On 19 July 1995 a Water Quality Certification (#3030) was issued to you to fill 6,200
square feet of wetlands and waters for lot fill and bulkhead installation. On 3 January
1997, DWQ was notified of your plans to modify the application for an additional 600
square feet of open water fill. This modification is hereby approved as long as all other
conditions of the 19 July 1995 Certification are still met.

The applicant has submitted to this office a written request to modify CAMA Major Permit
#118-95 issued 09/14/95. A check for $50.00 has also been submitted.
The applicant proposes to fill a portion of an existing 15'x 90' man-made boatramp and
canal. The area of the fill will be 600 square feet (15 ft. X 40 if). The water depth in the proposed
fill site at NWL is one foot. The applicant proposes to bulkhead across the canal and continue the
alignment along NWL until it reaches an existing bulkhead on the adjoining property line. The
proposal represents a 30 foot landward retreat from the previously permitted alignment. It will result
in 900 square feet of PT, EW not being captured and filled as allowed by the permit.
The plat from the original permit indicates 450 feet of bulkhead arc to be constructed. The
modified proposal indicates 335 feet of bulkhead are to be constructed.
It is recommended this modification proposal be approved.

CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws
92-500 and 95-217 of the United States and subject to the North Carolina Division of Environmental
Management Regulations in 15 NCAC 2H, Section .0500 to James Jester and Mike Lassiter resulting in 6,200
square feet of wetland impact in Pasquotank County pursuant to an application filed on the 2nd day of August of
1995 to install a bulkhead, shoreline cleanup and construction of residential facilities.
The Application provides adequate assurance that the discharge of fill material into the waters of
Pasquotank River in conjunction with the proposed development in Pasquotank County will not result in a
violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina
certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if
conducted in accordance with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as to prevent significant increase in
turbidity outside the area of construction or construction related discharge (50 NTUs in
streams and rivers not designated as trout waters by DEM; 25 NTUs in all saltwater
classes, and all lakes and reservoirs; 10 NTUs in trout waters).
The site for the septic tank drain field shall be altered as required by county authorities
so as to ensure that the drain field shall not be placed in jurisdictional wetlands.
Violations of any condition herein set forth shall result in revocation of this Certification. This
Certification shall become null and void unless the above conditions are made conditions of the Federal 404
and/or Coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or
CAMA permit.
If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written
request within sixty (60) days following receipt of this Certification. This request must be in the form of a
written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. If modifications are made to an original
Certification, you have the right to an adjudicatory hearing on the modifications upon written request within sixty
(60) days following receipt of the Certification. Unless such demands are made, this Certification shall be final
and binding.

8. PROJECT SUMMARY: The applicant proposes to construct 435 ft. of wooden bulkhead

INTRODUCTION
The applicants own three residential lots on Weeks Drive along the Albemarle Sound.
A derlick bulkhead exists along the shoreline which extends, in some places, 13 feet
waterward of the current NWL. To stabilize the shoreline and clean up the existing debris,
the applicants wish to bulkhead approximately 435 ft. of shoreline an average of 2 ft.
waterward of the old bulkhead. This application also concerns the replacement of an existing
boat ramp and the construction of a wooden jetty at the boat ramp waterward entrance. Other
development includes associated site clean up and grading of Estuarine Shoreline and the
construction of two residential structures adjacent to the Estuarine Shoreline AEC.
SITE DESCRIPTION
The applicants own lots 106, 108 and 110 on Weeks Drive, Riverview Acres, near the
Glen Cove Subdivision, Pasquotank County on the Albemarle Sound. The adjacent
properties are built upon and have bulkheads.
Man-made features on lot 106 owned by Mr Jester include a residential mobile home
structure, storage buildings and two gazebos . Lots 108 and 110, owned by Lassiter
Construction, include an abandoned mobile home trailer and miscellaneous out-buildings, all
of which are in a state of dis-repair or eminent collapse.
During March 1993, the existing bulkhead suffered significant damage and is presently
failing along it's entire length. The remains of a deteriorated bulkhead exists an average
distance of 8 ft. waterward and a maximum distance of 13 ft. of the normal water level.
Broken concrete and bricks line much of the area between the normal water level and the
deteriorated bulkhead. Lots 106 and 108 are separated by an existing boat slip and concrete
ramp structure. G.P. 12945A, issued July 7, 1994 to Mr. Jester, authorized 90 ft. of
bulkhead replacement at a 2 ft. waterward alignment from the NWL along this damaged
shoreline.
The existing site elevation is approximately 2 ft. above the normal water level.
The Pasquotank County Soil Survey indicates that the soils in the vicinity of this applicant's
project consists of Pasquotank Series soils and are defined by the USDA Soil Conservation
Service as very fine sandy loam. "Table D1" from the 1987 Corps of Engineer Wetland
Delineation Manual , lists Pasquotank Series soil as hydric.

Vegetation consists of yard grasses and a few trees including Acer rubrum (red maple),
Pinus taeda (loblolly pine), Salix nigra (coastal plain or black willow), Gleditsia spp.
(honeylocust) and Myrica cerifera (wax myrtle). Approximately 200 sf. of Phragmitis
australis are also present along the Estuarine Shoreline, landward of the NWL.
The waters of the Pasquotank River are classified as SC by NC DEM. The NC Marine
Fisheries Commission classifies the waters of the Albemarle Sound as Coastal Waters. The
waters of the Albemarle Sound are considered as Estuarine and Public Trust Waters by the
Division of Coastal Management and are part of the Estuarine System Area of Environmental
Concern in North Carolina.
PROPOSED WORK
The applicant proposes to develop lots 108 and 110. This work includes shoreline
stabilization, site clean-up and the construction of two residential structures. The applicant
proposes to construct 435 ft. of wooden bulkhead, approximately 2 ft. waterward of an
existing derlick bulkhead. The proposed bulkhead alignment would be an average distance of
10 ft. and a maximum distance of 15 ft. waterward of the NWL. The proposed bulkhead
will tie into the neighboring adjacent bulkhead structures. Existing large quantities of

ANTICIPATED IMPACTS
The proposed bulkhead will result in the loss of 4325 sf. of public trust waters and
estuarine waters. Due to the existing derlick bulkhead and rip-rap debris, use of these waters
by resources or by the public is near impossible. The placement of the proposed bulkhead at
a 2 ft. average distance waterward of the NWL would require the removal of a significant
quantity of old bulkhead debris and would probably increase turbidity levels. The proposed
alignment of two feet beyond the derlick bulkhead structure would minimize site disturbance
and turbidity. In addition, the proposed clean up of the debris along the estuarine shoreline
would prevent this debris from washing into the waters of the Albemarle Sound. The two
proposed residential structures would be outside the CAMA Estuarine Shoreline AEC.
Water turbidity levels will temporarily increase during bulkhead construction. To
reduce turbidity in the adjacent Estuarine Waters, the proposed site grading and clean up, as
well as the residential construction, would be done after the bulkhead construction is
complete.
CAMA REVIEW
The proposed project involves the Public Trust, Estuarine Waters and Estuarine
Shoreline Areas of Environmental Concern. The proposed project includes the stabilization
of less than 500 linear feet of shoreline. The proposed development does not exceed the
30% area of impervious surface coverage within the estuarine shoreline limitation (7H
.0209). Other than lot clean up and grading, the associated residential construction is
outside of the Estuarine Shoreline AEC.
No historical/archeological significance is associated with this lot. No endangered or
threatened species of plant nor animals have been identified in the project area. The lot is not
part of any unique geologic formation. There are no submerged aquatic vegetation beds or
coastal wetland species within the project area.
A consistency review of the Pasquotank County Land Use Plan in regard to this project
will be sent under a separate review.

Section 404 of the Clean Water Act, and we have determined that a water

INTRODUCTION
The applicants own three residential lots on Weeks Drive along the Albemarle Sound.
A derlick bulkhead exists along the shoreline which extends, in some places, 13 feet
waterward of the current NWL. To stabilize the shoreline and clean up the existing debris,
the applicants wish to bulkhead approximately 435 ft. of shoreline an average of 2 ft.
waterward of the old bulkhead. This application also concerns the replacement of an existing
boat ramp and the construction of a wooden jetty at the boat ramp waterward entrance. Other
development includes associated site clean up and grading of Estuarine Shoreline and the
construction of two residential structures adjacent to the Estuarine Shoreline AEC.
SITE DESCRIPTION
The applicants own lots 106, 108 and 110 on Weeks Drive, Riverview Acres, near the
Glen Cove Subdivision, Pasquotank County on the Albemarle Sound. The adjacent
properties are built upon and have bulkheads.
Man-made features on lot 106 owned by Mr Jester include a residential mobile home
structure, storage buildings and two gazebos . Lots 108 and 110, owned by Lassiter
Construction, include an abandoned mobile home trailer and miscellaneous out-buildings, all
of which are in a state of dis-repair or eminent collapse.
During March 1993, the existing bulkhead suffered significant damage and is presently
failing along it's entire lenkth. The remains of a deteriorated bulkhead exists an average
distance of 8 ft. waterward'and a maximum distance of 13 ft. of the normal water level.
Broken concrete and,bricks line much of the area between the normal water level and the
deteriorated bulkhead. Lots -106 and 108 are separated by an existing boat slip and concrete
ramp structure. G.P. 12945A, issued July 7, 1994 to Mr. Jester, authorized 90 ft. of
bulkhead replacement at a 2 ft. waterward alignment from the NWL along this damaged
shoreline.
The existing site elevation is approximately 2 ft. above the normal water level.
The Pasquotank County Soil Survey indicates that the soils in the vicinity of this applicant's
project consists of Pasquotank Series soils and are defined by the USDA Soil Conservation
Service as very fine sandy loam. "Table D1" from the 1987 Corps of-Engineer Wetland
Delineation Manual , lists Pasquotank Series soil as hydric.

Vegetation consists of yard grasses and a few trees including Acer rubrum (red maple),
Pinus taeda (loblolly pine), Saliz nigra (coastal plain or black willow), Gleditsia spp.
(honeylocust) and Myrica cerifera (wax myrtle). Approximately 200 sf. of Phragmitis
australis are also present along the Estuarine Shoreline, landward of the NWL.
The waters of the Pasquotank River are classified as SC by NC DEM. The NC Marine
Fisheries Commission classifies the waters of the Albemarle Sound as Coastal Waters. The
waters of the Albemarle Sound are considered as Estuarine and Public Trust Waters by the
Division of Coastal Management and are part of the Estuarine System Area of Environmental
Concern in North Carolina.
PROPOSED WORK
The applicant proposes to develop lots 108 and 110. This work includes shoreline
stabilization, site clean-up and the construction of two residential structures. The applicant

INTRODUCTION
The applicants own three residential lots on Weeks Drive along the Albemarle Sound.
A derlick bulkhead exists along the shoreline which extends, in some places, 13 feet
waterward of the current NWL. To stabilize the shoreline and clean up the existing debris,
the applicants wish to bulkhead approximately 435 ft. of shoreline an average of 2 ft.
waterward of the old bulkhead. This application also concerns the replacement of an existing
boat ramp and the construction of a wooden jetty at the boat ramp waterward entrance. Other
development includes associated site clean up and grading of Estuarine Shoreline and the
construction of two residential structures adjacent to the Estuarine Shoreline AEC.
SITE DESCRIPTION
The applicants own lots 106, 108 and 110 on Weeks Drive, Riverview Acres, near the
Glen Cove Subdivision, Pasquotank County on the Albemarle Sound. The adjacent
properties are built upon and have bulkheads.
Man-made features on lot 106 owned by Mr Jester include a residential mobile home
structure, storage buildings and two gazebos . Lots 108 and 110, owned by Lassiter
Construction, include an abandoned mobile home trailer and miscellaneous out-buildings, all
of which are in a state of dis-repair or eminent collapse.
During March 1993, the existing bulkhead suffered significant damage and is presently
failing along it's entire length. The remains of a deteriorated bulkhead exists an average
distance of 8 ft. waterward and a maximum distance of 13 ft. of the normal water level.
Broken concrete and bricks line much of the area between the normal water level and the
deteriorated bulkhead. Lots 106 and 108 are separated by an existing boat slip and concrete
ramp structure. G.P. 12945A, issued July 7, 1994 to Mr. Jester, authorized 90 ft. of
bulkhead replacement at a 2 ft. waterward alignment from the NWL along this damaged
shoreline.
The existing site elevation is approximately 2 ft. above the normal water level.
The Pasquotank County Soil Survey indicates that the soils in the vicinity of this applicant's
project consists of Pasquotank Series soils and are defined by the USDA Soil Conservation
Service as very fine sandy loam. "Table Dl" from the 1987 Corps of Engineer Wetland
Delineation Manual , lists Pasquotank Series soil as hydric.

Vegetation consists of yard grasses and a few trees including Acer rubrum (red maple),
Pinus taeda (loblolly pine), Salix nigra (coastal plain or black willow), Gleditsia spp.
(honeylocust) and Myrica cerifera (wax myrtle). Approximately 200 sf. of Phragmitis
australis are also present along the Estuarine Shoreline, landward of the NWL.
The waters of the Pasquotank River are classified as SC by NC DEM. The NC Marine
Fisheries Commission classifies the waters of the Albemarle Sound as Coastal Waters. The
waters of the Albemarle Sound are considered as Estuarine and Public Trust Waters by the
Division of Coastal Management and are part of the Estuarine System Area of Environmental
Concern in North Carolina.
PROPOSED WORK
The applicant proposes to develop lots 108 and 110. This work includes shoreline
stabilization, site clean-up and the construction of two residential structures. The applicant
proposes to construct 435 ft. of wooden bulkhead, approximately 2 ft. waterward of an
existing derlick bulkhead. The proposed bulkhead alignment would be an average distance of
10 ft. and a maximum distance of 15 ft. waterward of the NWL. The proposed bulkhead
will tie into the neighboring adjacent bulkhead structures. Existing large quantities of
damaged bulkhead and rip-rap debris litter the shoreline and would make the construction of
the new bulkhead at the two foot waterward of the NWL contour difficult.
Proposed work also includes the repair and replacement of the existing 15 ft. wide boat
ramp and wooden jetty structure. The proposed jetty would extend 15 ft. waterward of the
NWL and would be adjacent to the boat ramp's waterward entrance.
Other work proposed includes the removal of the abandoned and damaged structures
within the Estuarine Shoreline and grade and stabilize approximately 17,250 sf. (0.40 A.) of
the three lots. The two proposed residential structures and their associated septic drainfields
would be adjacent to but outside of the Estuarine Shoreline AEC.

ANTICIPATED IMPACTS
The proposed bulkhead will result in the loss of 4325 sf. of public trust waters and
estuarine waters. Due to the existing derlick bulkhead and rip-rap debris, use of these waters
by resources or by the public is near impossible. The placement of the proposed bulkhead at
a 2 ft. average distance waterward of the NWL would require the removal of a significant
quantity of old bulkhead debris and would probably increase turbidity levels. The proposed
alignment of two feet beyond the derlick bulkhead structure would minimize site disturbance
and turbidity. In addition, the proposed clean up of the debris along the estuarine shoreline
would prevent this debris from washing into the waters of the Albemarle Sound. The two
proposed residential structures would be outside the CAMA Estuarine Shoreline AEC.
Water turbidity levels will temporarily increase during bulkhead construction. To
reduce turbidity in the adjacent Estuarine Waters, the proposed site grading and clean up, as
well as the residential construction, would be done after the bulkhead construction is
complete.
CAMA REVIEW
The proposed project involves the Public Trust, Estuarine Waters and Estuarine
Shoreline Areas of Environmental Concern. The proposed project includes the stabilization
of less than 500 linear feet of shoreline. The proposed development does not exceed the
30% area of impervious surface coverage within the estuarine shoreline limitation (7H
.0209). Other than lot clean up and grading, the associated residential construction is
outside of the Estuarine Shoreline AEC.
No historical/archeological significance is associated with this lot. No endangered or
threatened species of plant nor animals have been identified in the project area. The lot is not

NOTICE OF FILING OF
APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that JAMES JESTER
AND MIKE LASSITER CONSTRUCTION COMPANY of Pasquotank County, filed an
application on June 30, 1995, for a permit from the Division of Coastal Management to
develop in an Area of Environmental Concern and for certification from the Division of
Environmental Management that a discharge of fill material in project wetlands will not
violate applicable water quality standards.
According to said application JAMES JESTER AND MIKE LASSITER
CONSTRUCTION COMPANY propose to construct 435 ft. of wooden bulkhead
approximately 2 ft. waterward of an existing derelict bulkhead. The proposed alignment
would be an average of 10 ft. and a maximum distance of 15 ft. waterward of the NWL.
The project also includes the re-construction of the existing boat ramp and a wooden jetty
adjacent to the boat ramp, as well as clean up and grading of the Estuarine Shoreline. The
project site is located Lots 106, 108 and 110, Weeks Drive, Riverview Acres, Pasquotank
County, Pasquotank River.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business
hours at the office of Dennis W. Hawthorn, Division of Coastal Management, located at
1367 US 17 South, Elizabeth City, N.C., 919/264-3901, and/or the office of Deborah
Sawyer, Division of Environmental Management, DEHNR Regional Field Office,
Washington, N.C., 919/946-6481.
The Division of Environmental Management proposes to take final action on this
water quality certification on or before August 19, 1995. The issuance of the CAMA Major
Development permit and the Section 401 Certification may deviate from this projected date
depending upon the nature of the comments submitted and subsequent hearings that may
result.
All persons desiring to make comments should do so in writing to Roger N. Schecter,
Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
August 14, 1995 for consideration in the CAMA permit decision, and to Mr. John Dorney,
Division of Environmental Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
August 9, 1995 for consideratior in the water quality certification decision. Later comments
on the CAMA application will be accepted and considered up to the time of permit decision.
Project modifications may occur based on review and comment by the public and state and
federal agencies. Notice of the permit decision in this matter will be provided upon request.
