Dear Mr. Daughtry:
On September 20, 2000, staff from the Fayetteville Regional Office of
the Division of Soil and Water performed an annual review of the L & M
Daughtry Farm in Sampson County. The review revealed that there was over
application of nitrogen to the bermuda crop on pull # 9 by thirty-five pounds.
These deficiencies were referred to the Division of Water Quality, as required,
by The Division of Soil and Water.
In regard to the deficiencies noted during the inspection, the following
actions are requested:
1. Avoid over application of nitrogen in the future.
Please provide this office with a written response, by November 7,
2000, as to the actions taken, or proposed to be taken, to resolve the
deficiencies noted. Nothing in this letter should be taken as absolving this
facility of the responsibility and liability of any-6olations that have resulted or
may result from these deficiencies.

On September 20, 2000, staff from the Fayetteville Regional Office of the Division of
Soil and Water performed an annual review of the L & M Daughtry Farm in Sampson County.
The review revealed that there was over application of nitrogen to the Bermuda crop on pull #9
by thirty-five pounds. This deficiency was referred to the Division of Water Quality, as required,
by the Division of Soil and Water.
In regard to the deficiency(s) noted during the review, the following actions are
requested:
Avoid over application of nitrogen in the future.
2. Over application of nitrogen is to be reported to the DWQ per the General Permit
Condition III.61
Please provide this office with a written response, by January 31, 2001, as to the actions
taken, or proposed to be taken, to resolve the deficiency(s) noted. Nothing in this letter should be
taken as absolving this facility of the responsibility and liability of any violations that have
resulted or may result from these deficiencies.

Dear: Mr. Rawls
On September 20, 2000 upon inspection by soil and water I discovered an
over application of nitrogen on pull #9. Reviewing the math I found an error
on my part_ I was honest and pointed it out to the inspector. During the
summer application on coastal in the grazing phase I intentionally tried to
maximize nitrogen on these pulls. Poor growth and low fertilization was
causing poor pasture performance, cattle were not in great condition either.
Another point was to take advantage of uptake during the active growth
phase (May — Sept. 1)_ Also, the last application on coastal in September
when applied to rye left me at only 3lbs over on pull #9. There was by no
means intentional over application. I have reorganized my record keeping
so I enter directly to the IRR -2, reseeding the NOD and keeping my record
clean should be considered.

recommendation of enforcement action, to the Director of the Division of Water Resources who may

"person" who violates or fails to act in accordance with the terms, conditions, or requirements of a permit
under authority of G.S, 143-215.6A. Therefore, it is imperative that you submit the appropriate fee as
requested within thirty (30) days of this Notice of Deficiency.
