You have our approval to excavate 2.1 acres of wetlands or waters for the purpose of expanding your existing pond off Sloop Point Loop Road (SR 1563) in Pender County, as you described in your application dated 6 September 1995. After reviewing your application, we have decided that this impact is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. When excavation is complete, applicant shall fill in the newly constructed ditch along the eastern side of the wetlands. The ditch shall be filled back to original ground elevation along its entire length. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. DEM ID: 95930. The Wildlife Resources Commission has reviewed the subject permit application. A site visit was made on September 21, 1995. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.). The applicant has applied for Water Quality Certification to excavate 2.1 acres of wetlands. The project's purpose appears to be expansion of an existing 1 acre pond in addition to generation of fill material. We found the ground in the forested wetland area to be saturated with water during our site visit. Site wetlands are vegetated with red maple, sweet bay, loblolly pine, sphagnum moss, and fern and provide habitat for raccoon, oppossum, and a variety of songbirds. These wetlands also appear to provide excellent amphibian habitat during wet periods when temporary pools of water occur. A ditch occurs near the property that likely drains to surface waters, so a water quality protection function may exist for the wetlands as well. RECEIVED SEP 2 81995 ENVIRONMENTAL SCIENCES J There appears to be a highground alternative for this project that would eliminate the need to excavate wetlands. Excavation into highground to the west of the existing pond, rather than to the south, would avoid wetlands and potential impacts to water quality. Therefore, we recommend that certification be conditioned to require relocation of excavation to existing adjacent highground. Thank you for the opportunity to comment on this project. Explained plans thus far, worked on structural and procedural aspects of the building program. Set up meeting.for 9:00 on August 14, to review upgrades to plans. Returned to office started re-vamp of plans as per architects and engineers suggestions. Tuesday- August 8, 1995 - 2.5 hours: Worked on plans contacted and sent a set of plans to Larry Baldwin of the Land Management Group. He should be out approximately August 18, to review site, do analysis of soils and design the sanitation systems to be submitted to the Health Department for approval. Estimated total cost - $450.00 to $600.00 dollars. Wednesday- August 9, 1995 7 hours: Met with Johnny Garrison the surveyor. Aligned a schedule to get a Topographical maj and a placement of the buildings so we may be able to prepare a storm water run off plan. Worked on plat and water collection plans. Thursday- August 10, 1995 - 8 hours: Met with Ron Chi at UCB Bank. He is the person taking Mary Anna Calhouns place. He is very knowledgable about church groups and building Churches. He is ready to start work as soon as we have basic completed plans and lock inon a budget. Called th Natural Resources Comm., Continued to work on storm drainage plans. Friday- August 11, 1995 - 8 hours: Continued to work on storm water run off plans and to try to follow directions so the plans will suffice to get a permit when we get an engineers seal. This could be the difference between one to two thousand versus ten to twelve thosand dollars as previously quoted. Based upon our review, we have determined that the proposed activity is consistent with the North Carolina Coastal Management Program provided the following conditions are met: 1. The proposed activity must be reviewed by the Pender County Planning Department and found to be in keeping with all local rules and regulations. 2. The activity described in the above-referenced application qualifies to receive one of the Nation- wide Permits described in 33 CFR Part 330 with the exception of Numbers 17, 21, 24, and 34 which were found inconsistent with the North Carolina Coastal Management Program. 3. A 401 Water Quality Certification is received, where required, from the North Carolina Division of Environmental Management. This letter does not relieve you of the responsibility to insure that all other State authorization and/or permit requirements are met prior to implementation of the project.
