STEVEN9 RETURN RECEIPT REQUESTED DIRECTOR Randy Tyndall 189 Beaverdam Road Clinton, NC 28328 SUBJECT: NOTICE OF DEFICIENCY Randy Tyndall Farm Facility No. 82- 538 Sampson County Dear Mr. Tyndall: On October 14, 1999, staff from the Fayetteville Regional Office of the Division of Water Quality conducted a routine inspection of your swine facility located in Sampson County. It was observed that the lagoon dikes were not being maintained to the toe of the slope. Trees were observed on the back slopes of the lagoon dikes and need to be removed as required by General Permit condition 11.10 which states that "Trees, shrubs, and other woody vegetation shall not be allowed to grow on the lagoon/waste storage pond embankments. All trees shall be removed in accordance with good engineering practices.". A review of the irrigation records indicated that the Plant Available Nitrogen (PAN) rate for the 1998-99 small grain overseed had been exceeded by 22 pounds on pull 2B. General Permit condition 111.6.f states that "The Permittee shall report by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 flours following first knowledge of the occurrence of any of the following events: (f) Overapplying animal waste either in excess of the limits set out in the CAWMP or where runoff enters surface waters.". It was also noted that freeboard were not being maintained. General Permit condition 111.2 states that "Waste lagoon and storage pond levels shall be recorded weekly on forms supplied or approved by the DWQ.". Contact the local NRCS district for assistance in removing the trees from the back slopes of the lagoons. Maintain both the inside and back slopes of the lagoon dikes so that they can be inspected routinely for evidence of erosion, seepage, and damage by animals. 2. Comply with the Certified -An imal_Waste_Man agement_Plan_(CAWMP_)_and_the_General-Permit-when applying waste using the correct PAN rates as specified for each crop. 3. Immediately begin recording weekly freeboard levels in order to be in compliance with the General Permit. Please notify this office in writing on or before February 11, 2000 at the letterhead above as to the actions taken or proposed to be taken to resolve these deficiencies. Nothing in this letter should be taken as absolving this facility of the responsibility and liability of any violations that have or may result from these deficiencies. The actions we will take to resolve these deficiencies are as follows: 1. By the spring my plans are to cut the small trees down and spray to gain control over our problem with briars. At that point we will then reseed the slopes to get a good coverage. 2. There was a mistake made on our PAN for pull 2B. 1 am watching the hours closely. 3. 1 have the paperwork for freeboard levels and have began weekly recordings. Please make any corrections that are necessary and return the signed copy to the address at the bottom of that page. You only have to review items 1 thru 8 and signed the form. The Raleigh Central Office has said you do not have to submit a copy of the most current waste plan. This form has to be completed and returned to the central office before a new Certificate of Coverage can be issued.
