Dear Mr. Bivins:
You have our approval to place fill material in 0.25 acres of wetlands or waters for the purpose
of repairing and stabilizing an existing dam at Richmond Technical Institute, as you described in your
application dated 19 April 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2745. This certification allows you to use
Nationwide Permit Number 3 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786.

Dear Sir:
During a routine inspection of the above referenced dam it was noticed that a sink hole
had developed on the lower face of the dam. The water level in the lake was dropped
approximately 6 feet and a inspection was made of the discharge pipe in the vicinity of the
sink hole. It was determined that there were several open joints of pipe underneath the
sink hole, that had apparently caused the migration of material through the joints of pipe
which resulted in the damage to the lower face of the dam. It was also determined at this
time that there appeared to be further damage up the pipe which was out of reach of a
physical inspection by our inspector. Therefore, we elected to run a TV camera through
the pipe for a complete inspection of the entire facility. This has been accomplished and a
copy of five photographs taken during this inspection are attached.
As you can see from the photographs we have had a complete failure of the pipe
underneath the dam and are in the process of trying to arrange repair of this dam. At the
present time the only access into the college is across the top of the dam, however, a new
roadway is being constructed on the opposite side of the campus and will be operational
sometime in July. At that time, we hope to continue to lower the lake and repair the dam
in a suitable manner.
The following items have also been attached for additional information on this proposed
repair:
1. Copy of the cover sheet for the phase 1 inspection report.
2. A copy of the vicinity map showing the location of the dam.
3. A copy of the plan of the dam and roadway.

4. A copy of the typical section of the dam and roadway.
The plan and section show the proposed modifications to the dam and roadway in order to
bring it up to acceptable standards for a structure of this classification. As can be seen the
lower face of the dam is in undelineated wetlands and by changing the downstream face
1:1 to 2:1 we will impact approximately 0.25 acres of wetlands. This area is estimated on
-the high side due to the fact that we do not know exactly where the boundaries are.
During the repair of this dam it will also be necessary to impact additional areas of
wetlands for passage of equipment and materials in this confined space.
At the present time, the school is negoiating with the army about coming in and making
these repairs as a training exercise. One of there concerns would be the proper permitting
of all activities in the wetlands.
We are hoping that you will allow us to do this work under nationwide permit no. 3. I
will be glad to meet with you on the site to go over our proposed plans with you at that
time.
We would appreciate your comments and guidance on this matter as soon as possible in
order that we may proceed with our plans.
