O ti??f9( ?mss X204 REFERENCE: DCM95-75: Amend Consistency for Proposed Rehabilitation of Airfield Taxiways and Runways (CD95-06), U.S. Coast Guard Support Center, Elizabeth City Dear Mr. Sykes: Thank you for providing us with information and plans for the expansion of aircraft parking aprons at the U.S. Coast Guard Support Center at Elizabeth City. The proposed work represents a modification to the proposal for taxiway and runway rehabilitation which we reviewed earlier this year (CD95-06). Based upon our review we agree to amend our consistency position to include the proposed aircraft parking apron expansion as described in the Talbert & Bright, Inc. report dated August 14, 1995. As with our original consistency position, all state authorization and or permit requirements must be met prior to implementation of the work. Fax# Fax# -, You have our approval to place fill material in 12 square yard of wetlands or waters for the purpose of replacing riprap for the proposed rehabilitation of airfield taxiways and tunw•ays at U. S. Coast Guard Support Center, as you described in your application dated 9 March 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2745. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your implication. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. The existing culvert is full of silt and not functioning. 13. Purpose of proposed work: The purpose is to replace an existing pipe that no longer performs as designed, and to drain an existing area of the airfield. 14. Since the proposed activity is located within the North Carolina coastal area and the activity could affect resources or uses of the coastal area, the Coastal Zone Management Act of 1972 is applicable to the proposed activity and a Consistency Determination pursuant to 15 CFR 930 is required.
