improvements to their existing vastewater treatment plant located on tho west
bank of the Osgood Canal. Theie proposed improvement will resul in the filling
of approximately 9,007 s.f. Atl acre) of wooded jurisdictional wc;tl ndh. The
attached maps and photographs describe the location and extant o these impacts.
Our preliminary irtvestigiAon has &'tcrMined that the wet.l nds to be
impacted are adjacent to the Osgood Canal which is above the he waters of
Burgaw Creek (s>ee attached qut?d sheeUvicinity map).
We hare radvised our client, that the wetland disturbance a sociMpd with
the expansion: should be covered by the Nationwide Permit 26. I is also our
underbt.andin that formal Motif cation of the regulatory agencies is not required
due to the fact that less than one-third acre of wetlands is being rr,pacted.
However, our client has reques=t )d that we notify the regulatory grnciPS to insure
that our interpretation of the rezulations i, correct.

The Town of Burgaw, North Carolina is preparing to construct

of approximately 9,007 s.f. (0.21 acre) of wooded jurisdictional wetlands. The
attached maps and photographs describe the location and extent of these impacts.
Our preliminary investigation has determined that the wetlands to be
impacted are adjacent to the Osgood Canal which is above the headwaters of
Burgaw Creek (see attached quad sheet/vicinity map).
We have advised our client that the wetland disturbance associated with
the expansion should be covered by the Nationwide Permit 26. It is also our
understanding that formal notification of the regulatory agencies is not required
due to the fact that less than one-third acre of wetlands is being impacted.
However, our client has requested that we notify the regulatory agencies to insure
that our interpretation of the regulations is correct.
