You have our approval to place fill material in 0.75 acres of wetlands or waters for the purpose
of constructing a sewer line at Richardson Creek extension, as you described in your application dated
23 May 1995. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 2664. This certification allows you to use Nationwide Permit
Number 12 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification.
Antiseep collars shall be placed at no more than 150 foot intervals where the sewer line passes through
wetlands. In addition, you should get any other federal, state or local permits before you go ahead
with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

Enclosed is an application package for a nationwide permit for the referenced
project. The City is proposing to construct a parallel sewer interceptor to relieve
the hydraulic overloading on the existing pipe.
The construction of the pipe will involve seven (7) crossings through wetland
pockets. A total of 0.75 acres is expected to be excavated and backfilled to the
original conditions.
The project did have an Environmental Assessment completed and approved by
the Clearinghouse.

I am enclosing the final review comments from the Department
of Environment, Health, and Natural Resources regarding the
Environmental Assessment for the Richardson Creek Extension
Parallel Interceptor Sewer. The comments stress the importance of
utilizing best management practices to control erosion and
sedimentation during project construction. In addition,
clarification is provided regarding the width of the permanent
maintained sewerline easement.
The document is ready to be sent to the State Clearinghouse
for distribution to other state agencies. Please send eleven
copies to my attention. All of the project review correspondence
from our Department should be included in an appendix of the
documents we forward to the State Clearinghouse. For your
information, the next Clearinghouse submittal deadline is on
October 21, 1994.

SUBJECT: Revised Environmental Assessment for Richardson Creek
Extension Parallel Interceptor Sewer, Union County,
City of Monroe, North Carolina, Project NO. 637
Staff biologists with the North Carolina Wildlife Resources
Commission have completed review of the subject document. Our
comments are provided in accordance with certain provisions of
the Fish and Wildlife Coordination Act (48 Stat. 401, as amended;
16 U.S.C. 661-667d), Section 201 of the Clean Water Act of 1977
(as amended), and the North Carolina Environmental Policy Act
(G.S. 113A-1 et seq. as amended; 1 NCAC 25).
The revised environmental assessment has addressed the
concerns we had raised in our initial review of the document
(June 27, 1994), except corridor width. However, the new sewer
line is going to parallel the existing line which occupies a 30-
foot easement. I have discussed the project with Ms. Margaret
Grav of McKim & Creed., and understand that the permanent
maintained easement will be 30 feet total for both the existing
and new sewer line.
We concur with the EA based on the revisions and the
clarification on the permanent pipeline easement.

SUBJECT: Response to Comments -- Richardson Creek Interceptor,
City of Monroe
REFERENCE: 637
The Division remains concerned about the status of the rare
mollusks inhabiting Richardson Creek. In addition to the
Richardson Creek Interceptor, there is another sewer project _
proposed in this watershed (the Stewarts Creek Outfall), as well
as two major highway projects (widening of US 601 and
improvements to US 74). All of these projects can be expected to
produce significant amounts of siltation, which has been well
established as a major factor in the decline of freshwater mussel
populations throughout the country.
Our concerns regarding the Richardson Creek Interceptor, have,
however, been acknowledged. The stringent application of all
best management practices for the control of erosion and
siltation, as proposed, should greatly help reduce the potential
impacts of this project.
