Dear Mr. Hoffer:
You have our approval to place fill material in 2.4 acres of wetlands or waters for the purpose of
constructing waterfowl impoundments at SR 1300, as you described in your application dated 16 May
1995. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26
when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

This approximate 1,000 (!r1111) is locrited on Dur,a nt.'s Neck in
eastern Perquimans County. Durant's Nec k Lies between the
Por•qu i mans and l,i tt le River-q. The farm is own ed by the Hoff'ler-
brothers who have a logging firm arid has been farmed by Mr.
Chappell si.nee 1963. Corgi, soybeans and wheat, are the major-
crops grown. Some of the more, erodable lands have been seeded to
per-marient. pasture, pri.mar-i_I,v Pe,-;cue.
The area was visited on December- 17, 1991 in the company of hlr•.
Chappell and Perquimans County Soil. Conservation Service District,
Conservationist John D. Myers and Pasquotank County Di_str•.ict
Conservat.iorri.st. Ri.charrd D. Hinson. Four Potential wetland
deveLopment sites were visited of which one Was already
completed. All arc on-farm upper- tributaries of Muddy Cr•c!ek
which empties into the Perquimans River- to the south.

Proposal
Four potential sites were visited and one was completed in 1990.
The completed one is termed site #1 and consists of an
approximate 100-feet road-dike across a former drainage ditch in
the central portion of the farm. A 36-inch culvert and 48-inch
riser are in this road-dike and the riser boards are manipulated
by Mr. Chappell so that from one to two acres of winter water are
held over planted Japanese millet and a variety of natural
plants, the majority of which are fair to good quality duck food
species.
Site #2 is approximately 400 yards south of site #1 at the head
of another tributary of Muddy Creek. It too involves plugging a
drainage ditch that serves several hundred acres of cropland.
' The watershed and ditch are larger than site #1 and construction
of an embankment approximately 200 feet long would be necessary.
The culvert would be 42 inches in diameter and a 54-inch riser
would be necessary according to Mr. Myers. This would inundate
an area of marginal cropland up to five acres in size.
Site #3 is approximately 100 yards north of site #1 on another
spur of the same Muddy Creek tributary draining site #1. As site
#2, it has a large watershed and would require up to 200 feet of
levee, a 42/54-inch culvert/riser structure and flood up to five,
acres. This site is bordered by permanent, fescue cover in the

lower half and by cropland in the upper reaches of the proposed
impounded portion.
Site #4 is located in the northwestern portion of the property
approximately 1/3 mile northwest of site #1 at the head of still
another branch of a Muddy Creek tributary. It has about 200
acres of watershed. The site was wooded with mature cypress and
hardwoods until the spring of 1991 when it was clearcut. A
drainage ditch bisects it also and it is surrounded by cropland
on three sides. It will require an approximate 200-foot dike and
a 36 inch culvert with a 48-inch riser. Dike material will need
to be taken from within the proposed ponded area resulting in a
permanent water pool inside the estimated two-acre impoundment.
Wildlife Management.
Sites #'s 1,2 and 3 all should be managed similarly, that is-
spring-summer drawdown and fall-winter inundation. The only
source of water will be rainfall and watershed flow. Site #1
already has been in operation two winters and as mentioned, a
variety of planted and natural waterfowl foods were observed.
Top soil from the dike end of the impoundment was used for
dike/road construction causing a poor grade of soil available for
the planted Japanese millet at this end. It appeared to have
done well on the non-disturbed end however. Natural foods noted
included the good duck foods fall panicum, foxt.ail and at le'ast

two species of smartweeds. Duck feathers and down were observed
and Mr.. Chappell mentioned a few species of ducks that have been
seen in the pond the past two winters. My recommendation for-,

site #1 is to continue to draw it down next sp ring and till?the
so and plant Japanese or brown-top millet, in the pond bottom,
parti cularly the half that was scraped to buil d the dam. Natural
foods will no doubt: continue to thrive in the unplanted portion.
These are of better- quality and quantity Lhan domestic millets.
In the event of a dry spring and summer, it may be well to retain
a board or two in the control structure to provide shallow water
for various species of wildlife, including several species of
shore, rnarshr an JJ ?Zding birds.

Site #2 can be managed the same way but here some preliminary
work is essential. A stand of phragmites occurs a 100 feet or so
above the proposed levee site. It is currently kept in check by
adjacent crop tilling and it, is recommended that it, be continued
to be controlled each year, or it will, take over the entire pond
site. The area also has a cattail and brush sump between the
phragmites and dam site which should hose no problem and may
serve as a semi-permanent pool site.
Site #3 is currently in rescue and brusi? and has not: been tilled
in four or five years. Prior to complO.ion it, will require
a

mowing and deep plowing to control undesirable perennials already
established. Plant succession needs setting back to the annual
stage. District Conservationist Myers mentioned a retention of
this fescue cover from the proposed water line for :30 feet into
the adjacent croplands to serve as a buffer. I agree with this
recommendation and that it apply to all four sites.
Site #4 should be prescribed burned following levee construction
to rid the area of brush and logging debris. Removal. of stumps
is not necessary. It is my recommendation that this unique area
be maintained in a permanent pool stage if possible. It will. be
flooded deeply at the dam/spoil pool end and shallowly in the
remainder. It was a wetland prior to logging and should remain
that way. The permanent water level will inhibit undesirable
brush species from establishing and will encourage pad plants for
ducks and fish and invertebrates for wading birds, etc.. It also
should have some wood duck nest boxes installed and will. furnish
brood habitat too if maintained in a flooded condition.
Benefits
In addition to use by migrating, wintering and nesting ducks, the
completion of this project will benefit other wildlife and non-
wildlife resources. Mr. Chappell stated that numerous tundra
swans, snow geese and Canada geese have traditionally utilized

his fields for ,years. 't'hese 10-15 acres of open water will add
to the enticement of the area for these species as well.
Lesser known species of migrating wetland birds such as
sanderlings, sandpipers, plovers, killdeer, snipe, yellowlegs,
etc. will. utilize these areas' edges particularly during late
fall and early spring migrations. Local wetland associated
animals such as river otter, raccoon, muskrats and mink frequent
these areas and are a renewable resource for the consumptive
user.
These shallow water impoundments will serve as catch basins for
farm nutrient/pesticide run-off to Muddy Creek, the Perquimans
River and Albemarle Sound. Also they will serve as sediment
traps to reduce soil erosion and improve water quality in

will far outweigh this loss.
