Dear Mr. Treme:
You have our approval to place fill material in 0.5 acres of wetlands or waters for the purpose of
streambank stabilization at north bank of Town Creek, as you described in your application dated
15 February 1995. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 2665. This certification allows you to use Nationwide
Permit Number 13 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. Anti-
seep collars shall be located at stations as shown on the site plans. In addition, you should get any
other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Subject: Town Creek Slope
Stabilization Project
Dear Mr. Chapin:
On February 14, 1995, a meeting was held at the proposed project site for the purpose of
reviewing plans for stabilizing the north bank of Town Creek. We appreciate the opportunity to
review these plans with you.
Over a period of years since the plant was constructed, the City has maintained the slope of the
creek bank. The bank is eroding and roots of trees are exposed. The bank has periodically
slipped into the creek due to erosion. We are of the opinion that clearing the bank and stabilizing
it with rip-rap, as proposed and indicated on the drawings, is in the best interest of the City of
Salisbury and offers the best possibility of long term stabilization of the creek bank.

A letter of request for an Authorization to Construct was received October 21, 1994 by the Division
and final plans and specifications for the subject project have been reviewed and found to be satisfactory.
Authorization is hereby granted for the construction of new mechanical bar screens, new grit/scum
removal facilities, new chlorination facilities and plant piping with discharge of treated wastewater into
Town Creek.
This Authorization to Construct is issued in accordance with part III, Paragraph A. of NPDES
Permit No. NCO023982 issued June 30, 1994 and shall be subject to revocation unless the wastewater
treatment facilities = constructed in accordance with the conditions and limitations specked in Permit No.
NC0023892.
The sludge generated from these treatment facilities must be disposed of in accordance with G.S.
143-215.1 and in a manner approved by the North Carolina Division of Environmental Management
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permitme shall take immediate corrective action, including these as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Mooresville Regional Office, telephone number 704/663-1699, shall be notified at least forty-
eight (48) hours in advance of operation of the installed facilities so that an in-place inspection can be
made. Such notification to the re onal supervisor shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this pemlitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, this Authorization to Construct and the approved plans and
specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box 29535, Raleigh, NC

Upon classification of the facility by the Certification Commission, the Permittee shall employ a
certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment
facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the
classification assigned to the wastewater treatment facilities by the Certification Commission. The
Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with
the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class Il, M, and IV facility at least daily, excluding weekends and holidays, and
trust properly manage and document daily operation and maintenance of the facility and must comply with
all other conditions of Title 15A, Chapter 8A, .0202. Once the facility is classified; the Permittea must
submit a letter to the Certification Commission which designates the operator in responsible charge within
thirty days after the wastewater treatment facilities are 50% complete.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization, to Construct does not preclude the Permittee from complying
with any and all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

Technical Review Group recommend several mitigation measures to
minimize project impacts on wetland and aquatic resources.

Influent Pump Station, Salisbury, North Carolina,
Project # 617.
The North Carolina Wildlife Resources Commission (NCWRC) has
reviewed the subject document, and our comments are provided in
accordance with provisions of the North Carolina Environmental
Policy Act (G.S. 113A-1 et. seq., as amended; 1 NCAC 25), the
Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661-667d), and Section 201 of the Clean Water Act of 1977
(as amended).
The proposed project involves replacing a 24 inch RCP
interceptor sewer from East Innis Street to the Town Creek
Wastewater Treatment Plant (WWTP) with a 42 inch concrete line.
The new interceptor will parallel the existing line most of the
length. A new influent pump station will be built at Town Creek
WWTP. The document states that around 30 acres of land will be
disturbed which includes approximately 15.5 acres of bottomland
forest, 1.6 acres of upland forest, and 4.79 acres of wetlands.
NCWRC appreciates that the existing pipeline route is being
used where possible, to avoid impacts to undisturbed areas. We
support the use of strict erosion control measures as stated in
the EA. Although direct construction impacts on fish and
wildlife resources are likely to be minimal, NCWRC recommends the
following document revisions to protect the resource:
1. Provide a mitigation plan with specific commitments
to mitigate aquatic habitat impacts at stream
crossings and wetlands. Measures such as corridor
width minimization, perpendicular crossing of

streams, erosion and sedimentation control, and
restoration of ground cover and wetland/flcodplain
function should be discussed. We recommend a
corridor width of no more than 40 feet. Efforts
should be made to avoid cutting mast producing trees
and den trees. The District 6 Wildlife Biologist
(Ken Knight 704-982-1600) can be contacted for
identification of plant species important to
wildlife.
2. Provide specific information on construction
activities as they relate to possible wetland
impacts. This discussion should include information
on the proposed width of construction and permanent
easements.
3. The 4.79 acres of disturbed wetlands should be
sloped, graded, and restored to original contour and
seeded to an annual small grain such as wheat,
millet, and/or rye. We do not recommend mowing in
wetlands but allow the areas to revert back to a
natural vegetative condition following this initial
stabilization.
4. If concrete encasement is used, wet concrete should
be prevented from entering the streamflow. WeL
concrete is toxic to numerous aquatic organisms and
should be contained until sufficiently cured to
prevent downstream travel.
5. Man-holes located within the 100 year flood plain
should be sealed and vented to prevent floodwater
intrusion and to eliminate sewage escape.

The subject document has been reviewed by this office. The Division of
Environmental Management is responsible for the issuance of the Section 401 Water
Quality Certification for activities which impact 4.79 acres of waters of the state
including wetlands.
Anti-seep collars should be placed at the following station locations to prevent draining
wetlands: 63+75, 94+25, 95+75, 97+25, 100+50, 103+50, 105+00, 106+50, 113+50,
and 116+50.
DEM recommends that annuals be planted within jurisdictional wetlands for soil and
erosion control. The annuals will allow a competitive advantage for wetland species
re-establishment.
The 401 Water Quality Certification could be denied if impacts to wetlands have not
been avoided and minimized to the maximum extent practicable. Questions regarding
the 401 Certification should be directed to Eric Galamb in DEM's Water Quality
Planning Branch.

1. The mitigative plan is included in the main document
beginning on page 18. Additionally, creeks will be crossed
perpendicularly at all locations possible. A sedimentation and
erosion control plan has been prepared and its approval requested
and received. Ground cover will be restored utilizing a wildlife
seed mixture or other suitable small grain seed. We will utilize
a 40 foot easement (20' permanent and 20' construction) through
all wetland areas. A 50 foot easement (30' permanent and 20'
construction) will be used in all other areas. All trees will be
removed within permanent easement to prevent root intrusion into
sewers. Contractor will be instructed to remove as few trees as
possible in construction easement.
2. Construction in wetlands will be limited to 40 foot
easements as noted above. Sedimentation basins will not be
constructed in wetlands but rather upstream of wetlands in order
to prevent siltation into wetlands. Silt fences can be utilized
to delineate wetlands from areas being disturbed to provide
additional protection.
3. All disturbed land will be sloped, graded and returned
to original contours. Wetlands can be seeded in small annual
grains. Owner will be notified to refrain from mowing in
wetlands.
4. Contractors will be instructed to divert small streams
where sewer crosses and concrete encasements are being proposed.
For large streams, contractors will be instructed to install
concrete encasement across half of stream at a time, allowing free
flowing stream across the other half away from fresh concrete.
5. All manholes within 100-year flood plan have been
designed as sealed and vented.
III. Responses to Division of Land Resources Comments:
A sedimentation and erosion control plan has been prepared.
Approval of said plan has been received. See attached letter in
Appendix I. No portion of the project is located in a High
Quality Water Zone.
IV. Responses to EHNR Checklist Comments:
An NPDES permit is not required because the project is not
changing the permitted capacity of the Town Creek WWTP. A
construction permit will be required. All open burning will be
performed in accordance with 15A NCAC 21 H.0600. The
sedimentation and erosion control plan has been approved. See
Appendix I.
V. Responses to Comments from Eric Galamb:
Anti-seep collars have been designed and noted on the
construction drawings at the requested stations. As noted under
Item 11.3. above, annual small grains will be planted within
jurisdictional wetlands.

Notice required by G.S. 113A-61(d) of our right of periodic
inspection to insure compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Program is
performance oriented, requiring protection of the natural
resources and adjoining properties. If following the
commencement of this project it is determined that the erosion
and sedimentation control plan is inadequate to meet the
requirements of the Sedimentation Pollution Control Act of 1973
(North Carolina General Statute 113A-51 thru 66), this office may
require revisions to the plan and implementation of the revisions
to insure compliance with the Act.

The revised EA adequately addresses the previous concerns raised
by the Wildlife Resources Commission during the Department of
Environment, Health, and Natural Resources review of the EA. In
addition, the revisions incorporate the mitigation measures
recommended by our Water Quality Section regarding placement of
anti-seep collars and the planting of annuals for soil and
erosion control.
The document is, therefore, ready to be forwarded to the
State Clearinghouse for review. This letter and attached
memorandum will need to be included in an appendix of the
document we forward to the State Clearinghouse. For your
information the next Clearinghouse submittal deadlines are on
June 17 and July 1. Please submit ten copies of the EA to my
attention and I will prepare a Finding of No Significant Impact
(FONSI) to attach to the documents we send to the State
