After a further review o f the situation and given the current s tatus of this fann it is my decision to retract the civil penalty asses sed in case number OV 97-98 and close otlr file on this matter. Please be advised that nothing in this letter should be ~aken as removing from you the responsibility or liability for failure to comply all applicable rules and regulations at the subject fann. Inactive lagoons and storage ponds were defined by the Statute as structures which were previously used to store animal waste but have not received waste for at least one year. The information collected on your property is contained in the attached field data sheets. Using this field data, staff ranked your inactive waste structures as high, medium or low according to its potential risk for polluting surface and/or groundwater. Your waste structure(s) was ranked as follows: Structure Number 1 Surface Area (Acres) 1.23 Ranking Medium This ranking is based in part on the conditions existing on the day of the site visit. Changes in these conditions or the collection and evaluation of additional data may modify the ranking of your waste structure(s) in the future. Information on your facility along with over I 000 others contained in the inventory has been provided to the General Assembly. These include taking appropriate actions to eliminate current discharges , prevent future discharges and to insure the stability of their structures. Staff of the Division of Water Quality will be in contact with owners of all inactive structures that have been determined to pose a serious environmental risk, based on its ranking and/or additional field data collected by the Department. All liquids and waste removed from these structures must be land applied at a rate not to exceed the agronomic needs of the receiving crops . Any major modifications made to the dike walls or structure must be done in accordance with current standards and under the direction of a technical specialist designated for structural design. Your local Soil and Water Conservation District is an excellent source for information and guidance related to proper waste application practices, structure operation and maintenance, and other related animal waste management standards and/or requirements. Nothing in this letter should be taken as removing from you the responsibility and liability for any past or future discharges from your lagoon(s) and/or storage pond(s) or for any violations of surface water or groundwater quality standards. OFFICE Subject: Fertilizer Application Recordkeeping Animal Waste Management System Facility Number 82-643 Sampson County This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN) application on fields that are part of your Certified Animal Waste Management Plan. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and indusuial sludges/residuals, and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping forms (i.e. IRRI, IRR2, DRYl, DRY2, DRY3, SLURl, SLUR2, SLDl, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ} compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during routine inspections. Facilities not documenting aH sources of nitrogen application will be subject to an appropriate enforcement action. OFFiCE Subject: Notice of Violation and Assessment of Civil Penalty for Violation of N.C.G.S. 90 A-47 .2 and 15A NCAC 8F .0201 M&MFanns Facility#: 82-581 Sampson County Case #: OV 97-098 This letter transmits a Notice of Violation and a notice of a civil penalty assessed against Michael Peterson in the amount of $500.00. This assessment is based upon the following facts: Michael Peterson operates an animal operation and associated animal waste management system in Sampson County. As of January 1, 1997, in accordance with N.C .G.S. 90 A-47 .2 and 15A NCAC 8F .0201 a certitied operator in responsible charge is required to operate the subject animal waste management system. I I ' ~ ~ In accordance with 15A NCAC 8F .0201(a), the owner of each animal operation having ; an animal waste management system must submit a letter to the Certification Comrilission, Division of Water Quality (DWQ), Technical Assistance and Certification Group, which · designates an Operator in Charge with the appropriate type of certification. This letter must be signed by the owner and the certified operator and be submitted to the Certification Commission by January I, 1997 for all facilities in operation as of that date. In November, 1996 and April, 1997, DWQ mailed notices to all animal waste management facilities who had not designated an operator with lhe DWQ. P.O. Based upon the above facts , I conclude as a matter of law that Michael Peterson violated or failed to act in accordance with the requirements ofN.C.G.S. 90 A-47.2 and 15A NCAC SF .0201. A civil penalty of not more than $1,000 per day may be assessed against a person who is required but fails to designate an appropriately certified wastewater treatment operator as required by N.C.G.S. 90 A-47.5 and 15A NCAC SF .0500. Based upon the above facts and conclusions of law, I hereby assess Michael Peterson a $~00.00 civil penalty for this violation of N.C .G .S. 90 A-47 .2 and 15A NCAC 8F .0201 pursuant to the authority delegated to me by N.C.G.S. 90 A-47.2 and 15A NCAC SF .0201. Annual soil tests are scron~iy encouraged so th.at all plant nutrients can be balanced for realistic :i.elds of the crop to be grown. Seve.:al factors are important in implementing your waste utilization plan in order to ma:x:imize the ferolizer value of the waste and to ensure that it is applied in m e.:rvironme::ually safe manner. System Calibration information presented in manufacturer's charts are based on average operation conditions with relatively new equipment. Discharge rates and application rates change over time ~s equipment gets older and components wear. In particular, pump wear tends to reduce operating pressure and flow. With continued use, nozzle wear results in an increase in the nozzle opening which will increase the discharge rate while decreasing the wetted diameter. You should be aware that operating the system differently than assumed in the design will alter the application rate, diameter of coverage, and subsequently the application uniformitY. For example, operating the system with excessive pressure results in smaller droplets, greater potential fur drift, and accelerates wear of the sprinkler nozzle. Clogging of nozzles can result in pressure increase. Plugged intakes or crystallization of mainlines will reduce operating pressure. Operating below design pressure greatly reduces the coverage diameter and application uniformitY. ,-:· For the above reason, you should calibrate your equipment on a regular basis to ensure proper application rates and uniformity. Calibration at least once every three years is recommended. Calibration involves collecting and measuring flow at several loca'lions in the application area. Any number of containers can be used to collect flow and determine the application rate. Rain gauges work best because they already have a graduated scale from which to read the application amount without having to perform additional calculations . However, pans, plasri c buckets, jars, or anything with a uniform opening and cross-section can be used provided the liql:Jid collected can be easily transferred to a scaled container for me2suring. For stationary sprinklers, collection containers should be located randomly throughout the application area at several distances from sprinklers. For traveling guns, sprinklers should be located along a transect perpendicular to the direction of pull. Set out collection containers 25 feet apart along the transect on both sides of the gun cart. You should compute the average application rate tor all non uniformity of the application. On a windless day, variation between containers of more than 30 percent is cause for concern. It is especially important ro manage levels so that you do not have problems during extended rainy and wet periods. Maximum storage capacity should be available in the lagoon for periods when the receiving crop is dormant (such as wintertime for berrnudagrass) or when there are extended rainy spells such as the thunderstonn season in the summertime. Tills means .that at the first signs of plant growth in the later winter/early spring, irrigation according-to a fann waste management plan should be done whenever the land is dry enough to receive lagoon liquid. This will make storage space available in the lagoon for furure wet periods. In the late summer/early fall the lagoon should be pumped down to the low marker (see Figure 2-1) to allow for winter storage. Every effon should be made to maintain the lagoon close to the minimum liquid level as -long as the weather and waste utili.zation plan will allow it Waiting until the lagoon has reached its maximum storage capacity before starting to iirigate does not leave room for storing excess water during extended wet periods. _ Overflow from the lagoon for any reason ~cept a 25-year, 24-hour storm is a violation of state law and subject to penalty action. ... The routine maintenance of a lagoon involves the following: Maintenance of 2. vegetative cove: for the dam . rescue or common b-ermudagrass are the most common vegetative covers. The vege:ation should be fe.rtiJiz.o..d each year, if·needed, to maintain a vigorous sr.and. The amount of fe:::tili.zer applied should be based on a soils test. but in the event that it is not practical to obtain a soils rest each year, the lagoon embankment and-surrounding areas should be fertilized \l..i.th 800 pounds pe:-acre of 10-10-10, or equivalent. Brush and trees on the embankment must be controlled . This may be done by mowing , spraying, grazing, chopping, or a combination of these practices. This should be done at least once a year and possibly twice in years that weather conditions are favorable for heavy vegetative growth. NOTE: IT vegetation is controlled by spraying, the he:bicide must not be allowed to enter the lagoon ware:. Such chemicals could harm the bacteria in the lagoon that are treating the waste. Maintenance inspections of the entire lagoon should be made during the initial filling of the lagoon and at least monthly and after ma1or rainfall and storm events. Items to be checked should include, as a minimum, the tollowing: Waste Inlet Pipes, Recycling Pipes, and Overr1ow Pipes-look for: 1. . separation ofjoinrs 2 . · cracks or breaks 3. accumulation of salts or minerals 4 . overall condition of pipes Lagoon surface-look for: 1. undesirable vegetative gro·wth 2 . floating or lodged debris Embankment-look for: 1. . settlement, craclcing, or "jug'' holes 2. side slope stability-slumps or bulges 3. wet or damp areas on the back slope 4 . erosion due to lack of vegetation or as a result of wave action 5 . rodent damage Larger lagoons may be subject to liner damage due to wave action caused by strong winds. These waves can erode the lagoon sidewalls, thereby weakening the lagoon dam. A good stand of vegetation will reduce the potential damage caused by wave action. If wave action causes serious damage to a lagoon sidewall, baft1es in the .lagoon may be used to reduce the wave impacts. Any of these features could lead to erosion and weakening of the dam: If your lagoon has any of these features, you should call an appropriate expert familiar with design and construction of waste lagoons. You may need to provide a temporary .fix if there is a threat of a waste discharge. However, a permanent solution should be reviewed by the technical ~ Any digging into a lagoon dam with heavy equipment is a serious undertaking with potenriall y serious consequences and should not be conducted unless recommended by an appropriate technical expert. T.ramfer Pumps-check for proper ope:ation of: 1. recycling pumps 2. inigation pumps Check for leaks, loose fittings, and ove..a.l.l pump operation. An unusually loud or gzinding noise, or a large amount of vibration, may indicate that the pump is in need or repair or replacement. NOTE: P.Jmping systems should be inspected and operated frequently enough so that you are not completely usurprised" by equipment failure. You should perform yourpumping system maintenance at a rime when your lagoon is at its low level. Tnis will allow some safety time should major repairs be required.· Having a nearly full lagoon is not. the time to think about switching, repairing , or borrowing pumps. Probably, if your lagoon is full, your neighbor's lagoon is full also. You should consider maintaining an inventory of spare parts or pumps. Surface water diversion features are designed to carry all surface drainage waters (such as rainfall runoff, roof drainage, gutter outlets , and parking lot runofr) away from your lagoon and other waste treatment or storage structures. The only water that should be coming from your lagoon is that which comes from your flushing (washing) system pipes and the rainfall that hits the lagoon directly. You should inspect your diversion system for the following: 1. adequate vegetation · 2. diversion capacity 3. ridge benn height Identified problems should be corrected prompt! y. It is advisable to inspect your syStem during or immediately following a heavy rain. If technical .assist3nce is needed to detc:mine proper solutions, consult with appropriate ape:·ts. You should record the level of the lagoon just prior to when rain is predicted, and then record the level ~oain 4 to 6 hours afu!r the :rain (assumes there is no pumping). Tlris will give you an idea of how much your lagoon level will rise with a certain rainfall amount (you must a1so be recording your rainfall for this to work). Knowing this should help in planning irrigation applications and storage. If your lagoon rises excessively, you may have an inflow problem from a suria.ce water dive::sion or there may be seepage into the lagoon from the surrounding land. Lagoon Opention Startup: 1. The contractor shall be responsible for the disposition of all debris to the satisfaction of the owner. The topsoil from the lagoon and pad area should be stripped and stockpiled for use on the dike and pad areas. After stripping, the foundation area of the lagoon embankment and building pad shall be thoroughly loosened prior to placing the first lift of fill material to get a good bond. EXCAVATION AND EARTHFILL PLACEMENT The· completed excavation and earthfill shall conform to the lines, grades, and elevations shown on the plans. Earthfill matenilt shall be free of material such as sod, roots, frozen soil, stones over 6 inches in diameter, and other objectionable material. To the extent they are suitable, excavated material may be used as fill. The fill shall be brought up in approximately horizontal layers not to exceed 9 inches in thickness when loose and prior to compaction. Each layer shall be compacted by complete coverage with the hauling and spreading equipment or standard tamping roller or equivalent method. Compaction shall be considered adequate when fill material is observed to consolidate to the point that settlement is not readily detectable. NOTE THE SPECIAL REQUIREMENTS FOR PLA.CEMENT OF LINERS IN THE LINER SECTION OF THIS SPECIFICATION. The embankment of the lagoon shall be installed using the more impervious materials from the required excavations . Construction of fill heights shall include 5 percent for settlement. Dikes over 15 feet in height with an impoundment capacity of 10 acre-feet or more fall under the jurisdiction of the NC Dam Safety Law and require permitting by the NC Dept. of Environment, Health and Natural Resources, Land Quality Section. The height is defined as the difference in elevation from the constructed height to the downstream toe of the dike. Precautions shall be taken during construction to prevent excessive erosion and sedimentation. LINER: A 40 mil HOPE liner shall be furnished and installed by the contractor in accordance with the liner manufacturers guidelines. CUTOFF TRENCH: A cutoff trench shall be constructed under the embankment area when called for in the notes on the drawings or as shown on a typical cross section on the drawings. VEGETATION: All exposed embankment and other bare constructed areas shall be seeded to the planned type of vegetation as soon as possible after construction according to the seeding specifications. Topsoil, if available on site shall be placed on areas of the dike and pad to be seeded. Temporary seeding or mulch shall be used if recommended permanent vegetation is out of season dates for seeding. Permanent vegetation shall be established as soon as possible during the next period of approved seeding dates. REMOVAL OF EXISTING TILE DRAINS: An observation trench shall be dug along the perimeter of the lagoon 25 feet outside the proposed embankment toe to verify that no subsurface drain tile Jines are present in the lagoon area. The trench shall be dug to a minimum depth of five feet and shall have a width adequate to accommodate equipment used for backfill and compaction . Trench side slopes shall be 1:1 or flatter. Trench backfill shall be compacted as stated in the EXCAVATION AND EARTHFILL PLACEMENT section of the specification. When tile drains are encountered, the tile will be removed to a minimum of 25 feet beyond the outside toe of slope of the dike . The tile trench shall be backfilled and compacted with material approved by the engineer or his representative. The time required for the planned fluid level (permanent and temporary storage) to be reached may vary due to site conditions, weather, flushing operations, and the amount of fresh water added to the system. The designed temporary storage consists of 180 days of temporary storage for: (1) manure production of animals, (2) excess fresh water storage, (3) rainfall in excess of evaporation , (4) storage for the 25 year I 24 hour stonn for the location, (5) and, if applicable, an additional "heavy rain" storage volume for chronic rainfall events. Allocation for any additional fresh water usage is also included in the temporary storage. The volume of waste generated from a given number of animals will be fairly constant throughout the._ year, but excess rainfall will vary from year to year. The 25 year rainfall will not be a faclor to consider in an annual pumping cycle , but this storage volume must always be available. A staff gauge must be installed in the lagoon that indicates the start pumping and stop pumping levels . The start pumping level is the maxium liquid level under normal operating conditions. The stop pumping level is the minimum liquid level under normal operation to maintain required treatment volume and depth. Pumping can be started and stopped anywhere between these two elevations for operating convenience as site conditions permit, such as weather, soils, crop, and equipment in order to apply waste without runoff or leaching. However, it is recommended that the lagoon be kept pumped down as much as possible. Land application of wastewater is recognized as an acceptable method of disposal. Methods of application include solid set, center pivot, guns , and traveling guns . Care should be taken when applying waste to prevent damage to crops. The following items are to be carried out: 1. It is required that the treatment lagoon be precharged to one-half the treatent volume or as otherwise specified on the lagoon design drawings before wastes are introduced. The purpose is to prevent excessive odors during start-up . ?recharging reduces the concentration of the initial waste entering the lagoon thereby reducing odors. Solids should be covered with effluent at all times. When precharging is complete, flush buildings with recycled lagoon liquid . Fresh water should not be used for flushing after initial filling . 2. The recommended maximum amount to apply per irrigation is one (1) inch and the recommended maximum application rate is 0 .3 inches per hour. Refer to the waste utilization plan for further details. · 5 . Keep vegetation on the embankment and areas adjacent to the lagoon mowed annually. Vegetation should be fertilized as needed to maintain a vigorous stand. 6. Repair any eroded or damaged areas and establish in vegetation . .. 7 . All surface runoff is to be diverted from the lagoon to stable outlets. 8. Keep a minimum of 25 feet of grass vegetated buffer around waste utilization fields adjacent to perennial streams. Waste will not be applied in open ditches. Do not pump within 200 feet of a residence or within 1 00 feet of a well. Waste shall be applied in a manner such that waste will not reach other property and public rights-of-way. 9. The: Clean Water Act of 19n prohibits the discharge of pollutants into waters of the United States. Waste shall not be discharged into surface waters , drainageways, or wetlands by either discharge or by over-spraying.
