The lagoon contained only 12 inches of freeboard, and the some of the spray fields contained standing storm water., Inspectors contacted Mr. Barefoot to inform him that a visit was made to the farm and the lagoon contained only 12 inches of freeboard. Inspectors met with Mr. Barefoot the following day to advise him on what areas could be utilized for waste application to prevent runoff. A routine inspection was conducted on this facility on March 9, 1999. It was observed that the lagoon was stili in the emergency storage level (18 inches) and the discharge pipes, entering the Iagoon from the buildings, had eroded portions of the inside slope. It was also noted that the lagoon had accumulated substantial amounts of sludge. The facility was utilizing portable aluminum pipe along with a stationary gun for means of irrigation. The aluminum pipe appeared to leak at approximately every joint when waste was being applied. One of the pipe joints, at the time of the inspection, was Iocated less than five feet from a ditch which leaves the property. The Division of Water Quality requests that the following items be performed: 1. Lower the lagoon level to the required freeboard on a suitable waste application field as weather permits and per the Certified Animal Waste Management Plan (CAWMP). 2. Extend the discharge pipes from the buildings to the lagoon in order to prevent erosion of the inside slopes. Consult with a technical specialist for assistance in determining how the sludge accumulation in the lagoon will be removed and where the material will be land applied once removed. 4. Please do not locate the aluminum irrigation pipe adjacent to the ditch in order to prevent any wastewater from entering the ditch as a result of the joints leaking. Conduct a through inspection of the irrigation equipment before and during an irrigation event to prevent any wastewater from leaving the field. Please notify this office in writing on or before March 26, 1999 at the letterhead address as to the actions taken or proposed to be taken to resolve these deficiencies. Nothing in this letter should be taken as absolving this facility of the responsibility and liability of any violations that have or may result from these deficiencies. By covering or extending the fill pipes the farm operator will not be able to observe the rate at which the recycle rater fills the tank This is critical because the tanks are often set up to dump periodically with a timer. if the tanks dump before they are fined the result is insufficient, water to completely wove the manure out of the pit thus creating more odors from the building. Conversely, if the tank fills before it is time to dump, you risk a spill via a blocked overflow pipe. In addition we also question the effectiveness of requirement No. 1 and believe that both of these rules will have a negligible or adverse effect on odor and could produce negative impacts on water quality. June 10, 1994 Page 2 Requirement No. 1 states that the discharge point of the pipe from the buildings shall enter below the surface of animal wastewater lagoons. This requirement will make it impossible for the operator to observe what is being discharged from the buildings. A pipe that becomes clogged may go undetected leading to a back up of recycle water in the pit with the potential to spill out of the building The operator also will not be able to detect any unusual discharge such as fresh water from a leak or malfunction. The added turn in the pipe needed to direct the flow under the lagoon surface could also increase the chance of a blockage. Because of these concerns we have not covered or extended the fill pipes on the dump tanks at any of the farms that we own or manage. We have extended our discharge lines under the surface of the lagoons. We have advised our growers to extend their discharge lines but have given them their choice on how to handle the flush tanks. Most have opted to leave them as is. l have included a list of farms associated with TDM in your region_ This includes farms, which we own, manage, or grow hogs on Contract for us. Annual permit fees are billed following the issuance of the permit and then annually thereafter on the anniversary of that date. Your animal waste management system permit was issued on 61512001.
