The purpose of this letter is to request Nationwide Permits 12,14 and tzfi a
Section 401 Water Quality Certification for the project known as Give r?1*, ''The:
project, owned by Fortis Homes, is located near Apex, NC (Wake County) and is
bordered by NCSR 1613 on the western boundary as shown on the enclosed
plans, and Cary, N.C., USGS Topo Quads vicinity map.
The wetland delineation has been approved by Ms. Ohlberg of the U.S. Army
Corps of Engineers, a copy of the signed delineation map is available upon
request.
Fill in wetlands will be required to construct private residences, roads and utility
lines as part of the infrastructure of a residential development.
It will be necessary to impact 0.44 acres (see map) of jurisdictional wetlands
above headwaters for placement of some of the proposed roadways and utility
lines. Prior to S&EC involvement in this project 0.33 acres of wetlands, an old
farm pond, was impacted for building lots; these activities were not permitted
by the COE. S&EC has accounted for the preexisting impact in this permit
application. A total of 0.36 acres will be filled for the placement of lots and other
structures under Nationwide 26; this total includes preexisting impacts. A tow
of 0.03 acres (see map) will be filled for road crossings under Nationwide Permit
14. The road crossings is perpendicular to wetland alignments, in order to
minimize impacts. Utility line impacts 0.05 acres of wetlands.
To expedite the permitting process the following individuals/agencies have
been provided with a complete copy of this entire application package: U.S. Fish
and Wildlife Service, National Marine Fisheries, N.C. Cultural Resources, Danny
Smith (DEM) and David Franklin (Wilmington Corps).

You have our approval to place fill material in 0.44 additioruill acres of wetlands or waters for the
purpose of constructing a residential subdivision at SR 1613, as y? u described in your application
dated 27 March 1995. After reviewing your application, we have _ecided that this fill is covered by
General Water Quality Certification Numbers 2664, 2732 and 26"i. These certifications allow you to
use Nationwide Permit Numbers 12, 14 and 26 when it is issued ty the Corps of Engineers.
This approval is only valid for the purpose and design that -,,c,u described in your application. If
you change your project, you must notify us and you may be regL_red to send us a new application.
For this approval to be valid, you must follow the conditions listen in the attached certification. In
addition, you should get any other federal, state or local permits tefore you go ahead with your
project.
If you do not accept any of the conditions of this certificatio. you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the No;-th Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C.. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmi2ntal Management under Section 401
