitrogen produced
at this farm.. ·
Please provide this office with a written response, by September 17,
1999, as to the actions taken, or proposed to be taken, to resolve the
deficiencies noted. Nothing in this letter should be taken as absolving this
facility of the responsibility and liability of any violations that have resulted or
may result from these deficiencies.
