After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ab.ead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: Applicant proposes to construct an approximately 950 foot bulkhead along property that borders the AIWW and to stabilize a backwater boat ramp area by placement of riprap along the slope adjacent to the ramps. t c Page 2 Raymond Hughes 9. PROTECT DESCRIPTION The applicant owns a 26 acre tract on which he actually proposes two different developments which will be referred to as Site A and Site B. SITE A The property is located at the end of SR 1582 near Washington Acres in Pender County near Hampstead. It is adjacent to the AIWW and south of the mouth of Mill Creek. The waters adjacent to the property are classified as SA waters. They are also classified as Outstanding Resource Waters which are open to shellfishing but are not designated as a primary nursery area. The applicant proposes to construct an approximately 950 ft bulkhead parallel to the AIWW along a moderately steep grade bank (2-8 ft) which has undergone considerable erosion over the years. A fact which is evidenced by the presence of a w4 which_was once located on the highground but is now located approximately 35 ft waterward of the escarpment. The applicant plans to grade the higher portions of the steep bank and utilize the dirt as backfill for the proposed bulkhead. The proposed bulkhead alignment is landward of all vegetated wetlands but will be waterward of Mean High Water in several spots. In no case should the alignment extend more than 5 feet waterward of Mean High Water. The applicant also proposes to utilize pre-poured 4 X 10 ft. concrete slabs lying end to end along the toe of the bulkhead to help increase the stability of the bulkhead. These slabs are to be placed at or landward of the staked line established by the permit. So, in essence, the concrete slabs will lie landward of the staked alignment and the bulkhead will be aligned landward of the concrete slabs. SITE B The property is located off SR 1603 in the Washington Acres subdivision in Pender County near Hampstead. It is adjacent to the lower portions of Mill Creek which is classified as SA waters and is closed to the taking of shellfish. Mill Creek is not designated as a primary nursery area, but the waters in the project are also classified as Outstanding Resource Waters. The property serves as a boat launching facility with two boat ramps which are utilized by the property owners within the Washington Acres subdivision. The Division of Marine Fisheries also utilizes the site to dock their barges and for the stockpiling of shell cultch. The applicant proposes to stabilize the boat ramps by pulling back the unvegetated bank on both sides and between the boat ramps to a slope of 1:1 and placing stones (riprap) just below Mean High Water up to the top of the slope. The southernmost boat ramp is flanked on its south side by an approximately 8 X 4 ft stand of Spartina al iniflora at its waterward end. However, the applicant proposes no placement of riprap waterward of any coastal vegetation. Page 3 Raymond Hughes 10. ANTICIPATED EMPACTS The construction of the proposed bulkhead will incorporate approximately 4750 sq. ft. of nonvegetated sandy bottom and will likely improve the erosion problem that the applicant is now facing. Although most of the backfill is expected to be obtained from the grading activities, the applicant anticipates the bulkhead related project will require approximately 45 additional cubic yards of backfill material which will all be placed below mean high water. Placement of the riprap at the boat ramps will not incorporate any vegetated wetlands and should help stabilize the adjacent shorelines. Submitted by: Jerry A. Page 2 Raymond Hughes 9. PROJECT DESCRIPTION The applicant owns a 26 acre tract on which he actually proposes two different developments which be referred to as Site A and Site B. SITE A The property is located at the end of SR 1582 near Washington Acres in Pender County r Hampstead. It is adjacent to the AIWW and south of the mouth of Mill Creek. The waters adjac to the property are classified as SA waters. They are also classified as Outstanding Resource Wa which are open to shellfishing but are not designated as a primary nursery area. The applicant proposes to construct an approximately 950 ft bulkhead parallel to the AIWW alor moderately steep grade bank (2-8 ft) which has undergone considerable erosion over the years. A which is evidenced by the presence of a well which was once located on the highground but is i located approximately 35 ft waterward of the escarpment. The applicant plans to grade the hig portions of the steep bank and utilize the dirt as backfill for the proposed bulkhead. The proposed bulkhead alignment is landward of all vegetated wetlands but will be waterward of M High Water in several spots. In no case should the alignment extend more than 5 feet waterwarc Mean High Water. The applicant also proposes to utilize pre-poured 4 X 10 ft. concrete slabs lying end to end along toe of the bulkhead to help increase the stability of the bulkhead. These slabs are to be placed a landward of the staked line established by the permit. So, in essence, the concrete slabs will landward of the staked alignment and the bulkhead will be aligned landward of the concrete slabs SITE B The property is located off SR 1603 in the Washington Acres subdivision in Pender County r Hampstead. It is adjacent to the lower portions of Mill Creek which is classified as SA waters an closed to the taking of shellfish. Mill Creek is not designated as a primary nursery area, but the wa in the project are also classified as Outstanding Resource Waters. The property serves as a boat launching facility with two boat ramps which are utilized by the prop owners within the Washington Acres subdivision. The Division of Marine Fisheries also utilizes site to dock their barges and for the stockpiling of shell cultch. The applicant proposes to stabilize the boat ramps by pulling back the unvegetated bank on both si and between the boat ramps to a slope of 1:1 and placing stones (riprap) just below Mean High W up to the top of the slope. The southernmost boat ramp is flanked on its south side by an approxima 8 X 4 ft stand of Squfm gltiniflora at its waterward end. However, the applicant proposes placement of riprap waterward of any coastal vegetation. Page' 3' Raymond Hughes 10. A N CTEATED PACTS The construction of the proposed bulkhead will incorporate approximately 4750 sq. ft. of nonvegetated sandy bottom and will likely improve the erosion problem that the applicant is now facing. Although most of the backfill is expected to be obtained from the grading activities, the applicant anticipates the bulkhead related project will require approximately 45 additional cubic yards of backfill material which will all be placed below mean high water. Placement of the riprap at the boat ramps will not incorporate any vegetated wetlands and should help stabilize the adjacent shorelines. Hughes of Hampstead is requesting the approval of a Special Use Permit for the construction of a 14 slip marina, bulkhead and shoreline stabilization work on his property at the end of Washington. Acres road. Mr. Hughes intends to operate a commercial slip-leasing marina with no other marine services provided. There will be no fuel service, boat painting or maintenance service. Lease contract language will assure that the marina's closed head policy will be enforced. A pump out station for holding tanks will be available on the dock for patron usage. No live-aboards or overnight dockage will be allowed. The existing deep water cove will require no dredging for dock construction. A raised wooden boardwalk will provide access from the shell/grass parking area directly to the floating dock. The state shellfish barge mooring and stockpile area, which Mr. Hughes allows the state to use, will not be impeded by this project. The proposed low-profile bulkhead along the Intracoastal Waterway is intended to stop the erosion along this side of Mr. Hughes' property. He has experienced significant loss of soil and property resulting in dangerous high bluffs which erode into and over the stands of Spartina Alterniflora marsh along the-waterway. His proposed bulkhead will be landward of the marsh and will prevent further sedimentation into this area. Mr. Hughes also proposed to place rip rap along approximately 100' of eroding shoreline on either side of an existing boat ramp. This will again resolve a dangerous condition and prevent loss of property. No marsh areas will be disturbed here. A CAMA Major Permit Application is being submitted simultaneously with this Special Use Permit request. A thorough review of the proposed activities will be conducted by state and federal Pender County Planning Department Page 2 agencies.
