Sherrod 2316 Tartinger's Quay Virginia Beach, VA 23456 Dear Mr. Sherrod: FILE copv You have our approval to place fill material in 0.08 acres of wetlands or waters for the purpose of constructing a bulkhead and dock at Lot H56 Snug Harbor Subdivision near Hertford, as you described in your application dated 22 September, 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: Applicant proposes to construct 290 ft. of wooden bulkhead an average distance of 5 feet waterward of the NWL and backfill of non-coastal wetlands and public trust area.. Sherrod Bio Report Page Two Site Description The applicant owns a 1/2 acre lot in the Snug Harbor Subdivision located in Perquimans County off of SR 1340. Adjacent lots are developed with single family houses, most with direct water access. The applicant's lot is situated with a man-made canal on the south and the Yeopim River on the east. The lot elevation varies from 6 feet along the northern side to less than 1 foot beside the canal. The applicant is building a house and already has the septic field in operation. The lot is moderately wooded with sweet gum (Liquidambar styraciflua) and loblolly pine Pinus taeda) being the predominant species. The undergrowth consists of yard grass and is mowed. The applicant has constructed a steel retaining wall along the south side of the house, separating the upland area from the shoreline wetlands. The dimensions are approximately 100' x 2' and the apparent purpose of this upland bulkhead is to prevent sediment from land disturbance and fill activities associated with house construction from eroding into the canal. Soils vary from sandy loam to organic and two areas (northeast corner and southern side along the canal to southeastern corner) appear to be non-coastal wetlands. Submerged aquatic vegetation consisting of Eurasian milfoil exist in sparse beds in the canal. Waters of the Yeopim River are classified as SC by the NC Division of Environmental Management. The applicant estimates annual erosion to be 2'. Development Proposal In order to protect his shoreline and his house, the applicant is proposing to construct 290 feet of wooden bulkheading an average distance of 5 feet waterward of the normal water line with a maximum distance of 111/2 feet. The applicant proposes to construct the bulkhead and then backfill 1447 sq. ft. of Public Trust Area and 3345 sq. ft. of non-coastal wetlands to an elevation of 3 feet. The applicant further proposes to construct a 24' x 14' wooden dock on the canal and adjacent to his proposed bulkhead. Anticipated Impacts Approximately 3345 sq. ft. of non-coastal wetlands will be filled and 1447 sq. ft. of Public Trust Area will be filled. Three hundred thirty-six sq. ft. of Public Trust will be shaded by the proposed dock. Increased turbidity will occur during construction. No submerged aquatic vegetation should be impacted by the project. CAMA Review The Perquimans County Land Use Plan places all of the estuarine shoreline and estuarine waters in the conservation class. A complete review and consistency determination with the Perquimans County Land Use Plan will be submitted under separate cover. Submitted by: Frank A. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the Revised 03/95 Form DCM-MP-1 site. Include highway or secondary road (SR) numbers, landmarks, and the like. • A Stormwater Certification, if one is necessary. • A list of the names and complete addresses of the adjacent waterfront (riparian) landowners and signed return receipts as proof that such owners have received a copy of the application and plats by certified mail. BOX 1890 WILMINGTON, NORTH CAROLINA 28402-1890 October 20, 1995 Regulatory Branch Action ID No. 199505584 Mr. John Parker Division of Coastal Management North Carolina Department of Environment, Health, and Natural Resources Post Office Box 27687 Raleigh, North Carolina 27611-7687 Dear Mr. Parker: Reference the application of Mr. James Sherrod for a Department of the Army (DA) permit to construct a bulkhead and dock on his property, identified as Lot H56, Snug Harbor Subdivision, located off State Road 1340, adjacent the Yeopim River, Hertford, Perquimans County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the permit plans. 2. The bulkhead will not be positioned farther waterward than 11.5 feet from the normal water level (NWL) elevation contour at any point along its alignment. 3. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. 4. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters outside of the permitted areas. 5. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 6. The fill material will be clean and free of any pollutants except in trace quantities. Sherrod Bio Report Page Two Site Description The applicant owns a 1/2 acre lot in the Snug Harbor Subdivision located in Perquimans County off of SR 1340. Adjacent lots are developed with single family houses, most with direct water access. The applicant's lot is situated with a man-made canal on the south and the Yeopim River on the east. The lot elevation varies from 6 feet along the northern side to less than 1 foot beside the canal. The applicant is building a house and already has the septic field in operation. The lot is moderately wooded with sweet gum (Liquidambar s raciflua and loblolly pine (Emus taeda being the predominant species. The undergrowth consists of yard grass and is mowed. The applicant has constructed a steel retaining wall along the south side of the house, separating the upland area from the shoreline wetlands. The dimensions are approximately 100' x 2' and the apparent purpose of this upland bulkhead is to prevent sediment from land disturbance and fill activities associated with house construction from eroding into the canal. Soils vary from sandy loam to organic and two areas (northeast corner and southern side along the canal to southeastern corner) appear to be non-coastal wetlands. Submerged aquatic vegetation consisting of Eurasian milfoil exist in sparse beds in the canal. Waters of the Yeopim River are classified as SC by the NC Division of Environmental Management. The applicant estimates annual erosion to be 2'. Development Proposal In order to protect his shoreline and his house, the applicant is proposing to construct 290 feet of wooden bulkheading an average distance of 5 feet waterward of the normal water line with a maximum distance of 11'/z feet. The applicant proposes to construct the bulkhead and then backfill 1447 sq. ft. of Public Trust Area and 3345 sq. ft. of non-coastal wetlands to an elevation of 3 feet. The applicant further proposes to construct a 24' x 14' wooden dock on the canal and adjacent to his proposed bulkhead. Anticipated Impacts Approximately 3345 sq. ft. of non-coastal wetlands will be filled and 1447 sq. ft. of Public Trust Area will be filled. Three hundred thirty-six sq. ft. of Public Trust will be shaded by the proposed dock. Increased turbidity will occur during construction. No submerged aquatic vegetation should be impacted by the project. CAMA Review The Perquimans County Land Use Plan places all of the estuarine shoreline and estuarine waters in the conservation class. SHERROD of Perquimans County, filed an application on September 7, 1995, for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the Division of Environmental Management that a discharge of fill material in project wetlands will not violate applicable water quality standards. According to said application JAMES H. SHERROD proposes to construct 290 ft. of wooden bulkhead an average distance of 5 feet waterward of the NWL and backfill on non- coastal wetlands and public trust area. Also proposed is the construction of a 24' x 14' dock. The project site is located at Lot H56, Snug Harbor, Hertford, Perquimans County, Yeopim River. A copy of the entire application and additional information may be examined (or copies furnished upon request and payment of reproduction costs) during normal business hours at the office of Frank A.
