PROJECT SUMMARY: The applicants propose to build a hotel, parking, swimming pool, beach crossovers, and install utilities on a 1.8 acre, oceanfront site. PELICAN'S NEST / Page 2 9. PROJECT DESCRIPTION The proposed Pelican's Nest Hotel site is located on Highway 210 in North Topsail Beach, Onslow County. This 1.8 acre tract is located oceanfront between the Mainsail Restaurant and St. Moritz highrise condominium building. This tract is across Highway 210 from Roger's Bay Camp Ground. The site is gently rolling with some primary dunes on the ocean side of the lot. Primary dune heights range from 17 to 23 feet above mean sea level and are shown on the Grading/Drainage Plan, Sheet C2. All proposed development is to be landward of the crest of the primary dunes. The hotel building and all required parking are landward of the 120' CAMA setback for large structures. The 120' required setback has been mistakenly labeled as 60' CAMA Line on the drawings. This error was corrected in ink. The proposed building is to have four floors of rooms with parking under the building at street level, for a total of five stories. The footprint of the structure is approximately 11, 000 square feet. 61 rooms are planned. The proposed height of the hotel building will be approximately 58' +- at the highest roof peaks. The building will exceed the height limitation of the Town of North Topsail Beach. A height variance was requested and received of the Town in March, 1995. The primary parking area will be located on the Eastern side of the hotel and will provide parking space for 50 cars. Surface treatments for the drives and parking are shown on the Site Plan, Sheet C1. The swimming pool, surrounding decking, and overflow parking area are proposed within the CAMA setback as allowed exceptions under the rules. The proposed parking oceanward of the building, within the setback, will be bordered by a retaining wall at the toe of the dunes. The purpose of this wall is to minimize impacts to dune system while allowing for maximum use of the lot. As is standard practice, the 2 beach crossovers extend from the developed areas over the dunes to the public beach. Wastewater disposal will be provided by North Topsail Water & Sewer, a private wastewater treatment plant. Water will be supplied by Onslow County. Stormwater will be collected in a storm drain system and discharged into the sideditch of Highway 210. However, specific stormwater requirements will be reviewed and modified as needed by the Division of Environmental Management. The predominant types of vegetation on this tract are small oaks, cedars, sea oats, yucca and other beach grasses. The first line of stable, natural vegetation has been identified by the Division and is shown on the plans. The property is zoned Business - 1 by North Topsail Beach, appropriate for the planned use. The area is classified as Limited Transition by the Town of North Topsail Beach Landuse Plan. The adjacent waters of the Atlantic Ocean are classified as SB by the Division of Environmental Management. 10. ANTICIPATED IMPACTS The applicant states that just under 1 acre will be disturbed in the course of this development. Adverse impacts include increased impervious surface over the tract, alteration of the natural drainage patterns, loss of native vegetation, and increased foot traffic during and after construction. The protective nature of the existing dunes should not be altered if the submitted design, plans, and conditions of the permit are adhered to. Janet M. The rules of the Coastal Resources Commission requLre that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be bsued. The Commission's rules on bullding standards, oceanfront setbacks and dune alteration are designed to minimize,bu t not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not gguarantee the safety of the development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean erosion rate for the area where your property Ls located is Z feet per year. The rate was es'.ablished by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies also indicate that the shoreline could move as much as -Z/O feet landward in a major storm. The flood waters Ina major storm are predicted to be about %-1 feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary devices, including sand bags, may be allowed under certain conditions. SPECIAL NOTE: This hazard notice is required for development in areas subject to sudden and massive storms and erosion. Permits issued for development in thLc ' area expire on December 31 of the third year following the year in which the permit was Issued. Shortly before work begins on the project site, the Local Permit Officer. will. determine the vegetation line and setback distance at your site. Natural forces of water and wind collide with tons of force, even on calm days. Man-made structures cannot be guaranteed to survive the force of a hurricane. Long-term erosion (or barrier island migration) may take from two to ten feet of the beach each year and, sooner or later, will threaten oceanfront struc- tures. These are the facts of life for oceanfront property owners. The Coastal Resources Commission (CRC) has adopted rules for building along the oceanfront. The rules are in- tended to avoid an unreasonable risk to life and property and to limit public and private losses from storms and long-term erosion' These rules lessen but do not eliminate the element of risk in oceanfront development. As you consider building along the oceanfront, the CRC wants you to understand the rules and the risks. With this knowled ge you can make a more informed decision about where and how to build in the coastal area. The Rules When you build along the oceanfront, coastal manage- ment rules require that the structure be sited to fit safely into the beach environment. Structures along the oceanfront must be behind the frontal dune, landward of the crest of the primary dune and set back from the first line of nahural stable vegetation a dis- tance equal to 30 times the annual erosion rate (a minimum of 60 feet). If the erosion rate It greater than 3.5 feet/year, the setback Is 30 times the erosion rate plus .105 feet. The Reasons The beachfront is an ever-changing landform. The beach and the dunes are natural "shock absorbers", takh?gg the beatin s of the winds and waves and protecting the nand areas. By setting back 30 or 60 Hmes the annual Ion term erosion rate, you have a good chance of enjoying the full life of the structure. At first, it seems very inviting to build' your dream house as close to the beach as possible, but-in five years you could find the dream has become a nightmare as high tides and storm tides threaten your investment. The Exception The Coastal Resources Commission recognized that these rules, inlHally passed in June of 1979, might prove a hardship forsomeproperty owners. Therefore, they estab- lished an exception for lots which cannot meet the setback requirement. The exception allows buildings in front of the setback line if the following conditions apply: (1) the lot must have been platted as of June 1,1979; and not capable of being enlargedbycombinhig with adjoining land under the same ownership, (2) development must be as for back on the property as possible and In no case less than 60 feet landward of the vegetation lino, (3) no development can take place on the frontal dune (4) special construction standards on piling depth and square footage must be met and (5) all other LAMA; state and local regulations must be met. The exception is not available In the Inlet Hazard Area. BOX 1570 JACKSONVILLE, NORTH CAROLINA 28541 Zz' (21i2) E (910) 455-0877 JUL1?'1995 Narrative for PELICANS NEST DIVISION OF -10ASTAL MANAGEMENT This property was conveyed to North Topsail Beach Motel, L.L.C. by the Hunter Heath Trust on September 14, 1994 as recorded in Deed Book 1204, Page 570 of the Onslow County Registry. This, property had been previously conveyed to Dr. Hunter Heath from Elizabeth S. Day in 1978 as shown in Deed Book 529, Page 872 of the Onslow County Registry. Pelicans Nest covers 1.8 acres of the total 3.57 acres conveyed to North Topsail Beach Motel, L.L.C.. The project was originally named Loggerhead Inn, as you will see throughout the application on some of the correspondence. This was changed to Pelicans Nest to eliminate any confusion with another establishment located on Topsail Island. This property is located between the Mainsail Restaurant and the St. Moritz on N.C. Highway 210. The property has 525 feet of road frontage, 275 feet of frontage along the Atlantic Ocean and 239 feet of depth. The elevation of the property at its lowest point is 8.0 feet and it's highest dune point is 23.7 feet above mean sea level. The property has limited vegetation with small oaks, several cedars and beach grass. The only man-made features on the property include the asphalt from the abandoned N.C. Highway 210. The CAMA line for this particular project is 120 feet from the first line of vegetation and is clearly marked on the plans. The proposed improvements designed within the CAMA line are the swimming pool, decking for the pool, boardwalks to the Atlantic Ocean and a portion of the eighteen parking spaces. The property is presently zoned Business-1,. Pelicans Nest is consistent with the present zoning. This project is also consistent with the Land Use Plan for the Town of North Topsail Beach. The western riparian adjoiner is Mr. Brad Minshew of North Topsail Beach, L.L.C. and the eastern riparian adjoiner is Mr. Louten Britt of H & B Investments, Inc. The addresses of these adjoiners are listed within the application. Sheet 6 of 23 Pelicans Nest will consist of one building (45' x 238') having sixty one rooms. The building will rest on a concrete slab supported by approximately 260 piles and will be five stories. The building will be constructed of concrete and masonry walls with stucco exterior. The required parking for this project by the Town of North Topsail Beach is sixty seven spaces. These spaces, as required by LAMA, will rest outside of the 60' LAMA line. Seventeen spaces are located below the building and 50 are located on the rock parking lot located on the east side of the building. Additional parking of eighteen spaces is located south of the building and overflow parking is located in the western adjoiner's parking lot (Mainsail Restaurant). The amount of land disturbance is limited to 0.9 acres. The primary land disturbance will be the building location and within 40 feet of it's foundation. The eastern parking lot will have limited grading with a rock coverage. The 18 spaces south of the building will include a retaining wall within the toe of the dune to minimize any dune disturbance. The swimming pool and decks will be built above the existing contours of the dunes to also minimize dune disturbance. The property will have two thirty feet entrances/exits to N.C. Highway 210. The State of North Carolina has granted a sewer extension permit labeled Permit No. WQ0010698 for this project. Pelicans Nest will build a pump station and force main and tie into the existing sewer force main of North Topsail Water & Sewer, Inc., which rests along the shoulder of N.C. Highway 210. PROJECT SUMMARY: The applicants propose to build a hotel, parking, swimming pool, beach crossovers, and install utilities on a 1.8 acre, oceanfront site. r PELICAN'S NEST / Page 2 9. PROTECT DESCRIPTION The proposed Pelican's Nest Hotel site is located on Highway 210 in North Topsail Beach, Onslow County. This 1.8 acre tract is located oceanfront between the Mainsail Restaurant and St. Moritz highrise condominium building. This tract is across Highway 210 from Roger's Bay Camp Ground. The site is gently rolling with some primary dunes on the ocean side of the lot. Primary dune heights range from 17 to 23 feet above mean sea level and are shown on the Grading/Drainage Plan, Sheet C2. All proposed development is to be landward of the crest of the primary dunes. The hotel building and all required parking are landward of the 120' CAMA setback for large structures. The 120' required setback has been mistakenly labeled as 60' CAMA Line on the drawings. This error was corrected in ink. The proposed building is to have four floors of rooms with parking under the building at street level, for a total of five stories. The footprint of the structure is approximately 11, 000 square feet. 61 rooms are planned. The proposed height of the hotel building will be approximately 58' +- at the highest roof peaks. The building will exceed the height limitation of the Town of North Topsail Beach. A height variance was requested and received of the Town in March, 1995. The primary parking area will be located on the Eastern side of the hotel and will provide parking space for 50 cars. Surface treatments for the drives and parking are shown on the Site Plan, Sheet C1. The swimming pool, surrounding decking, and overflow parking area are proposed within the CAMA setback as allowed exceptions under the rules. The proposed parking oceanward of the building, within the setback, will be bordered by a retaining wall at the toe of the dunes. The purpose of this wall is to minimize impacts to dune system while allowing for maximum use of the lot. As is standard practice, the 2 beach crossovers extend from the developed areas over the dunes to the public beach. Wastewater disposal will be provided by North Topsail Water & Sewer, a private wastewater treatment plant. Water will be supplied by Onslow County. Stormwater will be collected in a storm drain system and discharged into the sideditch of Highway 210. However, specific stormwater requirements will be reviewed and modified as needed by the Division of Environmental Management. The predominant types of vegetation on this tract are small oaks, cedars, sea oats, yucca and other beach grasses. The first line of stable, natural vegetation has been identified by the Division and is shown on the plans. The property is zoned Business - 1 by North Topsail Beach, appropriate for the planned use. The area is classified as Limited Transition by the Town of North Topsail Beach Landuse Plan. The adjacent waters of the Atlantic Ocean are classified as SB by the Division of Environmental Management. 10. ANTICIPATED IMPACTS The applicant states that just under 1 acre will be disturbed in the course of this development. The LAMA line for this particular project is t20 feet from the first line of vegetation and is clearly marked on the plans. The approval of this request will be considered on its merits and may or may not be approved. 6. Construction of the sewers. pwnp station(s) and force main shall be scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of the State. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a profmional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Manaprnent, in accordance with North Carolina General Statute 143-215.6(a) to 143-213.6(c). 10. The issuance of this penult does not preclude the Peminee from complying with any and all statutes, miles, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction 11. In the event that the facilities fall to perform satisfactorily, including the creation of nuisance conditions, the P+ermittee shall take immediate corrective ac dM including those as may be required by this Division, such as the construction of additional or replacement wastewater collection facilities. 13. NONCOMPLIANCE NOTIFICATION: The Permittee shall report by telephone to the Wilmington Re ional Office, telephone number (910 395-3900, as soon as possible, but in no case more than 24 hours or on the next worsting day following the occurrence or Brat knowledge of the occurrence of either of the following: a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater transport, such as mechanical or electrical failures of pumps, line blockage or breakage, etc.; or b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence.
