Director Division of Water Quality Dear Mr. Wrench: You are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T .1300, you have been found to be in violation of your 2T .1300 Permit. Violation 1: Failure to maintain waste levels in your waste structure in accordance with the facility's Certified Animal Waste Management Plan. (Permit No. AWS820719 Section V 2.) On August 14, 2008 a waste structure liquid level was documented at 11 inches of freeboard at Lagoon 1. A level of 19 inches is the minimum level allowed by your permit, including a structural minimum of 12 inches. Required Corrective Action for Violation 1: Continue to follow the proposed actions outlined in your Plan of Action (POA) received in the Fayetteville Regional Office on August 15, 2008. Take all necessary additional steps to insure lagoon levels remain in compliance with Section V 2 of your permit. An on-farm record review conducted on Sept 26, showed that weekly freeboard readings were 20 inches or less for four weeks prior to the incident. A weather station at Clinton has recorded at least nine instances of rainfall of 2-11 inches per week this year. Storms raise lagoon levels by at least an amount equal to the storm depth. Please bear in mind weather risks when operating your system. Violation 2: Failure to maintain waste system inspection records, and to notify Division of Water Quality of inadequate freeboard in your waste structure within 24 hours. (Permit No. AWS820719 Section UI 1 and 111 13 c) Your permit specifically requires inspection of the waste system after each storm event of greater than one inch, and notification to DWQ by telephone within 24 hours following first knowledge of the occurrence of a reportable permit condition. These inspection records were not kept prior to the Division of Soil and Water Conservation Operations Review of August 14, 2008. This review, undertaken in accordance with G.S. 143- 215,1OD, is one of two routine site visits scheduled for all subject animal operations in 2008. Staff from the Division of Water Quality will conduct a separate compliance inspection. During the operation review, the following item was noted: The wastewater level was eleven inches below the top of the lagoon. Wastewater levels at this elevation are considered to be in the structural freeboard of the lagoon. It was for this reason that your operation was referred to the Division of Water Quality for further investigation and possible enforcement action. G.S. 143-215.1 OE requires staff from the Division of Soil and Water Conservation to notify the Division of Water Quality and the owner/operator ol'these observed violations. It was observed that no records have been maintained of waste application to the spray fields and that no waste analysis samples had been collected within 120 days of that application. The existing traveling gun for waste application could not be calibrated an therefore requires replacement for certification. The waste application fields have weed problems and require maintenance. In regard to the deficiencies noted during the inspection, the following actions are requested: 1. Immediately begin recording waste application to the spray fields on the appropriate forms. Contact a technical specialist for assistance with recordkeeping and the appropriate forms. 2. Obtain a certified waste management plan within 60 days upon receipt of this letter. 3. Collect waste analysis samples every 120 days or within 60 days of spraying from your lagoon for accurate recordkeeping. 4. Calibrate the existing traveling gun or replace the gun with a model that can be calibrated for accurate recordkeeping of waste application on the spray fields.
