The Aubrey Moore Farm was originally registered as a farrow to feeder swine farm (39,150 lbs. SSLW) in 1993 and removed from registration in 1996. The farm has been inactive since at least 1995. The aforementioned application received on April 24, 2007 proposed to reconfigure the facility to a wean to feeder swine farm at a SSLW of 90,000 lbs. which is far in excess of the original registration SSLW of 39,150 lbs. In a letter dated August 22, 2007, the Division of Water Quality (Division) expressed concern that that the original/existing waste management system, registered in 1993, was not designed to accommodate the proposed animal population of 90,000 pounds SSLW. At the time of the application review, North Carolina was under a moratorium on the construction or expansion of swine facilities. A permit for the proposed animal waste management could not be issued by the Division unless there was a valid exception to the moratorium. In the letter dated August 22, 2007, the Division requested you to submit documentation and/or information that established eligibility for the exemption to the Moratoria on Construction or Expansion of Swine Farms (House Bill 515, Part I). Civil penalties of up to $25,000 per day per violation may be assessed for failure to secure a proper _permit required by North Carolina General Statute § 143-215.1.
