As you are aware, DWQ (then the Division of Environmental Management) issued a 401 Water Quality Certification allowing you to impact 3.0 acres of wetlands for fish production ponds. The Certification stated that "This approval is valid only for the purpose and design that you described in your application. If you change your project, you must notify us...". According to the letter from Mr. Gallo, you have cleared more than the approved acreage of wetlands and changed the project purpose. You did not notify DWQ of these changes. Therefore you are in violation of your 401 Water Quality Certification. We are unlikely to grant additional wetland fill for agricultural land clearing since we are concerned about the export of nutrients, sediments and pesticide residues into Big Flattery Creek and Albemarle Sound. We had no concerns about converting 3.0 acres of wetlands to fish ponds since there would be no runoff from the ponds and no loss of the storage value of these wetlands. However the conversion of wetlands to agricultural row crops is likely to result in pollutant export downstream. Also if the 5.8 acres of wetland fill is approved, it would only be approved contingent on acceptable compensatory wetland mitigation. According to our 401 Water Quality Certification rules (15A NCAC 2H .0506(h)(7)), wetland restoration will be required at a 2:1 ratio (or wetland creation at a 3:1 ratio) for the entire 5.8 acres of wetland fill. In order to correct the situation regarding the violation of our Certification, I suggest that you return to your original plan to establish fish ponds on the 3.0 acres of wetland and then restore hydrology to the remaining 2.8 acres of wetlands and allow vegetation to reestablish. The U.S. Army Corps of Engineers may also require restoration in order to bring this project back into compliance with the 404 Permit.
