E COPY Dear Mr. and Mrs. Mullen Haskett: You have our approval to place fill material in 960 square feet of waters for the purpose of constructing a bulkhead at 129 Nixonton Loop Road, as you described in your application dated 28 August 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant proposes minor repair to the existing dock and pier and to stabilize 96 ft. of shoreline with wooden bulkhead an average distance of 10 ft. waterward of the NWL. W. MULLEN HASKETT PASQUOTANK COUNTY BIO REPORT Page Two INTRODUCTION The applicant owns a lot and residential structure in Pasquotank County on the Little River in the Nixonton Township. The applicant wishes to repair the existing dock and pier and replace the remnant bulkhead with a new wooden bulkhead 10 ft. waterward of the existing NWL . SITE DESCRIPTION Nixonton is located on the north shore of the Little River, northwest of Trueblood Point in Pasquotank County. Nixonton Loop Rd. is off of SR 1100 and loops around the Nixonton Township along the Little River and SR 1140. Records indicate that the appplicant was conveyed the subject property in February of 1981. The existing shoreline is eroded an average of 8 ft. landward of the previous bulkhead. Existing structures include a 22 ft. by 6 ft. dock adjacent to a 96 ft. long by 6 ft wide pier with a 14 ft. by 16 ft. "L" platform at the end. A 15 ft. by 25 ft. enclosed boat supply shed is adjacent to the existing dock and mostly landward of the NWL. Pilings from a remnant bulkhead are currently 8 ft. waterward of the existing NWL. Approximately 8 ft. of shoreline has eroded underneath the boat shed, requiring the shed to be supported by temporary piles. A single-family residential structure is located approximately 66 ft. landward of the NWL. The shoreline is vegetated in upland lawn grasses with a fringe canopy of Taxodium distichum (bald cypress). The upland portion of the applicant's site is vegetated in lawn grasses, ornimental shrubs and Pinus australis (long-leaf pine). The waters of the Little river are classified as Joint Waters by the Wildlife Resources Commission. The Division of Environmental Management classifies these waters as SC. The waters of the Little River are classified as estuarine and public trust waters by the Division of Coastal Management and part of the Estuarine System Area of Environmental Concern. W. The applicant also wishes to stabilize 96 ft. of shoreline with wooden bulkhead an average distance waterward of 10 ft. and a maximum distance of 12 ft. waterward of the NWL. The river depth is approximately 2 ft. deep under normal conditions along the proposed bulkhead alignment. ANTICIPATED IMPACTS The proposed development is within the Estuarine / Public Trust Waters Areas of Environmental Concern. The proposed project would impact a total of 960 sf. (0.022 A) of public trust waters. The repair to the existing dock and pier would not shade any additional waters than are currently impacted. The proposed bulkhead construction would allow the property owner to stabilize the shoreline under an existing building structure. CAMA REVIEW No endangered species or Coastal Wetlands are are known to exist or are currently present at this proposed project site. This project is located within the Public Trust Waters Area of Environmental Concern of the Estuarine System in North Carolina. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the Revised 03/95 Form DCM-MP-1 site. Include highway or secondary road (SR) numbers, landmarks, and the like. 6. The applicant wishes to repair the existing dock and pier and replace the remnant bulkhead with a new wooden bulkhead 10 ft. waterward of the existing NWL . SITE DESCRIPTION Nixonton is located on the north shore of the Little River, northwest of Trueblood Point in Pasquotank County. Nixonton Loop Rd. is off of SR 1100 and loops around the Nixonton Township along the Little River and SR 1140. Records indicate that the appplicant was conveyed the subject property in February of 1981. The existing shoreline is eroded an average of 8 ft. landward of the previous bulkhead. Existing structures include a 22 ft. by 6 ft. dock adjacent to a 96 ft. long by 6 ft wide pier with a 14 ft. by 16 ft. "L" platform at the end. A 15 ft. by 25 ft. enclosed boat supply shed is adjacent to the existing dock and mostly landward of the NWL. Pilings from a remnant bulkhead are currently 8 ft. waterward of the existing NWL. Approximately 8 ft. of shoreline has eroded underneath the boat shed, requiring the shed to be supported by temporary piles. A single-family residential structure is located approximately 66 ft. landward of the NWL. The shoreline is vegetated in u 14 Lzzt ses with a fringe canopy of Taxodium distichum (bald cypress). The river depth is approximately 2 ft. deep under normal conditions along the proposed bulkhead alignment. ANTICIPATED EMPACTS The proposed development is within the Estuarine / Public Trust Waters Areas of Environmental Concern. The proposed project would impact a total of 960 sf. (0.022 A) of public trust waters. The repair to the existing dock and pier would not shade any additional waters than are currently impacted. The proposed bulkhead construction would allow the property owner to stabilize the shoreline under an existing building structure.
