The purpose of this letter is to request additional wetland impacts under
Nationwide Permit 18 and Nationwide Permit 13 and a Section 401 Water
Quality Certification for the project to be known as Bailey Farms Subdivision.
This application is filed by Pulte Homes and Westminister Homes on behalf of
the property owners listed on the attached agent authorization forms. An
application dated November 14,1996 was moving toward denial; we submit this
permit in its place. Please copy all individual lots owners with your response.
The attached maps show the progression of the wetland conditions for the
proposed impact area. Map 1 shows the current requested activity; filling
portions of wetlands shown on the map and stabilizing overland flow channels
with Geotextile fabric for stabilization. Map 2 shows the original impact plan
which was subsequently revised after it was determined that the on-site pond
needed to be breached. The current proposed activity removes some wetlands
that were previously located at the top of a drain and replaces some areas with
broad based wetland swales.

The current proposed activity is at the request of property owners within Bailey
Farms. The wetland area has been identified by landowners as an "attractive
nuisance", an "eye-sore" and a "health issue". Overall, in the opinion of the
landowners, the wetlands represent a hazard to their children and personal
property.
The Bailey Farms project was linked to the Walden Creek Subdivision by the
USACOE. This determination was made because of common land ownership
and common land boundaries under the subdivision-division rule. This
application is made with this knowledge in mind.
The wetlands that are proposed to be filled are associated with a drained pond
bottom and a recently installed utility line. Both areas are currently trapping
sediment and have naturalized to some extent. The sediment that is remaining
in the pond bottom represents the largest hazard to children in the subdivision.
The table below shows all proposed impacts.

Dear Mr. Huysman:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in 0.1 acres of wetlands or waters for the purpose of improving drainage in a drained pond bottom at
Bailey Farms subdivision near lots 152-156, as you described in your application dated 11 March 1997. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Numbers 3103 and 3106. These certifications allow you to use Nationwide Permit Numbers 18 and 13 when
they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). For this approval to be
valid, you must follow the conditions listed in the attached certification and any additional conditions listed
below. Wetland mitigation is required for this fill since total wetland fill for this subdivision exceeds one
acre. According to our regulations (15A NCAC 2H .0506(h)) a total of 0.4 acres of wetland restoration or 0.6
acres of wetland creation will be required. This can be done by a contribution to the Wetlands Restoration
Program of $9,600 ($24,000/acre 0.4 acres) or development of a mitigation plan for 0.4 acres of restoration or
0.6 acres of creation. DWO shall be notified in writing of which option you have selected by 15 May 1997.
If this information is not received by DWQ by 15 May 1997, this Certification is not valid and wetland fill
may = occur. Wetland fill shall not occur until written DWQ approval is received for the mitigation plan.
In addition, you should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water
Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit
expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of

On January 6, 1997, 1 made a visit to the potential violation areas you identified within this
subdivision. I concur with your findings and have discussed corrective measures with my client.
We believe that these areas can be easily brought into compliance with the issued permits.
No corrective actions requiring the disturbance of vegetated soils will be undertaken until the
spring to ensure that the areas can re-vegetate successfully. Sediment fencing will be installed
immediately upon approval of the concepts outlined in this letter.
Utility Easements
Easements will be staked in the field and excess soils will be removed to highground utilizing a
bobcat or other similar equipment. Disturbed areas will be seeded with a mixture similar to shown
on the attached seeding specifications. All minor grading will be supervised by S&EC, Inc.

Small areas of non-permitted fill may occur on these lots. We propose "restore" these areas
concurrently with the utility easement located behind the lots. We furthermore propose to utilize
the same treatment methods.

Sediment Basin
The basin and it's check dam are located over jurisdictional channels only. The channel and banks

1. Surface water control measures to be installed according to plan.

The Division of Water Quality has reviewed your plans for the discharge of fill material into an additional
0.31 acres of waters and/or wetlands located at Bailey Farms subdivision in Wake County for removal of
wetlands adjacatt to existing lots. Based on this review, we have identified significant uses which would be
removed by this project. These uses are water storage, pollutant removal and downstream strearnbank
stabilization. Furthermore, insufficient evidence is present in our files to conclude that your project must be
built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, we are moving
toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e). Until we receive additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project
on administrative hold.
Please provide us with information supporting your position that your project must be constructed as
planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically
our previous approval dated 20 February 1996 required deed restrictions on all remaining wetlands to prevent
future wetland fill. You will need to address this issue in any response to this letter. Any documentation such
as maps and narrative that you can supply to address alternative designs for your project may be helpful in our
review of your 401 Certification. Also this project will require compensatory mitigation as described in 15A
NCAC 2H .0506(h). Your mitigation proposal is insufficient because note is proposed. If any additional fill is
authorized, a restoration/creation ratio of 1:1 will be required ou site since previous impacts have been greater
than one acre. It may be possible to expand existing wetlands along this channel farther downstream. However
a detailed mitigation plan with five years of monitoring and pcrrnancnt casement will need to be provided to
ensure adequate mitigation. Please respond within two weeks of the date of this letter by sending a copy of this
information to me and one copy to Mr. Eric Fleck at the Ralcigh Regional Office at 3800 Barrett Drive,
Raleigh, NC 27609. If we do not hear from you in two weeks, we will assume that you no longer want to
pursue this project and we will consider the project as withdrawn. I can be reached at 919-733-1786 if you have

On November 27, 1996 Eric Fleek and Pete Colwell visited the
aforementioned project in order to assess the need to impact an
additional .31 acres of wetlands (under NW 26) at this site. Prior
approval of approximately 3.59 acres of wetland impact has already
been issued at this site and the Walden Creek project (which the
COE has linked to Bailey Farms). The primary reason for requesting
the additional impacts is based on homeowners concerns about
"eyesore nuisances" as well as "health" and "safety" issues.
Specifically, the homeowners cited the accumulating sediment in and
around the area of the breached pond as a safety hazard to
children.
Based on the site visit, it is the opinion of the RRO that the
request for fill of an additional .31 acres of wetlands be denied.
The "hazard" of the accumulated sediment seems very small. Both
myself and Pete walked across the sediment accumulation with no
sinking despite the very wet conditions. Further, the function and
opportunity of the wetlands in question are significant and should
not be removed due to "eyesore nuisances" or to seemingly
nonexistent health and safety issues.

Dear Michaels:
On November 27, 1996 Mr. Eric Fleek and myself made a compliance monitoring
site visit to Bailey Farms / Walden Creek Subdivision off NC 55 near Apex in Wake
County. The Bailey Farms project has received two C (2/10/95 and 2/20/96) 401 water
quality certifications authorizing a total of 1.07 acres of wetland impact and requiring that
deed restrictions be put on all remaining jurisdictional wetlands to prevent future fill.
Our monitoring inspection found that unauthorized fill had been placed in
wetlands behind lots 136 and 137 and that wetland elevations along some portions of the
sewer line have not been restored to the original grade. We also found some erosion
control problems that have allowed sediment to enter wetland areas and the stream
channel. Of particular concern is the large road crossing and lot fill around lots 110, 111,
51, and 52. Fill on lot 110 is eroding into the stream. Below the road crossing a
sediment basin with a large rock check dam has been placed in the creek channel and
across the floodplain without authorization under your 401 water quality certification.
Please respond within 10 days to address these concerns. Failure to respond or
get proper authorization for these impacts may result in a Notice of Violation being
issued to you. The Division would also like have a copy of the deed restriction that is to
be placed on the remaining jurisdictional wetlands. Also, in order to address cumulative
impacts on the project, any future impacts will likely require compensatory mitigation to

fill is covered by General Water Quality Certification Numbers 3022, 2732 and 2671. These
certifications allow you to use Nationwide Permit Numbers 12, 14 and 26 when they are issued by the
Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you

On November 27, 1996 Mr. Eric Fleek and myself made a compliance monitoring
site visit to Bailey Farms / Walden Creek Subdivision off NC 55 near Apex in Wake
County. The Bailey Farms project has received two C (2/10/95 and 2/20/96) 401 water
quality certifications authorizing a total of 1.07 acres of wetland impact and requiring that
deed restrictions be put on all remaining jurisdictional wetlands to prevent future fill.
Our monitoring inspection found that unauthorized fill had been placed in
wetlands behind lots 136 and 137 and that wetland elevations along some portions of the
sewer line have not been restored to the original grade. We also found some erosion
control problems that have allowed sediment to enter wetland areas and the stream
channel. Of particular concern is the large road crossing and lot fill around lots 110, 111,
51, and 52. Fill on lot 110 is eroding into the stream. Below the road crossing a
sediment basin with a large rock check dam has been placed in the creek channel and
across the floodplain without authorization under your 401 water quality certification.
Please respond within 10 days to address these concerns. Failure to respond or
get proper authorization for these impacts may result in a Notice of Violation being
issued to you. The Division would also like have a copy of the deed restriction that is to
he placed on the remaining jurisdictional wetlands. Also, in order to address cumulative
impacts on the project, any future impacts will likely require compensatory mitigation to
offset wetland impacts. If you have any questions concerning this matter please contact

The purpose of this letter is to request additional wetland impacts under Nationwide Permit 26 and
a Section 401 Water Quality Certification for the project known as Bailey Farms Subdivision.
This application is filed by Pulte Homes and Westminster Homes on behalf of the property owners
listed on the attached agent authorization forms. Please copy all individual lot owners with your
response.
The attached maps show the progression of the wetland conditions for the proposed impact area.
Map 1 show the current requested activity; filling the balance of wetlands shown on the map. Map
2 show the original impact plan which was subsequently revised after it was determined that the
on-site pond needed to be breached. The current proposed activity removes all wetlands that were
previously located at the top of a drain.
The current proposed activity is at the request of property owners within Bailey Farms. The
wetland area has been identified by landowners as an "attractive nuisance", an "eye-sore", and a
"health issue". Overall, in the opinion of the landowners, the wetlands represent a hazard to their
children and personal property.
The Bailey Farms project was linked to the Walden Creek Subdivision by the USACOE. This
determination was made because of common land ownership and common land boundaries under
the subdivision-division rule. This application is made with this knowledge in mind. The Walden
Creek portion of the project has a total of 2.52 acres of impacts to wetlands; 0.34 acres are under
NW 26. Total impacts for both projects will be 3.90 acres if all impacts are approved.

The wetlands that are proposed to be filled are associated with a drained pond bottom and a
recently installed utility line. Both areas are currently trapping sediment and have naturalized to

The purpose of this letter is to request revisions to an existing application for
Nationwide Permits 12, 14, and 26 and Section 401 Water Quality Certification
for the project known Bailey Farms Subdivision. A revised application dated
December 5, 1996 was moving toward a denial by the state for the 401
Certification. This application replaces the December 5, 1996 application and
supports our position for necessary fill activities.
Our client has reduced impacts on this project by 0.23 acres under Nationwide
26. Please compare the prior application map with the enclosed impact map.
Reductions were accomplished by redesigning cul de sacs and manipulating
property lines. The attached map shows a substantial reduction to wetland
impacts in the vicinity of lots 226 and 227, the developer must impact an isolated
portion of this system to maintain the number of lots. This wetland will continue
its function to store and filter water from the roads and lots 231 and 232.
Furhermore, impacts for lots 116 and 117 were reduced by shortening the cul de
sacs, impacts were needed to maintain these lots. Lots 214, 215 and 216 were
redesigned and resulted with further reductions in impacts to wetlands.

The purpose of this letter is to request revisions to an existing application for
Nationwide Permits 12, 14, and 26 and Section 401 Water Quality Certification
for the project known Bailey Farms Subdivision. A revised application dated
December 5, 1996 was moving toward a denial by the state for the 401
Certification. This application replaces the December 5, 1996 application and
supports our position for necessary fill activities.
Our client has reduced Impacts on this project by 0.23 acres under Nationwide
26. Please compare the prior application map with the enclosed impact map.
Reductions were accomplished by redesigning cul de sacs and manipulating
property lines. The attached map shows a substantial reduction to wetland
impacts in the vicinity of lots 226 and 227, the developer must impact an isolated
portion of this system to maintain the number of lots. This wetland will continue
its function to store and filter water from the roads and lots 231 and 232.
Furhermore, impacts for lots 116 and 117 were reduced by shortening the cul de
sacs, impacts were needed to maintain these lots, Lots 214, 215 and 216 were
redesigned and resulted with further reductions in impacts to wetlands.

The Division of Environmental Management, Water Quality Section has reviewed your plans for the
discharge of till material into an additional 0.75 acres of waters and/or wetlands (0.52 acres of rill
previously approved) located at Bailey farms development in Wake county for residential development.
Based on this review, we have identified significant uses which would be removed by this project. These
uses are water storage, streambank stabilization pollutant. removal and wildlife habitat.. Furthermore,
insufficient evidence is present. in our files to conclude that your project must be built. as planned in waters
and/or wetlands. Therefore, we are moving toward denial of your 401 Certification as required by 15A
NCAC 2B.0109. Until we, receive additional information, we are requesting (by copy of this letter) that
the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management. place your project.
on administrative hold.
Please provide us wA information supporting your position that. your project. must be constructed as
planned and that. you have no practicable alternative to placing till in these waters and/or wetlands.
Specifically can you construct. your residential development without. fills at lots 116, 117, 227, 226, 214
and 215? If stormwater from the street and lots near lots 231 mid 232 is directed to flow into the unfilled
wetland at lot 227 and 226, we would have no objection to this fill of 0.08 acres. In addition, deed
restrictions will be required on all wetlands with remaining jurisdictional wetlands to prevent future fill.
Any documentation such as maps and narrative that you caul supply to address alternative designs for
your project may be helpful in our review of your 401 Certification. Please respond within two weeks of'
the date of this letter by sending a copy of this information to me and one copy to Mr. Eric Fleck at (lie

The purpose of this letter is to request Nationwide Permits 12, atl; ' i
Section 401 Water Quality Certification for the initial phase of a project to be
known as Bailey Farms. The project is located near Apex, NC (Wake County)
and is bordered by NC 55 on the western boundary and NC SR 1601 on the
northern boundary as shown on the enclosed plans, and New Hill and Green
Level N.C., USGS Topo Quads vicinity map.
The delineations of impact areas have been approved by Ms. Ohlberg of the U.S.
Army Corps of Engineers (See attached Notification of Jurisdictional
Determination).
Fill in the wetlands will be required to construct private residences, roads and
utility lines.
It will be necessary to impact 0.52 acres (see map) of jurisdictional wetlands
above headwaters for placement of some of the proposed roadways, driveways,
utility lines and lots utilizing Nationwide Permits 12,14 and 26. A total of 0.02
acres (see map) will be filled for road crossings under Nationwide Permit 14.
Road crossings are perpendicular to wetland alignments, in order to minimize
impacts. Utility line impacts total 0.31 acres. A total of 0.19 acres will be filled
for the placement of lots under Nationwide 26.
We realize that notification for impacts less than 1/3 acre under Nationwide 26
are not required but we are doing so as a professional courtesy.
To expedite the permitting process and to make "life easier" on everyone
involved, the following individuals/agencies have been provided with a
complete copy of this entire application package: U.S. Fish and Wildlife Service,
National Marine Fisheries, N.C. Cultural Resources, Danny Smith (DEM) and
David Franklin (Wilmington Corps).
