In response to your letter dated June 6, 1995 requesting additional
information to expedite the application process for my proposed boat
basin and dock, I am submitting the following:
(1) The original application and work plans sent to CAMA, which
they received on March 7, 1995.
(2) The revised application and work plans sent to CAMA, which I
mailed on April 24, 1995.
The original application shows a boat basin of 30, long by 15' wide,
with a 4' depth. Since the ditch to be excavated measures 14, wide at
the opening (at my property line) and narrows to 9' wide at the end of
the 30' proposed boat basin length, it was my estimate that
approximately 30 cubic yards of material would need to be excavated
from below water level, and approximately 10 cubic yards would be
excavated above water level.
The original plan submitted was intended to be the least damaging to
water and wetland areas. It has been my intention from the start NOT
to remove any wetland material. The original application, in fact,
indicates under Item 6(d) that the area to be excavated does not
include marshland, swamps, or other wetlands. However, when this
application was returned to me by CAMA, they disagreed. They
indicated that the wetlands run along the entire edge of the ditch
alongside the proposed boat basin.
Therefore, I revised the application as follows. Rather than disturb
any of the wetlands (and therefore, rather than excavate any material
above the water level, I now propose to excavate only the ditch mud.
The revised boat basin will now be 30' long by 14' wide (at the ditch
opening) and 9' wide (at the end of the 30' length). The depth will
still remain at 4' in order to accommodate my boat. So basically, I
will only be dredging the creek of mud, without causing adverse
impacts to the wetlands.

The proposed boat dock has not changed from my original application.
It remains at (2) sections of 31x15' dock. This, too, was designed to
cause as little impact to the wetlands as possible.
I hope I have answered all questions and concerns. It has been my
goal from the start of this proposed basin to cause as little impact
to the environment as possible. I cannot see any other alternatives
to building the boat basin with less of an impact.

the Army authorization and a State Water Quality Certification to construct
a boat dock and undertake excavation activities within a man-made canal on
their property, located off Ensign Road, in Sea Vista Subdivision, adjacent
to Pierce Creek, Oriental, Pamlico County, North Carolina. Your receipt of
this letter verifies your acceptance of a valid request for certification
in accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until
the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases,
60 days after receipt of a request for certification is a reasonable time
for State action. Therefore, if you have not acted on the request, or asked
for an extension of time, by August 7, 1995, the District Engineer will
deem that waiver has occurred.

9. NARRATIVE DESCRIPTION:
Project Setting
The applicants own lots #56, #57 and #58 in Sea Vista Subdivision in Oriental at
the head of a manmade canal off of Pierce Creek in Pamlico County. Both lots are
high ground except for a 10' to 15' border of coastal and/or 404 wetlands S a ina
cynosuroides dominates the marsh) bordering the canal adjacent lot #56. The adjacent
property downstream (lot # 55) has a similar fringe of coastal and 404 wetlands. This
adjacent property has a single private dock. And although the navigable section of the
canal ends at the applicants' northeast property line, the canal itself extends on for
another 30'-35' before it turns into a 6'-wide by -1.5' deep drainage ditch that
eventually ends on lot #58. The southeast property line is located along the centerline
of the ditch/canal. The property across the ditch/canal is the other adjacent riparian
property and has a 6'-10' fringe of marsh as well. Both adjacent riparian property
owners have signed that they have no objections to the project as proposed.
The water depths of this canal adjacent the project site are -4.5' below NWL and
average between -5.5 and -6' for most of the distance to its confluence with Pierce
Creek. The canal itself is not a designated Primary Nursery Area although the upper
reaches of Pierce Creek just above the canal mouth is designated as a PNA. Pierce
Creek is SA NSW waters and is closed to shellfishing.
Project Description
The applicants propose to excavate a boat basin at the headwaters of a canal
adjacent Pierce Creek. The area to be excavated measures 30' in length by an average
of 11.5' in width and is to be at a depth of -4' (the existing water depth is
approximately -1.5' below NWL). The applicants also propose to construct a 15' long
by 3' wide dock over the marsh. In addition, the applicants propose to construct a 15'
long by 3' wide access from high ground to the dock.
Anticipated Impacts
The excavation within the Estuarine Waters of the canal/drainage ditch would
result in the removal of 345 ft' of shallow water habitat. The excavation activities
would result in the removal of approximately 32 yds3 of soft mud material. Since the
applicants propose to excavate immediately adjacent to the marsh, it is anticipated that
approximately 2' of marsh along each bank would eventually be lost due to a sloughing
off of the bank adjacent the cut and would result in a loss of 120 ft' of Coastal
Wetlands. Minimal impacts to additional Coastal Wetlands due to shading from the
dock would also be expected.

9. NARRATIVE DESCRIPTION:
Project Setting
The applicants own lots #56, #57 and #58 in Sea Vista Subdivision in Oriental at
the head of a manmade canal off of Pierce Creek in Pamlico County. Both lots are
high ground except for a 10' to 15' border of coastal and/or 404 wetlands S artina
cynosuroides dominates the marsh) bordering the canal adjacent lot #56. The adjacent
property downstream (lot # 55) has a similar fringe of coastal and 404 wetlands. This
adjacent property has a single private dock. And although the navigable section of the
canal ends at the applicants' northeast property line, the canal itself extends on for
another 30'-35' before it turns into a 6'-wide by -1.5' deep drainage ditch that
eventually ends on lot #58. The southeast property line is located along the centerline
of the ditch/canal. The property across the ditch/canal is the other adjacent riparian
property and has a 6'-10' fringe of marsh as well. Both adjacent riparian property
owners have signed that they have no objections to the project as proposed.
The water depths of this canal adjacent the project site are -4.5' below NWL and
average between -5.5 and -6' for most of the distance to its confluence with Pierce
Creek. The canal itself is not a designated Primary Nursery Area although the upper
reaches of Pierce Creek just above the canal mouth is designated as a PNA. Pierce
Creek is SA NSW waters and is closed to shellfishing.
Project Description
The applicants propose to excavate a boat basin at the headwaters of a canal
adjacent Pierce Creek. The area to be excavated measures 30' in length by an average
of 11.5' in width and is to be at a depth of -4' (the existing water depth is
approximately -1.5' below NWL). The applicants also propose to construct a 15' long
by 3' wide dock over the marsh. In addition, the applicants propose to construct a 15'
long by 3' wide access from high ground to the dock.
Anticipated Impacts
The excavation within the Estuarine Waters of the canal/drainage ditch would
result in the removal of 345 ft2 of shallow water habitat. The excavation activities
would result in the removal of approximately 32 yds3 of soft mud material. Since the
applicants propose to excavate immediately adjacent to the marsh, it is anticipated that
approximately 2' of marsh along each bank would eventually be lost due to a sloughing
off of the bank adjacent the cut and would result in a loss of 120 ft2 of Coastal
Wetlands. Minimal impacts to additional Coastal Wetlands due to shading from the
dock would also be expected.

only high quality copies will be accepted. Blue-line

APPLICATION FOR CAMA MAJOR DEVELOP
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that Joseph and Dawn
Dixon of Pamlico County, filed an application on April 25, 1995, for a permit from the
Division of Coastal Management to develop in an Area of Environmental Concern and for
certification from the Division of Environmental Management that a discharge of fill material
in project wetlands will not violate applicable water quality standards.
According to said application, the applicants are proposing to construct a dock and
excavate a basin at a man-made canal off Pierce Creek, in the Town of Oriental, Pamlico
County.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business
hours at the office of Ted Tyndall, Division of Coastal Management, located in the Division
of Marine Fisheries Building, Morehead City, N.C., (919) 726-7021, and/or the office of
Deborah Sawyer, Division of Environmental Management, DEHNR Regional Field Office,
Washington, N.C., (919) 946-6481.
The Division of Environmental Management proposes to take final action on this
water quality certification on or before June 19, 1995. The issuance of the CAMA Major
Development permit and the Section 401 Certification may deviate from this projected date
depending upon the nature of the comments submitted and subsequent hearings that may
result.
All persons desiring to make comments should do so in writing to Roger N. Schecter,
Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
June 14, 1995 for consideration in the CAMA permit decision, and to Preston Howard,
Director, Division of Environmental Management, P.O. Box 27687, Raleigh, N.C., 27611,
prior to June 9, 1995 for consideration in the water quality certification decision. Later
comments on the CAMA application will be accepted and considered up to the time of permit
decision. Project modifications may occur based on review and comment by the public and
state and federal agencies. Notice of the permit decision in this matter will be provided upon
request.
