This application is filed by Pulte Homes and Westminister Homes on behalf of the property owners listed on the attached agent authorization forms. An application dated November 14,1996 was moving toward denial; we submit this permit in its place. Please copy all individual lots owners with your response. The attached maps show the progression of the wetland conditions for the proposed impact area. Map 1 shows the current requested activity; filling portions of wetlands shown on the map and stabilizing overland flow channels with Geotextile fabric for stabilization. Map 2 shows the original impact plan which was subsequently revised after it was determined that the on-site pond needed to be breached. Ih ?.I,',II ENVIRONMENTAL SCIENCES March 11, 1997 The current proposed activity is at the request of property owners within Bailey Farms. The wetland area has been identified by landowners as an "attractive nuisance", an "eye-sore" and a "health issue". Overall, in the opinion of the landowners, the wetlands represent a hazard to their children and personal property. The Bailey Farms project was linked to the Walden Creek Subdivision by the USACOE. This determination was made because of common land ownership and common land boundaries under the subdivision-division rule. This application is made with this knowledge in mind. The wetlands that are proposed to be filled are associated with a drained pond bottom and a recently installed utility line. Both areas are currently trapping sediment and have naturalized to some extent. The sediment that is remaining in the pond bottom represents the largest hazard to children in the subdivision. The table below shows all proposed impacts. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Wetland mitigation is required for this fill since total wetland fill for this subdivision exceeds one acre. According to our regulations (15A NCAC 2H .0506(h)) a total of 0.4 acres of wetland restoration or 0.6 acres of wetland creation will be required. This can be done by a contribution to the Wetlands Restoration Program of $9,600 ($24,000/acre 0.4 acres) or development of a mitigation plan for 0.4 acres of restoration or 0.6 acres of creation. DWO shall be notified in writing of which option you have selected by 15 May 1997. If this information is not received by DWQ by 15 May 1997, this Certification is not valid and wetland fill may = occur. Based on this review, we have identified significant uses which would be removed by this project. These uses are water storage, pollutant removal and downstream strearnbank stabilization. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Prior approval of approximately 3.59 acres of wetland impact has already been issued at this site and the Walden Creek project (which the COE has linked to Bailey Farms). The primary reason for requesting the additional impacts is based on homeowners concerns about "eyesore nuisances" as well as "health" and "safety" issues. Specifically, the homeowners cited the accumulating sediment in and around the area of the breached pond as a safety hazard to children. Based on the site visit, it is the opinion of the RRO that the request for fill of an additional .31 acres of wetlands be denied. The "hazard" of the accumulated sediment seems very small. Both myself and Pete walked across the sediment accumulation with no sinking despite the very wet conditions. Further, the function and opportunity of the wetlands in question are significant and should not be removed due to "eyesore nuisances" or to seemingly nonexistent health and safety issues. The Bailey Farms project has received two C (2/10/95 and 2/20/96) 401 water quality certifications authorizing a total of 1.07 acres of wetland impact and requiring that deed restrictions be put on all remaining jurisdictional wetlands to prevent future fill. Our monitoring inspection found that unauthorized fill had been placed in wetlands behind lots 136 and 137 and that wetland elevations along some portions of the sewer line have not been restored to the original grade. We also found some erosion control problems that have allowed sediment to enter wetland areas and the stream channel. Of particular concern is the large road crossing and lot fill around lots 110, 111, 51, and 52. Fill on lot 110 is eroding into the stream. Below the road crossing a sediment basin with a large rock check dam has been placed in the creek channel and across the floodplain without authorization under your 401 water quality certification. Please respond within 10 days to address these concerns. Failure to respond or get proper authorization for these impacts may result in a Notice of Violation being issued to you. The Division would also like have a copy of the deed restriction that is to be placed on the remaining jurisdictional wetlands. Also, in order to address cumulative impacts on the project, any future impacts will likely require compensatory mitigation to offset wetland impacts. The Bailey Farms project has received two C (2/10/95 and 2/20/96) 401 water quality certifications authorizing a total of 1.07 acres of wetland impact and requiring that deed restrictions be put on all remaining jurisdictional wetlands to prevent future fill. Our monitoring inspection found that unauthorized fill had been placed in wetlands behind lots 136 and 137 and that wetland elevations along some portions of the sewer line have not been restored to the original grade. We also found some erosion control problems that have allowed sediment to enter wetland areas and the stream channel. Of particular concern is the large road crossing and lot fill around lots 110, 111, 51, and 52. Fill on lot 110 is eroding into the stream. Below the road crossing a sediment basin with a large rock check dam has been placed in the creek channel and across the floodplain without authorization under your 401 water quality certification. Please respond within 10 days to address these concerns. Failure to respond or get proper authorization for these impacts may result in a Notice of Violation being issued to you. The Division would also like have a copy of the deed restriction that is to he placed on the remaining jurisdictional wetlands. Also, in order to address cumulative impacts on the project, any future impacts will likely require compensatory mitigation to offset wetland impacts. This application is filed by Pulte Homes and Westminster Homes on behalf of the property owners listed on the attached agent authorization forms. Please copy all individual lot owners with your response. The attached maps show the progression of the wetland conditions for the proposed impact area. Map 1 show the current requested activity; filling the balance of wetlands shown on the map. Map 2 show the original impact plan which was subsequently revised after it was determined that the on-site pond needed to be breached. The current proposed activity removes all wetlands that were previously located at the top of a drain. The current proposed activity is at the request of property owners within Bailey Farms. The wetland area has been identified by landowners as an "attractive nuisance", an "eye-sore", and a "health issue". Overall, in the opinion of the landowners, the wetlands represent a hazard to their children and personal property. The Bailey Farms project was linked to the Walden Creek Subdivision by the USACOE. This determination was made because of common land ownership and common land boundaries under the subdivision-division rule. This application is made with this knowledge in mind. The Walden Creek portion of the project has a total of 2.52 acres of impacts to wetlands; 0.34 acres are under NW 26. Total impacts for both projects will be 3.90 acres if all impacts are approved.
