APPROVAL of 401 Water Quality Certification

Dear Mr. Godfrey:
You have our approval to place fill material in 9,280 square feet of wetlands or waters for the
purpose of constructing a bulkhead at your lot at Carolina Shores, Durants Neck, as you described in
your application dated 29 August 1995. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Number 2665. This certification allows you to use
Nationwide Permit Number 13 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

Site Description
The applicant owns Lot 8 of Susan's Landing Subdivision, which he developed. It is
located on the Albemarle Sound in the Durant's Neck region of Perquimans County off of
SR 1223. The lot is approximately 2 acres and is almost entirely tended yard grasses except
for a few trees around the edge. Taxodium distichum (bald cypress), Acer rubrum (red
maple), uercus nigia (sweet gum) and Liquidambar styraciflua (water oak) are the prevalent
tree species. Although no coastal wetland or SAV's were noted, approximately 4,000 square
feet of the lot has been delineated as "404" wetlands by the USACOE.
Soils on the lot have a sandy loam texture and the elevation varies from 6" along the
shore to 6' at the center of the lot. The waters of the Albemarle Sound are classified by
NCDEM as SB and are part of CAMA's Estuarine System Area of Environmental Concern.
Man-made features on the applicant's lot consist of a pier with platform and boathouse,
a boatramp, a 170' wooden bulkhead and approximately 150' of riprap constructed of
concrete bags. This latter feature was originally placed at the water's edge to prevent
overwash; however, due to erosion, it now lies an average of 17 feet waterward of the NWL
and serves as a non-functioning low water breakwater.
The applicant is experiencing severe erosion and overwash of the unprotected portion
of his lot and he wishes to prevent this from continuing by constructing 600' of bulkhead to
connect on both sides of his existing bulkhead. One hundred feet of bulkhead with a 20'
return is to be constructed east of his boatramp and 560 feet of bulkhead with a 20' return is
to be constructed and connected to the western end of his existing bulkhead and ending at his
property line. The applicant further proposes to fill and grade behind the bulkhead and to fill
and grade the "404" area.
Anticipated Impacts
The proposed work will cause increased turbidity during construction. Once the
project is completed, shoreline erosion should stop and turbidity and measurable
sedimentation should cease.
An area of 5,280 sq. ft. of Estuarine and Public Trust Waters will be lost in the fill
area behind the bulkhead. This amount of fill area represents the amount the applicant feels
he has lost within the last year. Four thousand square feet of "404" wetlands will be lost.

CAMA Review
The proposed project involves the Public Trust, Estuarine Waters and Estuarine
Shoreline Areas of Environmental Concern. No historical/archeological significance is
associated with this lot. No endangered or threatened species of plants or animals have been
identified in the project area. The lot is not part of any unique geologic formation. There
are no submerged aquatic vegetation beds within the projected work area.
A consistency review of the project with the Perquimans County Land Use Plan will be
sent under separate letterhead.

Enclosed is the application of Mr. Ray Godfrey for Department of
the Army (DA) authorization and a State Water Quality Certification to
construct a bulkhead on his property, identified as Lot Number 8, Susan's
Landing Subdivision, located off State Road 1323, adjacent the Albemarle
Sound, Durant's Neck, Perquimans County, North Carolina. Your receipt of
this letter verifies your acceptance of a valid request for certification
in accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until
the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases,
60 days after receipt of a request for certification is a reasonable time
for State action. Therefore, if you have not acted on the request, or
asked for an extension of time, by October 30, 1995, the District Engineer
will deem that waiver has occurred.

to be constructed and connected to the western end of his existing bulkhead and ending at his
property line. The applicant further proposes to fill and grade behind the bulkhead and to fill
and grade the "404" area.
Anticipated Impacts
The proposed work will cause increased turbidity during construction. Once the
project is completed, shoreline erosion should stop and turbidity and measurable
sedimentation should cease.
An area of 5,280 sq. ft. of Estuarine and Public Trust Waters will be lost in the fill
area behind the bulkhead. This amount of fill area represents the amount the applicant feels
he has lost within the last year. Four thousand square feet of "404" wetlands will be lost.

PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that Ray Godfrey of
Perquimans County, filed an application on August 17, 1995, for a permit from the Division
of Coastal Management to develop in an Area of Environmental Concern and for certification
from the Division of Environmental Management that a discharge of fill material in project
wetlands will not violate applicable water quality standards.
According to said application Ray Godfrey proposes to construct 660 linear feet of
bulkhead along the shoreline. The proposed bulkhead would backfill 5,280 square feet of
estuarine waters. The property is located at Carolina Shores, Durants Neck, Perquimans
County on the Albemarle Sound.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business
hours at the office of Frank Jennings, Division of Coastal Management, located at 1367 US
17 South, Elizabeth City, N.C., 919/264-3901, and/or the office of Deborah Sawyer,
Division of Environmental Management, DEHNR Regional Field Office, Washington, N.C.,

The Division of Environmental Management proposes to take final action on this
water quality certification on or before September 18, 1995. The issuance of the CAMA
Major Development permit and the Section 401 Certification may deviate from this projected
date depending upon the nature of the comments submitted and subsequent hearings that may
result.
All persons desiring to make comments should do so in writing to Roger N. Schecter,
Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
September 13, 1995 for consideration in the CAMA permit decision, and to Mr. John

Site Description
The applicant owns Lot 8 of Susan's Landing Subdivision, which he developed. It is
located on the Albemarle Sound in the Durant's Neck region of Perquimans County off of
SR 1223. The lot is approximately 2 acres and is almost entirely tended yard grasses except
for a few trees around the edge. Taxodium distichum (bald cypress), Acer rubrum (red
maple), uercus nigia (sweet gum) and Liquidambar styraciflua (water oak) are the prevalent
tree species. Although no coastal wetland or SAV's were noted, approximately 4,000 square
feet of the lot has been delineated as "404" wetlands by the USACOE.
Soils on the lot have a sandy loam texture and the elevation varies from 6" along the
shore to 6' at the center of the lot. The waters of the Albemarle Sound are classified by
NCDEM as SB and are part of CAMA's Estuarine System Area of Environmental Concern.
Man-made features on the applicant's lot consist of a pier with platform and boathouse,
a boatramp, a 170' wooden bulkhead and approximately 150' of riprap constructed of
concrete bags. This latter feature was originally placed at the water's edge to prevent
overwash; however, due to erosion, it now lies an average of 17 feet waterward of the NWL
and serves as a non-functioning low water breakwater.
The applicant is experiencing severe erosion and overwash of the unprotected portion
of his lot and he wishes to prevent this from continuing by constructing 600' of bulkhead to
connect on both sides of his existing bulkhead. One hundred feet of bulkhead with a 20'

Site Description
The applicant owns Lot 8 of Susan's Landing Subdivision, which he developed. It is
located on the Albemarle Sound in the Durant's Neck region of Perquimans County off of
SR 1223. The lot is approximately 2 acres and is almost entirely tended yard grasses except
for a few trees around the edge. Taxodium distichum (bald cypress), Acer rubrum (red
maple), uercus nigia (sweet gum) and Liquidambar styraciflua (water oak) are the prevalent
tree species. Although no coastal wetland or SAV's were noted, approximately 4,000 square
feet of the lot has been delineated as "404" wetlands by the USACOE.
Soils on the lot have a sandy loam texture and the elevation varies from 6" along the
shore to 6' at the center of the lot. The waters of the Albemarle Sound are classified by
NCDEM as SB and are part of CAMA's Estuarine System Area of Environmental Concern.
Man-made features on the applicant's lot consist of a pier with platform and boathouse,
a boatramp, a 170' wooden bulkhead and approximately 150' of riprap constructed of
concrete bags. This latter feature was originally placed at the water's edge to prevent
overwash; however, due to erosion, it now lies an average of 17 feet waterward of the NWL
and serves as a non-functioning low water breakwater.
The applicant is experiencing severe erosion and overwash of the unprotected portion
of his lot and he wishes to prevent this from continuing by constructing 600' of bulkhead to
connect on both sides of his existing bulkhead. One hundred feet of bulkhead with a 20'
return is to be constructed east of his boatramp and 560 feet of bulkhead with a 20' return is
to be constructed and connected to the western end of his existing bulkhead and ending at his
property line. The applicant further proposes to fill and grade behind the bulkhead and to fill
and grade the "404" area.
Anticipated Impacts
The proposed work will cause increased turbidity during construction. Once the
project is completed, shoreline erosion should stop and turbidity and measurable
sedimentation should cease.
An area of 5,280 sq. ft. of Estuarine and Public Trust Waters will be lost in the fill
area behind the bulkhead. This amount of fill area represents the amount the applicant feels
he has lost within the last year. Four thousand square feet of "404" wetlands will be lost.

The proposed project involves the Public Trust, Estuarine Waters and Estuarine
Shoreline Areas of Environmental Concern. No historical/archeological significance is
associated with this lot. No endangered or threatened species of plants or animals have been
identified in the project area. The lot is not part of any unique geologic formation. There
are no submerged aquatic vegetation beds within the projected work area.
A consistency review of the project with the Perquimans County Land Use Plan will be
sent under separate letterhead.
